From what you said this morning about 10 years of silt containment being equivalent to approximately 6,000 cubic yards of silt, I can't imagine these ponds originally being very deep. i.e., 10— 12 feet. I'm curious because some of the public might ask if these can be turned into recreational boating and fishing amenities. There was no data kept on the depth for the permanent water pool. Based on the Ac. Ft. of sediment storage and the surface area 1 came up with an average depth. Site 4, RC, average depth was 3.8'. The deepest was 12.0'in the channel. Looking at the cross section when it was constructed, I estimate the depth at 5.5'for the majority of the lake. Site 5, RC, average depth was 4.2'. The deepest was 8.0'in the channel. Looking at the cross section when it was constructed, I estimate the depth at 6.2'for the majority of the lake. Site 7, RC, average depth was 3.4'. The deepest was 6.1'in the channel. Looking at the cross section when it was constructed, I estimate the depth at 4.8'for the majority of the lake. With the current depths of the lakes you would not want to allow any motorized boats. Paddle boats, canoes, etc. would be acceptable. Even if you added another 4.0'of depth, the front face of the dam and the shoreline would have to be protected from wave erosion caused by motor boats. A developer is dedicating approximately 43 acres of parkland to the City of Wylie, and this includes the southern portion of Muddy Creek Reservoir—the dam, spillway area, containment area,and area below the dam. Since we will be the property owners,we'll need to know the applicable easement restrictions,maintenance of certain areas,mowing,erosion control, inspections,record keeping, safety,required signage,etc. Can you forward us information about that? Also,would the city be allowed to use the water behind the dam for irrigation purposes? In other words, could we pump water out of the containment area? The easement restrictions is you can do anything within the easement as long as it does not interfere with the operations of the structure. You could put a concrete path on the dam or in front of the dam. Any amenities would have to meet the ADA requirements. The grass cover would have to be maintained. As far as the maintenance, Collin County Commissioners Court has that responsibility. They are going to do the minimum. A city, owner, etc. can maintain the dams as long as no damage is caused. Helping People Help the Land An Equal Opportunity Provider and Employer Any disturbance in the spillway needs to be kept to a minimum. If and when the earthen spillway functions anything that alters the water flow can potentially cause failure. Essentially any traffic, both pedestrian and vehicle, on the dam and spillway needs to be kept at a minimum. The dam you are referring to is very tall and steep. A person could very easily fall down dam and become injured As far as the City of Wylie's liability would have to be determined by an attorney. You can pretty much do as you wish as long as it does not interfere with the operations of the structure. Any changes within the easement need the approval of the Collin County Soil and Water Conservation District. Using water out of the lake or outfall of the lake is controlled by the State of Texas. You can use surface water in Texas for livestock and domestic use only without a permit. All other uses require a permit from the TCEQ. Since that water goes into Lake Hubbard, I imagine that the city of Dallas would object. I really don't know for Hubbard. I know anything that goes into Lake Lavon is controlled by the North Texas Municipal Water District. They object to any water use without some mitigation. Such as drilling a well and replacing what is removed plus additional amounts. Do you have any contacts in the City of McKinney that we could contact regarding their pond rehabilitation project? I would like to ask them why they are rehabilitating the ponds,if it was in response from public concern, safety-related issue, or developing an amenity for future use. I would also like to know the scope and cost of their project. The City of McKinney incorporated their lakes in their Storm Water Maintenance Plan. Essentially the city saw the lakes as a benefit. With the lakes being developed and taken out of agriculture, and they are getting old, they wanted to do what was necessary to ensure their safety, and extend their useful life. Discussion In 2005,the Wylie Economic Development Corporation(WEDC)purchased 25 acres to be developed as a well- ordered business park. To be named Premier South Business Park, the site is located adjacent and south of Holland Hitch with frontage on Martinez Lane. The WEDC will soon be platting Premier South and breaking ground on its first project — a 20,050 square foot facility being developed by JTM Technologies. As well, the WEDC, in partnership with the City of Wylie, will begin improving Martinez Lane from a 24-foot asphalt design to 36-foot concrete street with curb and gutters(a$500,000 project). As Premier South is platted, the WEDC will be subject to a $25,000 parkland dedication fee. The WEDC is seeking relief from that fee based upon the dedication of open space to the Department of Parks and Recreation. While the WEDC would prefer for the fees to be waived based upon the WEDC's status as a governmental entity and component unit of the City of Wylie, there is no policy in place to allow such a waiver. Therefore, the only option available is to dedicate property with a value equal to or greater than that of the dedication fee. The only flaw in this approach is that the property the WEDC is attempting to dedicate is not on the trail system master plan. However, the WEDC will argue that the site could connect adjacent neighborhoods to existing City of Wylie property which will become parkland. The open space in question is 5.959 acres and located at the easternmost portion of Premier South as shown on the attached aerial. A more detailed version is provided as exhibit A. The existing wastewater treatment facility, located on 6.8 acres, is scheduled to be closed in the next 5 — 10 years per the City Engineer. Based upon its existing wastewater use, the future use will most likely be open space. Further to the south is 39.8 acres owned by the City of Wylie. Previously the Alanis landfill, the only allowable use of this site will be a park, as anticipated by the City of Wylie Parks Department. The missing piece to this proposed open space is the property due north of the City 6.8 acres. Being that this piece is predominantly in the floodplain, a future link to the WEDC 5.9 acres is not unimaginable. The WEDC purchased Premier South for $639,000. The only comparative sale of floodplain property identifiable to the WEDC was 3.2 acres purchased by Bayco near Sanden Boulevard. The 3.2 acres was purchased for $45,000, or $0.323 per square foot. Translated to the 5.959 acres, the WEDC sight could have an arguable value of$83,798. The WEDC appreciates your consideration of this issue. Staff has considered redeveloping a portion of this 40 acre +/- site with a two one acre +/- dog parks, one located in the northwest area of the site and one located in the southeast area of the site. Minimal development is permitted at the site per TCEQ regulations, and a dog park would have minimal impact to the site. The remaining acreage would be developed in the future. The dog park would satisfy a growing citizen demand for this type of facility in the area. Improvements would include two parking lots, sidewalks, two fenced areas to allow for usage and maintenance rotation, water supply, landscaping, irrigation, signage, picnic tables and benches. Such locations can be found in the Bozman Farms and Birmingham Farms developments as well as nearby Army Corps of Engineers land. The disc golf course would satisfy a growing citizen demand for this type of facility in the area. The park is located adjacent to a creek, and its accessibility is limited by terrain along its eastern edge. Installation of a pedestrian bridge in this direction would allow residents living to the east of park to have greater accessibility. Installation of a second pedestrian bridge would provide a needed connection to a future nature trail towards the south. This project would include site preparation and grading, landscaping, irrigation, extension of concrete walking trails, picnic pavilion, picnic tables, benches, drinking fountain, and installation of two pedestrian bridges. Last year, an assessment of the lighting system was conducted, and the report indicated that the existing wiring has weathered and deteriorated to the point that accidental electrocution was a possibility. This report coincides with annual observations made in the past by the electrical contractor performing annual maintenance to the lights. This project would include consultant services to specify significant upgrades and repairs to the existing system, install a new remote control Musco link for remote operation of the lighting system, and install all related electrical components and appurtenances including transformers, breakers, conduit, wiring, etc. PRELIMINARY PROJECT BUDGET ACCOUNT NO. Basketball courts are listed as a moderate priority on the Wylie Parks, Recreation and Open Space Master Plan. The Master Plan identified Friendship Park as a site that needed to be upgraded, and the plan recommended the addition of seven more basketball courts by the year 2011. It has not been annexed into the City. The Collin County Appraisal District's website lists the market value at $1,490,497. Approximately 60% of the site is located in the flood plain.
