02-16-2015 (Zoning Board of Adjustment) Minutes Wylie Zoning Board of n cal: WYI_II Adju stment Minutes Zoning Board of Adjustment Monday, February 16, 2015 — 6:30 pm Wylie Municipal Complex — Council Chambers 300 Country Club Road, Building 100 CALL TO ORDER Chair Linda Jourdan called the meeting to order at 6:30 p.m. and stated that a quorum was present. Board Members present were; Vice Chair Jason Potts, Board Member Robert Holcomb, Board Member Kevin Finnell and Board Member Karyn McGinnis. Staff members present were: Renae' 011ie, Planning Director and Mary Bradley, Administrative Assistant. CONSENT ITEMS 1. Consider and act upon approval of the Minutes of the January 26, 2015 Meeting. A motion was made by Board Member Potts and seconded by Board Member Finnell, to approve the Minutes from the January 26, 2015 Meeting as submitted. Motion carried 5 — 0. PUBLIC HEARINGS Item 1 —ZBA 2015-02 Hold a public hearing to consider and act upon a request by Russell Heileman for a Variance to Section 2.5.C.e.2 and of the Zoning Ordinance from the requirement of an accessory structure covering more than 2% of the lot to have a masonry exterior, property located at 800 Crestview Lane. ZBA 2015-02. Staff Comments Ms. 011ie stated that the subject property is located at 800 Crestview Lane in the Stoneridge Farms Addition. The applicant is proposing to construct a 1,200 square foot accessory structure, Minutes February 16, 2015 Wylie Zoning Board of Adjustment Page 1 of 3 with a metal exterior material, on a residential lot of approximately 42,481 square feet. The Zoning Ordinance requires an accessory structure that covers more than 2 percent of lot to be constructed with exterior walls composed of composite maonry façade material or the same masonry content required for the main structure. For the subject lot, by Zoning Ordinance the size would be 849 square foot accessory structure. The intent of the Ordinance was for average lot sizes of 8,500 -15,000 square feet. The subject lot sits on approximately an acre tract and is classified more to an estate single family lot. The applicant maintains that due to these current conditions his request would be keeping within the look and feel of the neighborhood. It is also his contention that the one acre lots in Stoneridge Farms represent a unique physical circumstance as they are larger than the average lot within the City and thus the intent of the Ordinance is still being met if a variance is approved. The board has approved similar requests within this subdivision over the past few years, and several similar structures do exist in this subdivision. Public Comment Forms were mailed to twelve property owners within 200 feet of this request. Three responses were received, all in favor of the request. One respondent was in opposition, if the accessory structure was larger than 15 feet. The building, as presented by the applicant, is only 12 feet tall. Public Comments Chairperson Jourdan opened the Public Hearing. Mr. & Mrs. Russell Heileman, 800 Crestview Lane, applicant, stated that the residential structure is 2,600 square foot. The size of the structure will be 30 x 40 and there is an exact building adjacent to his property. A six foot board on board wooden fence surrounds the back part of the property, with a 20 foot slide gate. The height of the fence facing Stone Road is eight feet, then the fence goes down to six foot along the side of the property and facing Crestview Lane. There is a curb cut for a driveway and the access to the accessory structure will be concrete, just not complete. Chairperson Jourdan closed the Public Hearing. Board Discussion Commissioners questioned the intent of the Zoning Ordinance. Ms. 011ie stated that Stoneridge is unique with one acre lot minimum, and the majority of the lots around the city are 10,000 square feet or smaller. The zoning for Stoneridge is 10,000 square foot lots, but Minutes February 16, 2015 Wylie Zoning Board of Adjustment Page 2 of 3 the lots are estate lots with approximately one acre. The Board can direct Staff to amend the Zoning Ordinance to allow larger accessory buildings for the lots that are larger than 10.000 square foot. This would alleviate property owners applying for variances that live within Stoneridge Addition or larger lots than 10,000 square foot. Board Action A motion was made by Board Member McGinnis and seconded by Board Member Finnell, to Grant the variance request Section 2.5.C.e.2 of the Zoning Ordinance allowing accessory structure covering more than 2% of the lot with metal exterior material. Motion carried 5 — 0. Board directed Staff to move forward on drafting an Ordinances for lots larger than 10,000 square foot to allow more than 2 percent coverage for Accessory Structures. ADJOURNMENT A motion was made by Board Member Finnell, ang seconded by Vice Chairman Potts to adjourn the meeting.
