Board Member Robert Holcomb, Board Member Kevin Finnell and Board
Member Karyn McGinnis.

Administrative Assistant.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes of the January 26, 2015
Meeting.
A motion was made by Board Member Potts and seconded by Board
Member Finnell, to approve the Minutes from the January 26, 2015
Meeting as submitted. Motion carried 5 — 0.
PUBLIC HEARINGS
Item 1 —ZBA 2015-02
Hold a public hearing to consider and act upon a request by Russell Heileman for
a Variance to Section 2.5.C.e.2 and of the Zoning Ordinance from the
requirement of an accessory structure covering more than 2% of the lot to have a
masonry exterior, property located at 800 Crestview Lane. ZBA 2015-02.
Staff Comments
Ms. 011ie stated that the subject property is located at 800
Crestview Lane in the Stoneridge Farms Addition. The applicant is
proposing to construct a 1,200 square foot accessory structure,
Minutes February 16, 2015
Wylie Zoning Board of Adjustment

with a metal exterior material, on a residential lot of approximately
42,481 square feet. The Zoning Ordinance requires an accessory
structure that covers more than 2 percent of lot to be constructed
with exterior walls composed of composite maonry facade material
or the same masonry content required for the main structure. For
the subject lot, by Zoning Ordinance the size would be 849 square
foot accessory structure. The intent of the Ordinance was for
average lot sizes of 8,500 -15,000 square feet. The subject lot sits
on approximately an acre tract and is classified more to an estate
single family lot.
The applicant maintains that due to these current conditions his
request would be keeping within the look and feel of the
neighborhood. It is also his contention that the one acre lots in
Stoneridge Farms represent a unique physical circumstance as
they are larger than the average lot within the City and thus the
intent of the Ordinance is still being met if a variance is approved.
The board has approved similar requests within this subdivision
over the past few years, and several similar structures do exist in
this subdivision.
Public Comment Forms were mailed to twelve property owners
within 200 feet of this request. Three responses were received, all
in favor of the request. One respondent was in opposition, if the
accessory structure was larger than 15 feet. The building, as
presented by the applicant, is only 12 feet tall.
Public Comments
Chairperson Jourdan opened the Public Hearing.
Mr. & Mrs. Russell Heileman, 800 Crestview Lane, applicant, stated
that the residential structure is 2,600 square foot. The size of the
structure will be 30 x 40 and there is an exact building adjacent to
his property. A six foot board on board wooden fence surrounds the
back part of the property, with a 20 foot slide gate. The height of the
fence facing Stone Road is eight feet, then the fence goes down to
six foot along the side of the property and facing Crestview Lane.
There is a curb cut for a driveway and the access to the accessory
structure will be concrete, just not complete.
Chairperson Jourdan closed the Public Hearing.
Board Discussion
Commissioners questioned the intent of the Zoning Ordinance. Ms.
011ie stated that Stoneridge is unique with one acre lot minimum,
and the majority of the lots around the city are 10,000 square feet
or smaller. The zoning for Stoneridge is 10,000 square foot lots, but
Minutes February 16, 2015

the lots are estate lots with approximately one acre. The Board can
direct Staff to amend the Zoning Ordinance to allow larger
accessory buildings for the lots that are larger than 10,000 square
foot. This would alleviate property owners applying for variances
that live within Stoneridge Addition or larger lots than 10,000
square foot.
Board Action
A motion was made by Board Member McGinnis and seconded by
Board Member Finnell, to Grant the variance request Section
2.5.C.e.2 of the Zoning Ordinance allowing accessory structure
covering more than 2% of the lot with metal exterior material.
Motion carried 5 — 0.
Board directed Staff to move forward on drafting an Ordinances for
lots larger than 10,000 square foot to allow more than 2 percent
coverage for Accessory Structures.
ADJOURNMENT
A motion was made by Board Member Finnell, and seconded by Vice Chairman
Potts to adjourn the meeting. All Board Members were in consensus, and the
meeting adjourned at 6:50p.m.

Hold a public hearing to Consider and act upon, a Variance to Ordinance 2014-44, Section 22-450 (2) Real
Estate Signs requiring requirement of temporary signs to be no larger than nine square feet and four feet in
height,property located at 709 Parker Road being Tract 32 of the WD Penney Survey. ZBA 2015-03
Discussion
Applicant: Ronnie Smitheart Owner: Ronnie Smitheart
The subject property is located at 709 Parker Road in the WD Penney Survey. The property is 4.92 acres
currently zoned AG/30.
The applicant is proposing to construct and erect two 4'x8' (32 square foot) for sale signs on the property.
Currently, the Ordinance only allows temporary signs on a residentially zoned property to be a maximum of
nine square feet and four feet in high. This property is subject to this regulation because the ordinance classifies
the AG/30 zoning category as a residential district.
Therefore, the applicant is requesting a variance to Section 22-450 (2) of Ordinance 2014-44.
The applicant maintains that due to the property's location off of the Parker Road loop the sign size allowed by
the Ordinance is insufficient to attract attention to the property from the traffic on Parker Road.
A unique circumstance may exist as the ordinance was written and intended for average residential lot sizes
within subdivisions. This property is almost five acres which is 20 times larger than the minimum allowed lot
size. Additionally, due to the unique nature of this section of Parker Road, the property is not adjacent to the
road on which it is addressed. The property is approximately 250-300 feet off the main trafficked roadway with
another structure (Lutz Wordworking)between it and Parker Road.
Public comment forms were mailed to 17 property owners within 200 feet of this request, as required by State
Law. No responses have been received at the time of this posting.
The Board shall not grant a variance to the development code which:
(1) Permits a land use not allowed in the zoning district in which the property is located; or
(2) Is in the public right-of-way or on public property; or
(3) Alters any definition of the development code; or
Page 1 of 2
Page 2 of 2
ZBOA 2015-03
(4) Is other than the minimum variance that will afford relief with the least modification possible to the
requirements of the development code; or
(5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to
reasonably make practicable the formulation of a general regulation to be adopted as an amendment to
the development code; or
(6) Is based exclusively on findings of personal or financial hardship.
In order to grant a variance to the development code the Board shall find that all the following have been
satisfied:
(1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical
condition particular to the affected property;
(2) That because of these unique physical circumstances or conditions, the property cannot be reasonably
developed or used in compliance with the provisions of the development code;
(3) That due to such unique physical circumstances or conditions, the strict application of the development
code would create a demonstrated hardship;
(4) That the demonstrable hardship is not self-imposed;
(5) That the variance if granted will not adversely affect the proposed development or use of adjacent
property or neighborhood;
(6) That the variance, if granted will not change the character of the zoning district in which the property is
located;
(7) That the variance, if granted is in keeping with the intent of the development code; and
(8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of
Wylie.

Hold a public hearing to consider and act upon a request by Kerat Building, LLC for a Variance to Section 3.3.B.3 of the
Zoning Ordinance for properties requiring a minimum 15 foot side yard setback for buildings, property located at 621
Fleming Street,being 1,Block E of the Village Addition. ZBA 2015-04
Discussion
Applicant: Raid Alazzawi Owner: Kerat Building,LLC
The applicant is requesting a variance to Section 3.3.B.3 of the Zoning Ordinance Development Standards for residential
zoned properties that requires a 15' side yard setback when on a corner lot. The purpose of the setback standard is to
ensure adequate spacing between structures and between structures and drive lanes for the placement of utilities, fire
safety,visibility triangles, and green space.
The applicant is requesting the minimum setback be reduced to 10' to build a residential structure on the property.
The applicant has purchased and is developing the remaining 16 lots within The Village subdivision. This subdivision was
abandoned and the lots sold off by Choice Homes shortly after the economic downturn in 2007-2008. The developer has
acquired those and is planning to build homes that meet or exceed the current standard of the neighborhood.
However, in order to do so they are requesting a variance on one lot in order to fit their floorplan onto the lot. The original
requirements of the subdivision allowed for single car garages. However, the applicant desires to construct all homes with
two car garages. In order to construct the two car design on the subject lot,the additional footage is needed.
A unique circumstance may exist on the property due to the property being on a side lot but with a separated access drive.
This separation allows vehicles entering Fleming to easily see oncoming traffic, regardless of structure placement on the
property, eliminating one of the reasons for the setback.
Public comment forms were mailed to thirty-six (36)property owners within 200 feet of this request, as required by State
Law. At the time of this posting one comment form was received in favor, and no comment form in opposition.
The Board shall not grant a variance to the development code which:
(1) Permits a land use not allowed in the zoning district in which the property is located; or
(2) Is in the public right-of-way or on public property; or
(3) Alters any definition of the development code; or
Page 1 of 2
Page 2 of 2
ZBOA 2014-04
(4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements
of the development code; or
(5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably
make practicable the formulation of a general regulation to be adopted as an amendment to the development code;
or
(6) Is based exclusively on findings of personal or financial hardship.
In order to grant a variance to the development code the Board shall find that all the following have been satisfied:
(1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition
particular to the affected property;
(2) That because of these unique physical circumstances or conditions,the property cannot be reasonably developed
or used in compliance with the provisions of the development code;
(3) That due to such unique physical circumstances or conditions,the strict application of the development code
would create a demonstrated hardship;
(4) That the demonstrable hardship is not self-imposed;
(5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or
neighborhood;
(6) That the variance, if granted will not change the character of the zoning district in which the property is located;
(7) That the variance, if granted is in keeping with the intent of the development code; and
(8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie.
