INVOCATION & PLEDGE OF ALLEGIANCE Commissioner Hennesey gave the invocation and Commissioner Gregg led the pledge of allegiance. CITIZEN PARTICIPATION No one appeared to speak to the Commissioners. CONSENT AGENDA 1. Consider and act upon approval of the Minutes from the July 19, 2005 Regular Meeting. Commission Byboth stated that the results of the vote for item 2 be added to the minutes. With no further corrections or deletions, a motion was made by Commissioner Alexander, and seconded by Commissioner Ames, to approve the minutes with the requested change. Motion carried 7—0. P &Z Commission Meeting August 2, 2005 Page 2 of 3 ACTION AGENDA 1. Consider a recommendation to the City Council regarding a Final Plat for Wylie Lakes Phase 1A and 1B, generally located east of Forrest Ross Road and south of Skyview Drive, and more specifically being a tract of land situated in the Francisco De La Pena Survey, Abstract No. 688 and being part of that 121.11 acre tract of land conveyed to Wylie Lakes, Ltd. As recorded in Volume 5415, Page 4387, Collin County Deed Records of Collin County, Texas. Thompson stated that the property is located east of Forrest Ross Road and south of Skyview Drive. The plat consists of Phase 1A and Phase 1B. Phase 1A includes 37.285 acres and will create 94 single-family residential lots, 14 townhouse lots and 1.220 acres open space dedicated to the City of Wylie. Phase 1B includes 13.287 acres and will create 55 single- family attached townhouse lots, and 5.479 acres of dedicated open space. Thompson discussed changes from the previously approved plat such as adding alleys. Spencer Lane will be extended all the way out to Skyview prior to being accepted. Commissioner Ames asked if there would be only one way out on Colby. Thompson confirmed. A motion was made by Commissioner Byboth, and seconded by Commissioner Hemphill, to recommend approval for the Wylie Lakes Phase 1 A & 1B Addition Final Plat to the City Council. Motion carried 7—0. 2. Consider a recommendation to the City Council regarding a Final Plat for Wylie I.S.D. Center Addition, being a Replat of Part of Caldwell Estates situated in the Allen Atterberry Survey, Abstract 23, Collin County, Texas, and being all of a 35.844 acre tract of land conveyed to Wylie I.S.D. by deed recorded in Volume 684, Page 895, Deed Records of Collin County, Texas, being all of an 11.188 acre tract of land conveyed to the Wylie I.S.D. by deed recorded in Volume 920, Page 203, Deed Records of Collin County, Texas, and being part of a 14.595 acre tract of land conveyed to the Wylie I.S.D. by deed recorded in Volume 920, Page 371, Deed Records of Collin County, Texas. Thompson stated that the Final Plat under consideration is for the expansion of the WISD Administration Building located at 951 Ballard Street. The property totals 60.403 acres. Demolition and dirt work has already begun with the approval of the Engineer. The plat dedicates a 55' right-of-way for Ballard Street and a 50' right-of-way for Pirate Drive. A motion was made by Commissioner Gregg, and seconded by Commissioner Alexander, to recommend to City Council approval for the WISD Administration Building Final Plat to the City Council. Motion carried 7—0. P &Z Commission Meeting August 2, 2005 Page 3 of 3 WORK SESSION 1. Discuss potential revisions to the Zoning Ordinance to conform to recent changes in the Comprehensive Plan. Commissioners and Staff discussed New Residential Requirements, Infill Residential Requirements and Non-Residential Requirements for review. Regulations will now include base requirements and incentive or desirable elements. The Commissioners discussed all three tables, and discussed the modified regulations for each section ADJOURNMENT A motion was made by Commissioner Byboth, and seconded by Commissioner Hemphill, to adjourn the meeting at 9:20PM. ZC 2005-16 SUMMARY (Continued): Section 5.2.J.7 of the Zoning Ordinance requires an approved Special Use Permit (SUP) for the construction and operation of amateur communication towers and antennas within the Single Family -8.5/17 Residential (SF-8.5) District. The Ordinance also limits such towers to one (1)per lot, the height of which may not exceed seventy-five (75) feet. The Ordinance states that such towers may not be located within any front, side or rear setbacks. Single antennas may not exceed 900 square feet and multiple antennas may not total more than 1,400 square feet. It is believed that Wylie's regulations comply with the FCC guidelines. The Zoning Ordinance allows consideration of a Special Use Permit (SUP) for certain uses within certain districts as a means to more carefully and specifically evaluate the effects of certain uses on surrounding properties or when necessary to establish for such uses in such locations any special conditions which insure that the use is more compatible and consistent with the character of the adjacent properties than that use might be normally in other locations. An SUP does not change the zoning but overlays the existing zoning with site- specific and limited additional uses and regulations. The Planning and Zoning Commission and City Council shall evaluate a request for an SUP to determine its probable effects on adjacent properties and the community as a whole, and may impose any reasonable conditions for the granting of an SUP. Failure at any time to comply fully with the approved Conditions of the SUP will result in the cancellation of the Certificate of Occupancy. Amateur radio towers/antennas require the approval of a Special Use Permit (SUP) because such towers often raise concerns of potential adverse visual or aesthetic impact and interference with other communications equipment within the vicinity. 1. Aesthetics are largely a difficulty-defined personal issue. The proposed tower will be located in the rear yard, largely screened by the house from view of the some-what lower front street-level. The top of the tower and antenna (at a maximum 45 feet) will be approximately 13 feet higher than the peak of the house roof (32 feet). The tower will be open trust construction with no supporting guy wires. (see attached plans) 2. The FCC confirms the potential for the radio transmitting to interfere with other air-wave communications receiving equipment within the immediate vicinity. Such interference is largely caused by inadequate design of the equipment being interfered and from equipment within the interfered-with home rather than sources outside. If caused by radio operations, the interference will occur only when the radio is operating (not receiving) and can be documented by the FCC-required log each operator must maintain. Radio transmissions do not interfere with cable-receiving equipment. (see attached FCC report) No other towers/antennas have been permitted nor were observed within the immediate vicinity, except for a number of roof-mounted TV receiving antennas. There are a total of 47 households with one or more licensed operators within Wylie (0.05% of our total households), and these are fairly well distributed with no potential for concentrations. The planned development for this neighborhood was approved by the City Council on September 14, 1999. That planned development subdivided the property into three sub-areas. Sub-area#1was designated SF-A and is to generally conform to the city's SF-1 zoning classification Sub-area #2 was designated SF-B and is to generally conform to the city's SF-2 zoning classification. Sub-area#3 was designated SF-C and is to generally conform to the city's SF-3 zoning classification. Within the approved changes to those above zoning classifications, all of the sub- areas have a 6' maximum allowed height for individual fences. The city's current standards allow for a maximum height of 8' for fences within a neighborhood. We are requesting that the maximum allowable height for fences in this community be 8'. Accompanying our request is a letter provided by the Riverchase HOA board of directors requesting that an application be made to change the zoning requirements within this neighborhood to allow for 8' tall fences.
