CALL TO ORDER
Chairman Bryan Rogers called the meeting to order and a quorum was present. Board
members present with the Chairman were; Board Member Sonny Lee Mosby, Board
Member Sunil Verma, Board Member Billy McClendon, Board Member Charles Barton
and Board Member Dale Davenport.
Staff present was Building Official Brian Killebrew, Code Enforcement Officer Pat
Mitchell, Secretary Alicia Chavez and Development Services Director Renae 011ie.
CITIZENS COMMENTS
Chairman Rogers opened the Citizens Participation. With no one approaching the
Commissioners, Chairman Rogers closed the Citizens Participation.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes from the August 18, 2014,
Regular Meeting.
Board Action
A motion was made by Board Member Verma and seconded by Board Member
McClendon to approve the Minutes from the August 18, 2014 Regular Meeting.
Motion passed 6-0.
REGULAR AGENDA
Regular Hearing
1. Consider, and act upon, a variance to the City of Wylie Sign ordinance section 22-447
regarding the height of the signs for The Rock Wood Fire Kitchen. The property is
generally located at 2600 W FM 544.
Citizen Comments
Mr. Sean Casey, a representative for The Rock Wood Fire Kitchen stated the feel and
image of The Rock brand is highly dependent on the signage. They feel that the

height of the sign is not over powering due to the size of the building. They are
requesting the variance due to the new Sign Ordinance restrictions.
Staff Comments
Mr. Killebrew stated that these signs are have a height constraint and that in the new
Sign Ordinance; it will not allow the height they are requesting. The height
maximum is two feet and the sign with the flames is eight feet. Mr. Killebrew stated
due to the building being set back from the street, the signage is important and is not
over bearing at all. Mr. Killebrew stated he does not have an issue with the height.
Board Action
A motion was made by Board Member McClendon and seconded by Board Member
Verma, to approve the request for a variance. Motion carried 6-0.
Public Hearing
1. Hold a public hearing, consider, and act upon providing evidence, seeking a
determination that a building(s) located at or near 215 Millstone Dr, Harvest Bend #2,
Block E, Lot 12, Wylie, Collin County, Texas was in violation of standards set out in
Ordinance #2008-49 DANGEROUS BUILDINGS and or PUBLIC NUISANCES
Ordinance 92-14 of the City of Wylie, Texas; and seeking an order of approval of the
Emergency Secure conducted on August 5, 2014.
Staff Comments
Ms. Mitchell stated that she was contacted by the Police Department whom found the
garage open and unsecured at the property located at 215 Millstone Dr. The yard was
mowed and the property was secured along with treating the stagnant in-ground
swimming pool. Liens were filed and have not been satisfied. This home is vacant.
Chairman Rogers opened the Public Hearing. With no one approaching the Board,
Chairman Rogers closed the Public Hearing.

A motion was made by Board Member Verma and seconded by Board Member
McClendon to approve the emergency secure of 215 Millstone Dr. Motion carried 6-
0.

determination that a building(s) located at or near 215 Millstone Dr, Harvest Bend #2,
Block E, Lot 12, Wylie, Collin County, Texas was in violation of standards set out in

Ordinance 92-14 of the City of Wylie, Texas; and seeking an order of approval of the
Emergency Secure conducted on September 19, 2014.

Staff Comments
Ms. Mitchell stated that she was contacted by the contractor due to the back gate
being unsecured once again at the property located at 215 Millstone Dr. Ms. Mitchell
contacted the Police Department to clear the home. The property was once again
mowed and re-secured by the contractor. Liens were filed and have not been
satisfied. This home is vacant.

Chairman Rogers closed the Public Hearing.

Block E, Lot 12, Wylie, Collin County, Texas was in violation of standards set out in
Ordinance #2008-49 DANGEROUS BUILDINGS and or PUBLIC NUISANCES
Ordinance 92-14 of the City of Wylie, Texas; and seeking an order of approval of the
Emergency Secure conducted on October 24, 2014.
Staff Comments
Ms. Mitchell stated that she was contacted by the contractor once again due to the
back gate being unsecured at the property located at 215 Millstone Dr. Ms. Mitchell
contacted the Police Department to clear the home. Ms. Mitchell stated that each
time a property is secured; there is a $750.00 Administrative Fee for dangerous
buildings. The property was re-secured. Liens were filed and have not been satisfied.
This home is still vacant.

4. Hold a public hearing, consider, and act upon providing evidence, seeking a
determination that a building(s) located at or near 904 Marble Creek Dr, Creek
Hollow #1, Block F, Lot 38, Wylie, Collin County, Texas was in violation of
standards set out in Ordinance # 2008-49 DANGEROUS BUILDINGS and or
PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie. Texas; and seeking an
order of approval of the Emergency Secure conducted on August 20, 2014.

Staff Comments
Ms. Mitchell stated that she was contacted by the Police Department whom found the
entire home unsecured at the property located at 904 Marble Creek Dr. The Police
Department stated they found a group of kids playing in the home. Ms. Mitchell
stated they home was completely furnished and it seemed as if someone left in a
hurry. Ms. Mitchell contacted the contractor to board the entire home up from the
inside and out. Liens were filed and have not been satisfied. This home is vacant.

Chairman Rogers closed the Public Hearing.

determination that a building(s) located at or near 904 Marble Creek Dr, Creek
Hollow #1, Block F, Lot 38, Wylie, Collin County, Texas was in violation of
standards set out in Ordinance # 2008-49 DANGEROUS BUILDINGS and or
PUBLIC NUISANCES Ordinance 92-14 of the City of Wylie, Texas; and seeking an
order of approval of the Emergency Secure conducted on August 25, 2014.
Staff Comments
Ms. Mitchell stated that she found the property located at 904 Marble Creek Dr. once
again unsecured in the back. There was a hole in the fence and the Police Department
advised her that they have made contact with the parents to keep the kids out. The
yard was mowed and the property was re-secured. Liens were filed and have been
satisfied. This home is vacant.
Chairman Rogers opened the Public Hearing. With no one approaching the Board,
Chairman Rogers closed the Public Hearing.

A motion was made by Board Member Verma and seconded by Board Member
Mosby to approve the emergency secure of 904 Marble Creek Dr. Motion carried 6-
0.
