Ordinance 2008-17 ORDINANCE NO. 2008-17 AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, REPEALING ORDINANCE NO. 2005-63; ADOPTING THE 2006 EDITION OF THE INTERNATIONAL BUILDING CODE FOR COMMERCIAL BUILDINGS, SAVE AND EXCEPT THE DELETIONS AND AMENDMENTS SET FORTH HEREIN; PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR REPEALING, SAVINGS AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF. WHEREAS, the City Council of the City of Wylie, Texas ("City Council") has investigated and determined that it would be advantageous and beneficial to the citizens of the City of Wylie, Texas ("W.~") to repeal Wylie Ordinance No. 2005-63; and WHEREAS, the City Council has investigated and determined that it would be advantageous and beneficial to the citizens of Wylie to adopt the 2006 Edition of the International Building Code far commercial buildings, save and except the deletions and amendments set forth below. ~ NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION L• Findin sg Incorporated. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: Ordinance No. 2005-63 Repealed. Wylie Ordinance No. 2005-63 is repealed in its entirety and replaced by this Ordinance. The effective date of the repeal discussed in this Section shall not occur until the effective date of this Ordinance at which time Ordinance No. 2005-63 shall be repealed. Such repeal shall not abate any pending prosecution and/or lawsuit or prevent any prosecution and/or lawsuit from being commenced for any violation of Ordinance No. 2005-63 occurring before the effective date of this Ordinance. SECTION 3: Adoption of the 2006 International Buildin Code. The International Building Code, copyrighted by the International Code Council, Inc., save and except the amendments set forth in Exhibit "A", attached hereto and incorporated herein for all purposes, is hereby adopted as the Building Code for Wylie, prescribing regulations applicable to all commercial or nonresidential structures and constitutes minimum requirements and standards for commercial construction applications (the "2006 International Building Code"). The 2006 International Building Code is made a part of this Ordinance as if fully set forth herein. One (1) copy of the 2006 International Building Code is on file in the office of the City Secretary of Wylie being marked and designated as the 2006 International Building Code. All provisions of any ordinance in conflict with this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining portion of conflicting ordinances shall remain in full force and effect. A reference in any ordinance to an earlier or different version of a building code is hereby amended to refer to the 2006 International Building Code as it is adopted herein or may be subsequently amended. SECTION 5: Penaltv Provision. Any person, firm, corporation or entity violating this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be subject to a fine not to exceed the sum of TWO THOUSAND AND NO/100 DOLLARS ($2,000.00). Each continuing day's violation under this Ordinance shall constitute a separate offense. The penal provisions imposed under this Ordinance shall not preclude Wylie from filing suit to enjoin the violation. Wylie retains all legal rights and remedies available to it pursuant to local, state and federal law. SECTION 6: Severability. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason, held to be unconstitutional or invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. Wylie hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, and phrases be declared unconstitutional. SECTION 7: Effective Date. This Ordinance shall become effective upon its passage and publication as required by the City Charter and by law. Building owners/manaeers must utilize a licensed fire protection contractor to test and certify standpipe svstems. In addition to the testin~ and maintenance requirements of NFPA 25 applvin~ standpipe svstems, the followine additional requirements shall be a~plied to the testin~ that is required ever~ ~ 1. The pipin~ between the Fire Department Connection (FDC) and the standpipe shall be hydrostatically tested for all FDC's on an~type of standpipe system. Hydrostatic testine shall also be conducted in accordance with NFPA 25 requirements for the different types of stand~ipe s sty ems• 2. For an manual dry or wet) standpipe system not having an automatic water sup~lv capable of flowing water throu~h the standpipe, the contractor shall connect hose from a fire hydrant or portable pumpine system (as approved bv the fire code official) to each FDC and flow water throu~h the standpipe svstem to the roof outlet to verifv that each inlet connection functions properly. There is no required pressure criteria at the outlet. Verifv that check valves function properly and that there are no closed control valves on the system 3. Anv pressure relief, reducin~, or control valves shall be tested in accordance with the requirements of NFPA 25. 4. If the FDC is not alreadv vrovided with approved caps the contractor shall install such caps far all FDC's Contact the Fire Marshal for additional information. 5. U~on successful completion of standpipe test the contractor shall place a blue tag (as per "Texas Administrative Code Title 28 Insurance Part I Texas Department of Insurance Chapter 34 State Fire Marshal, Subchapter G. Fire Sprinkler Rules, 28 TAC & 34.720 Inspection Test and Maintenance Service ~ITM) Ta~") at the bottom of each stand~pe riser in the building An example of this tae is located at the end of this SOP. The tag shall be check-marked as "Fifth Year" for Type of ITM and the note on the back of the ~g shall read "5 Year Stand~pe Test" at a minimum. 6. The contractor shall follow the procedures as required by "Texas Administrative Code Title 28 Insurance Part L Texas Denartment of Insurance. Chapter 34. An automatic sprinkler svstem shall be installed throu~hout all buildin~s with a buildin~ area over 6,000 sq.ft. For the purpose of this provision, fire walls shall not define separate buildings. Exceations• 1. Open parking gara~es in compliance with Section 406.3 of the International Buildin~de. 2. Group A-5 occupancies. (Reason: Reflect local practices.) **Section 903.3.1.1.1; change to read as follows: 903.3.11.1 Exempt locations. When approved by the code official, automatic sprinklers shall not be required in the following rooms or areas where such ...(bulk of section unchanged} because it is damp, of fire- resistance-rated construction or contains electrical equipment. 1. Any room where the application of water, or flame and water, constitutes a serious life or fire hazard. 2. Any room or space where sprinklers are considered undesirable because of the nature of the contents, when approved by the code official. 3. Generator and transformer rooms, under the direct control of a public utility, separated from the remainder of the building by walls and floor/ceiling or roof/ceiling assemblies having a fire-resistance rating of not less than 2 hours. ~ (Reason: Gives more discretion to code official. Protects locations where fire risks are poorly addressed.) **Section 903.3. S; add a second paragraph to read as follows: Water sunplv as required for such systems shall be provided in conformance with the su~ply requirements of the resnective standards; however, ever~protection svstem shall be desi~ned with a 10 psi safety factor.
