05-24-2000 (Zoning Board of Adjustment) Minutes MINUTES ZONING BOARD OF ADJUSTMENT Wednesday May 24, 2000 7:00 P.M. City Council Conference Room Municipal Complex, 2000 Highway 78 North CALL TO ORDER The meeting was called to order. Those present were Gerald Clark, Jeff McCoy, Weldon Bullock, Marilyn Herrera, and Derek Green. APPROVAL OF MINUTES: Two corrections were noted for the minutes: Tobin Maples is listed as attending the November 1, 1999 meeting and was not present, and the minutes reflect that they are for 2000 and need to be corrected to reflect 1999. Motion was made by Jeff McCoy and seconded by Marilyn Herrera to approve the minutes as corrected. The vote was unanimous for approval. PUBLIC HEARINGS 1. ZBA No. 2000-01: Hold a public hearing and consider and act upon a request from Richard Parker for a variance to Section 19.3 (1) (c) of the Zoning Ordinance from the required rear yard setback of 20' in the B-2 (Business) District to the requested 0' to allow construction within the required rear yard setback, and being all of Lot 1, Block A, of The Parker Addition, City of Wylie, Collin County, Texas. Staff reported to the Board that this is an irregularly shaped property with a power line easement, a NTMWD easement and flood plain designations. In addition, right-of-way has been acquired across the front of the property for the widening of F.M. 544. The applicant is wishing to develop the property with mini-warehouses and has requested a 0' setback along the rear property line. Don Jackson, representing the applicant was present and stated that there will not be any development directly adjacent to the rear property line due to the location of the railroad tracks. A Site Plan for the property has been approved by the Planning & Zoning Commission, contingent on the approval of the variance. After discussion, a motion for approval was made by Jeff McCoy and seconded by Marilyn Herrera. The motion was approved unanimously. 2. ZBA No. 2000-02: Hold a public hearing and consider and act upon a request from Kerry C. Hunt-Currin for a variance to Section 25.5 (2) (a) of the Zoning Ordinance for an existing nonconforming swimming pool within the required side yard setback, and being all of Lot 11, Block 14, of Newport Harbor Addition, Phase I, an Addition to the City of Wylie, Collin County, Texas, located at 1501 Schooner Bay. Staff reported that a permit was issued in error for this swimming pool. The current ordinance does not allow any structure within the exterior side yard, and this pool is among several in the City that have received permits in error. The applicant was present and stated that in attempting to sell her home, this encroachment was identified by the title company. In order to clear to title, a variance would have to be requested and approved. After discussion, a motion for approval was made by Derek Green and seconded by Weldon Bullock.
