03-17-1994 (Zoning Board of Adjustment) Minutes MINUTES
The Board of Adjustments Commission met in a Business Meeting on March 17, 1994, at 6:30 p.m. in
Council Chambers of the Wylie Municipal Complex, located at 2000 Hwy. 78 North, Wylie, Texas 75098.
A quorum was present and a notice was posted in the time and manner required by law.
COMMISSION MEMBERS PRESENT: Acting Chairman Glen Graves; Ray Capley, Marilyn Herrera,
Robin Messer.
ABSENT: Gerald Clark and Jeff Payne.
STAFF MEMBERS PRESENT: Building Official, Russell Wyman and Secretary, Kirsten Fresh.
PUBLIC HEARING
ITEM NO. l: Hold a Public Hearing to consider an appeal from Don Hughes to the decision of the Building
Official requiring landscaping and masonry to be incorporated into the building site and structure currently
permitted for construction at 211 Industrial Ct. and further described as: Lot 6, Abstract 820 of the Railroad
Industrial Park. Glen Graves opened the public hearing. Don Hughes, owner of the property at 211
Industrial Ct., spoke in favor of the appeal for landscaping and masonry; claiming that the other buildings
around him did not have it and that trees would be a nuisance. J.C. Worley of 335 Donna Dr, the business
owner at 211 Industrial Ct., spoke in favor of the appeal; claiming it was not necessary to his business to have
it. Glen Graves closed the public hearing. The Commission discussed among themselves after looking at
several photos that Don Hughes had submitted of the surrounding properties. Ray Capley made a motion
and Marilyn Herrera seconded to approve the appeal on the landscape but to deny the appeal on the masonry.
Motion carried, all in favor(4 votes).
ITEM NO. 2: Hold Public Hearing to consider an appeal from Raul Rubalcava to the decision of the
Building Official requiring the removal of any fencing constructed between the building line and front
property line except for ornamental type fencing along the side property lines at the residence located at 1315
FM 1378 and further described as: Lots 4, 5, & 6 of the McMillen Farms Addition. Glen Graves opened
the public hearing. Raul Rubalcava, of 1315 FM 1378, spoke in favor of keeping the fence. Bob Galvan,
of 301 Lake Ranch Rd., spoke in favor of the fence; stating that it adds to the community and is a definite
asset to the area. Glen Graves closed the public hearing. Staff explained that the zoning for Mr. Rubalcava's
lots are SF-1 and the ordinance states that a fence cannot be between the front property line and the building
line unless the house is set back 25'. Mr. Rubalcava's house sets back 23'. The land on either side of his lots
is zoned agriculture, which does allow for a fence to run along the same front property line that Mr.
Rubalcava's fence is aligned. Glen Graves made a motion and Ray Capley seconded to approve the appeal.
Motioned carried, all in favor(4 votes).
