09-08-1997 (Zoning Board of Adjustment) Minutes Minutes of the Zoning Board of Adjustments The Zoning Board of Adjustments met in a Regular Business Meeting on September 8, 1997 at 7:30 p.m. in the Council Chambers of the Wylie Municipal Complex, located at 2000 Highway 78 North, Wylie, Texas 75098. A quorum was present and a notice was posted in the time and manner required by law. COMMISSION MEMBERS PRESENT: Chairman Gerald Clark, Emily Hartwig, Marilyn Herrera, Ken Ryburn and Greg Alford, plus alternates Denise Mays and Jeff McCoy (not sworn). ABSENT: None STAFF MEMBERS PRESENT: Mike Phillips - Building Official and Rebecca Rogers - Secretary. ELECTION OF OFFICERS Emily Hartwig nominated Gerald Clark for Chairman, seconded by Ken Ryburn. Motion carried, all in favor (4). Emily Hartwig nominated Marilyn Herrera for Vice- Chairman, seconded by Greg Alford. Motion carried, all in favor(4). ACTION ITEMS ITEM NO. 1: Consider approval of the Minutes of the March 10, 1997 Regular Business Meeting. A motion was made by Greg Alford, seconded by Marilyn Herrera to accept the minutes as presented. Motion carried, all in favor(5). ITEM NO. 2: Consider an appeal from Metroplex Multifoods, Inc. from the City of Wylie Zoning Ordinance which requires that an application or request for a variance will not be heard or granted to any parcel of property or portion of said property until a Concept Plan, detailed Site Plan, Preliminary Plat, or Final Plat has been finally acted upon by both the Planning and Zoning Commission and the City Council. Mike Phillips, Building Official,stated that the Zoning Ordinance requires the applicant to have exhausted all other avenues available to detailed Site Plan review,Concept Plan,Preliminary Plat, etc. before a variance may be requested. Metroplex Multifoods has requested this variance prior to approval of a site plan, concept plan, etc. however, those items will still be required prior to a building permit being issued. No site plan has been submitted for review or approval. Kenneth Durrett,Metroplex Multifoods, Inc, 101 E.Cherokee St., Jacksonville, TX 76766 was present to speak for the variance. Mr. Durrett stated that they were applying for a variance before the property was purchased because if they couldn't get the sign variances requested, this property would not be of interest to them(visibility on FM 544 and SH 78 is very important). Mr. Durrett stated that if the variances are not approved they can not build at this site and could not say if they would build at another location in Wylie or another city entirely. A motion was made by Greg Alford, seconded by Ken Ryburn, to consider an appeal from Metroplex Multifoods,Inc. from the City of Wylie's Zoning Ordinance which requires that an application or request for a variance will not be heard or granted to any parcel of property or portion of said property until a Concept Plan,detailed Site Plan, Preliminary Plat, or Final Plat has been finally acted upon by both the Planning and 1 Zoning Commission and the City Council. 3 in favor(Greg Alford, Ken Ryburn, Gerald Clark), 2 opposed (Marilyn Herrera, Emily Hartwig). Motion denied due to lack of majority vote(Chairman Clark quoted the 75%vote requirement.) No need for Public Hearing to be held. PUBLIC HEARING(not held) ITEM NO. 1: Hold a Public Hearing to consider an appeal from Metroplex Multifoods, Inc. for a variance from the City of Wylie Zoning Ordinance"Sign Regulations"which requires a 20-foot maximum height for a general business pole sign. ITEM NO.2: Hold a Public Hearing to consider an appeal from Metroplex Multifoods, Inc. for a variance from the City of Wylie Zoning Ordinance"Sign Regulations"which require a maximum allowed area of 60 square feet for a general business pole sign. ADJOURNMENT A motion was made by Marilyn Herrera, seconded by Emily Hartwig, to adjourn the meeting. Motion carried, all in favor(5). Davidson Survey) Be advised that the Wylie Zoning Board of Adjustments has considered the evidence and testimony relevant to the above location and determined: Your appeal from the City of Wylie Zoning Ordinance which requires that an application or request for a variance will not be heard or granted to any parcel of property or portion of said property until a Concept Plan, detailed Site Plan, Preliminary Plat, or Final Plat has been finally acted upon by both the Planning and Zoning Commission and the City Council has been denied.
