A quorum was present and a notice was posted in the time and manner required by law.

CALL TO ORDER
The meeting was called to order at 7:00 P.M. by Tobin Maples.
ELECTION FOR VICE CHAIRMAN
There was an election for a vice chairman. Jeff McCoy nominated himself
Motion: The motion was made by Denise Hays, Seconded by Weldon Bullock to elect Jeff McCoy as the Vice
Chairman.
Motion carried- all in favor(4).
CONSENT AGENDA
1. Approval of July 13, 1998, Regular Business Meeting Minutes.
Motion: A motion was made by Denise Hays, Seconded by Weldon Bullock to approve the July 13, 1998,
Regular Business Meeting Minutes.
Motion carried - all in favor(4).
PUBLIC HEARINGS
1. ZBA No. 98-03: Consider and act upon a request from DR Horton Custom Homes for a variance to Section 10.3
(1) (a) Area Regulations of the Zoning Ordinance so as to allow construction in a portion of the 25' required
front yard setback, and being all of Lot 15, Block D, of the Twin Lakes Addition, an Addition to the City of
Wylie, Collin County, Texas.

Tobin Maples update:
The address is 1103 Hughes Court. The regulations in Section 10.3 (1) (a) require the single family
homes include front yards with no less than 25 feet. The applicant is seeking a variance for a minor
encroachment into the western portion of the structure, due to the fact the foundation has been
poured. The City has inspected the foundation and it passed. This is the Cities error as well as the
builder. Staff is recommending approval. The encroachment is on the cul de sac end of the building
line.
Discussion among Board Members:
The City inspectors did approve the foundation with out all the information on hand and discovered
the error at a later date and time.
Public Hearing:
Paul Heft with DR Horton:
To prevent this from happening again they will have the plans and form survey will be on site.
John Cogan 1109 Hughes Court:
In favor of variance.
There was one public comment form returned in favor of this variance.
Motion: A motion was made by Denise Hays, Seconded by Weldon Bullock approval of ZBA No. 98-03.

2. ZBA No. 98-04: Consider and Act Upon a request from Pacific Construction Inc., a division of Lexington
Homes for a Variance to Section 10.2 (1)(c) Area Regulations of the Zoning Ordinance so as to allow
construction in a portion of the 25' required rear yard setback, and being all Lot 2, Block B, of Mill Creek
Estates, an Addition to the City of Wylie, Collin County, Texas.
Tobin Maples Update:
This is a rear yard setback variance. This is the same situation as ZBA No. 98-03. This property is at 920
Springwood. Staff is recommending approval.
Public Hearing:
Art Perkins,president of Lexington Homes. He has a concern with the 25 foot rear yard setback. He works
in other cities and the setback is on 20 feet. He feels this is a loss of valuable property.
Motion: A motion was made by Denise Hays, Seconded by Weldon Bullock to approve ZBA No. 98-04.

PUBLIC ANNOUNCEMENT
The City of Wylie is updating the Comprehensive Plan. They are holding workshops open to the public. The next
workshop will be December 27, 1998 at 7:00 pm here at City Hall. Mr. Maples encourages all builders and
developers to attend these workshops.
