01-27-2003 (Zoning Board of Adjustment) Minutes MINUTES ZONING BOARD OF ADJUSTMENT City Council Chambers Wylie Municipal Complex 2000 Highway 78 North, Wylie, Texas 75098 January 27, 2003 7:00 p.m. Notice was posted in time and manner required by law, and a quorum was present. Board Members Present: Staff Members Present: Eric Alexander Mary Bradley Weldon Bullock Terry Capehart Gerald Clark Claude Thompson Dennis Gibbons Wayne Morman Marilyn Herrera Layne LeBaron CALL TO ORDER Chairman Clark called the meeting to order at 7:05 p.m. CITIZEN PARTICIPATION No one was present to speak. CONSENT AGENDA 1. Consider and act upon approval of the Minutes of the December 16, 2002, Meeting. A recommendation was made to remove the sentence "Ms. Herrera arrived during the presentation" on page 4 in the fourth paragraph and stating on the first page under Consent Agenda in parenthesis (Mrs. Herrera absent at the time.) A Motion was made by Mr. Gibbons, and seconded by Mr. Morman, to approve the minutes with changes noted. Motion carried 7 — 0. ZBOA Commission Meeting January 27, 2003 Page 2 of 3 PUBLIC HEARINGS 1. Hold a public hearing to consider and act upon a request by Calvin Frederick for a variance to Section 3.3.A of the Zoning Ordinance (Sign Ordinance) in order to reduce the front yard from the required twenty-five (25) feet to six (6) feet, this property being located at 504 South Jackson Street and being Lot 3 of Block 7 in the Keller's First Addition. (ZBOA Case No. 2002-21) Thompson stated that the subject property was created by the platting of the Keller's First Addition, one of the oldest residential subdivisions within Wylie. The residence was constructed with a single-car garage, as allowed by the Zoning Ordinance in force at the time of platting. The Zoning Ordinance did not specify, at that time, if the requirement for parking was to be enclosed or covered or uncovered/open. A front yard of twenty-five (25) feet was required, although the existing residence and garage were constructed thirty (30) feet from the front property line. The applicant wishes to convert the garage into a "hobby shop", and to construct a single-car carport to the front of the garage. The new carport will be six (6) feet from the front property line, a variance of 19 feet or 75 percent from the required 25 feet front yard. However, the right-of-way of Jackson Street is 70 feet wide rather than the normally required 50 feet, and the carport will be located 24 feet from the curb or approximately 14 feet from what would be a normal right-of-way (a variance of 25%). Regardless of the future improvements to Jackson, there is sufficient paved drive for two cars, one under the carport and one between the carport and the street. Board Members discussed the vested rights of a homeowner. Thompson stated that because the proposed addition is less than 50 percent of the original size of the residence, the regulations in force at the time of development apply. Ms. Alicia Frederick, 125 Kathlyn Lane, Rowlett, Texas, the daughter-in-law of the applicant, stated that the purpose of enclosing the garage is to keep the hot/cold weather away from the retired applicant in order for him to work on hobby craft items ift the garage. Other residents along Jackson have added carports or never had either garage or carport. A motion was made by Mr. Morman, and seconded by Mr. LeBaron, to grant the variance. Motion passed 6 — O. Mr. Clark adjourned the meeting at 7:25 pm to reconvene for a work session in the back of the Chambers. ZBOA Commission Meeting January 27, 2003 Page 3 of 3 WORK SESSION Thompson made a slide presentation on value of tree preservation and the City of Wylie philosophy, in response to earlier discussion by the Board Members. The presentation was supported by a handout, which summarizes the City's policy and discusses the general issue of tree preservation during development.
