CALL TO ORDER
Announce the presence of a Quorum.
Chairperson Ellis called the meeting to order at 7:00PM. Those present were:
Chairperson Jeff Ellis, Vice-Chairperson Ms. Linda Jourdan, Board Member Mr. Layne
LeBaron, Board Member Ms. Marilyn Herrera, and Board Member Ms. Karyn McGinnis.
Staff members present were: Senior Planner Charles Lee, Assistant Planner Jasen
Haskins and Administrative Assistant Mary Bradley.
ELECTION OF OFFICERS
1. Hold elections for Chair and Vice-Chair of the Zoning Board of Adjustment.
A motion was made by Board Member Herrera, and seconded by Board Member
McGinnis, to appoint Board Member Ellis as Chairperson. Motion carried 5 — 0.
A motion was made by Board Member LeBaron, and seconded by Board Member Ms.
Herrera, to appoint Board Member Jourdan as Vice-Chairperson. Motion carried 4 — 0,
with Board Member Jourdan abstaining.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes of the June 25, 2007
Meeting.
A motion was made by Board Member Jourdan, and seconded by Board Member
LeBaron, to approve the minutes of the June 25, 2007 meeting as submitted. Motion
carried 4— 0 — 1, with Board Member Ellis abstaining.

PUBLIC HEARINGS
1. Hold a public hearing to consider and act upon a request by Jackie
Mcllroy for a Variance to Section 3.2.B.3 Development Standards of the
Zoning Ordinance to reduce the rear yard setback from the required 25
feet to 17 feet. (ZBA 2007-11).
Mr. Haskins stated that the property is located at 1301 Columbus Lane and was
developed in September 2003 with the platting of Birmingham Farms Addition Phase
3B.
The applicant desires to construct a pergola over an existing patio in the rear of the
main structure. The pergola would be twelve feet deep and extend seven feet into the
required rear setback.
The applicant states that a hardship exists due to the main structure being built within
six feet of the required setback with an existing 10' x 10' concrete patio that extends
four feet into the required setback. In addition, the applicant states that the pergola will
provide shading for the rear entrance into the home.
Twenty-nine comment forms were mailed to property owners within 200 feet of this
request, and no responses were received.
Chairperson Ellis opened the Public Hearing.
Mr. Greg Mcllroy, applicant and property owner of the subject property, stated that the
concrete slab was poured at the time of construction of the main structure. The pergola
will be constructed out of red cedar.
Board Member Ms. Jourdan questioned if most of the residential dwellings in that
subdivision had concrete pads and if constructed at the time the dwelling units were
built. Mr. Lee stated that the question is very important, and that approximately 90
percent of the lots have the concrete slab poured at the time of construction of the
dwelling units. As planners and developers will need to be more diligent on how plans
are reviewed on how footpads of the dwelling units are laid out, whether the dwelling
unit will have the sun directly facing the homes. Additional requests may be coming
before the Board, because of the setback constraints and that property owners are
unaware of the need to obtain permits prior to construction.
Chairperson Ellis closed the Public Hearing.
A motion was made by Board Member Mr. LeBaron, and seconded by Board Member
Ms. Jourdan, to GRANT the request for a variance to Section 3.2.B.3 Development
Standards of the Zoning Ordinance to reduce the rear yard setback from the required 25
feet to 18 feet. Motion carried 5 — 0.

ADJOURNMENT
A motion was made by Board Member Ms. Herrera, and seconded by Board Member
Mr. Ellis, with the consensus from all Board Members to adjourn the meeting at 7:12PM.
