CALL TO ORDER
Chairman Dennis Larson announced that a quorum was present and called the
meeting to order at 7:03PM. Those present besides Chairman Larson were, Vice-
Chair Scott Ames, Commissioner Ramona Kopchenko, Commissioner Phillip
Johnston, Commissioner Tim Bennett, and Commissioner Ruthie Wright.
Commissioner John Onufreiczuk was absent
Staff present was Renae 011ie, Charles Lee, and Mary Bradley.
INVOCATION & PLEDGE OF ALLEGIANCE
Commissioner Wright gave the invocation and Commissioner Kopchenko led the
pledge of allegiance..
CITIZENS COMMENTS
Chairman Larson opened the Citizens Participation. No one approached the
Commissioners; Chairman Larson closed the Citizens Participation.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes from the November 6,
2007 Regular Meeting.
A motion was made by Commissioner Johnston, and seconded by Vice-Chair
Ames, to approve the minutes from November 6, 2007 Regular Meeting, as

REGULAR AGENDA
Action Agenda
1. Consider a recommendation to the City Council regarding a Final
Plat creating nine (9) commercial lots and one (1) open space lot
for Regency Steel Business Campus, Block A, Lots 1 — 10,
generally located east of Regency Drive and north of Steel Road.
Mr. Lee stated that the property totals 3.915 acres and will create and establish a
commercial business campus consisting of nine lots and one common area lot.
The proposed development is located within the Regency Park Industrial area,
and has frontage along Regency Drive and Steel Road.
In May 2007, the City Council approved (PD 2007-14) to accommodate an
innovative commercial/industrial campus with a common area and privately
maintained access easements connecting interior lots, with stipulation that
landscaping requirements to be calculated for entire development, and the
parking be based on the entire development as well.
The Final Plat complies with all applicable technical requirements of the City of
Wylie including the Subdivision Ordinance and staff recommends approval.
Commissioner Kopchenko questioned how the common use area will be handled.
and if the Site Plan will be submitted after all the lots have approved Site Plans.
Mr. Bryan Rogers, NiCom Construction, 120 Regency Drive, represented the
developer, stated that the common area will be owned by the mandatory
Property Owners' Association. The lot can be submitted at any time, the
common lot will have a small parking area, landscaping that will be irrigated and
small park setting. Each commercial lot within the development will pay a fee to
the Property Owner's Association, and the proposed park will be maintained by
the Property Owner's Association. A mutual access easement connecting the
interior lots will be maintained by the Property Owner's Association as well. The
Commissioners requested that the Site Plan for the common area lot be
submitted when the Site Plan for the first lot is submitted. Mr. Rogers agreed to
submit the Site Plan within the week.
Commissioner Bennett questioned the ownership of Regency Drive and if it is a
private street. Mr. Lee stated that Regency Drive and Steel Road are both
maintained by the City of Wylie. However, when a development is submitted to
the City, staff uses the opportunity to clean up the road by dedicating right-of-
way. Ms. 011ie stated that staff will submit to the City Engineer questioning the
legality of changing from a private road into a city-maintained road.
A motion was made by Vice-Chair Ames, and seconded by Commissioner
Johnston, to recommend approval to the City Council for the Final Plat Regency
Steel Business Campus, Block A, generally located east of Regency Drive and
north of Steel Road, with the stipulation that a Site Plan for Lot 3, common area,
be submitted with the Site Plan for the first lot within the development. Motion
carried 6 — 0.

PUBLIC HEARING
1. Hold a Public Hearing and consider a recommendation to City
Council regarding an amendment to Zoning Ordinance 2006-04,
Article 5, Sections 5.1 (F)(3): Retail, Personal Service &
Commercial, establishing regulations specifying the location of
Major Automobile Repair uses. Text Amendment
Ms. 011ie stated that staff has conducted research on the permitted uses within the
Light Industrial (LI) District, particularly Major Automobile Repair. Currently, the use
is allowed by right within the Commercial Corridor (CC) and Heavy Industrial (HI)
Districts.
A property owner has approached staff, with a desire to operate such use. The
property is located within the Regency Business Park Addition, and the zoning is LI.
Ms. 011ie reviewed the revisions and amendments to the Zoning Ordinance for the
Regency Business Park Addition from 2001 to 2006, which changed from Business
Center (BC) to the current zoning LI.
Light Industrial Zoning includes less-intensive assembly, warehousing and
distribution of products, while excludes uses such as but not limited to meat packing,
chemicals and petroleum processing and manufacturing and foundries. The
recommendation is to allow major automobile repair uses within the LI District with a
Specific Use Permit (SUP). This will provide a means for developing certain uses in
a mariner in which the proposed use will be compatible with adjacent properties and
allows for site specific conditions where certain impacts may exist that require
additional review to ensure compatibility between uses.
Vice-Chair Ames expressed the desire to amend the Zoning Ordinance to allow
major automobile repair uses with a Specific Use Permit within the Commercial
Corridor as well as Light Industrial District. Commissioner Kopchenko questioned if
the Specific Use Permit would limit the number of major automobile repair within the
same area. Ms. 011ie stated that a Specific Use Permit would provide a means to
controlling the number of uses that are adjacent to one another.
Chairman Larson opened the Public Hearing.
Mr. Wale Hameed, 402 Francis Way, Richardson, spoke in favor of the text
amendment.
Chairman Larson closed the Public Hearing.
A motion was made by Commissioner Johnston, and seconded by Commissioner
Bennett, to approve the text amendment to amend Article 5, Section 5.1 (F)(3):
Retail, Personal Service & Commercial, to allow major automobile repair uses with
an Specific Use Permit in the Commercial Corridor and Light Industrial Districts.

Discussion
The applicant is proposing to develop a single story office building on one lot. The lot is .321 acres in size. The
proposed building totals 3,522 square feet intended for general and professional office uses.
The subject property was originally platted as a single family residential lot within the Railroad Addition. It was
previously being used for residential purposes prior to a fire destroying the single family home on the property on
February 20, 2006. Current zoning on the vacant property is Commercial Corridor (CC) District. General,
professional and medical office is a permitted use within the CC District.
The proposed building will be constructed primarily of face brick with stone accents with a clay tile roof. The
site, landscape and elevation plans adhere to both base &desirable design standards.
Recommended for approval subject to additions and/or alterations to the engineering plans as required by the
Engineering Department.

Discussion
The applicant (Nicom Construction, Inc.) is proposing to develop a single story, 4,225 sq. ft. office
showroom/warehouse facility on one lot. The property is zoned Planned Development-2007-14-Light
Industrial (PD-2007-14-LI) and is 0.261 acre in size. City Council established this PD in May 2007 to
accommodate an innovative commercial business campus within the Regency industrial area.
Office showroom/warehouse uses are permitted within the PD. This item represents initial phase of a ten (10)
lot commercial campus (including one open space area) and is in conformance with overall development plan
for the campus. Exterior building materials will consist primarily of brick veneer with minimum 20% stone on
front facade.
This site plan is in conformance with the provisions of the PD as well as the overall adopted development plan;
including setbacks, parking, and landscaping.
In reviewing the final plat for this property, (December 4, 2007 P&Z Meeting) the Commission recommended
that the applicant submit site plan for open space area lot in conjunction with initial phase of the development.
The applicant has submitted the site plan for the open space area lot and it is on the current agenda for
consideration at this time.
The Site Plan complies with all applicable technical requirements of the City of Wylie, and includes a
tabulation of how the planned development regulations will be achieved.

Discussion
The applicant (Nicom Construction, Inc.) is proposing to establish and develop a common open space lot, in
conjunction with the Regency-Steel Business Campus. The property is zoned Planned Development-2007-14-
Light Industrial (PD-2007-14-LI) and is 0.277 acre in size.
City Council established this PD in May 2007 to accommodate an innovative commercial business campus
within the Regency industrial area. This site reflects the required common open space area,providing a picnic-
like setting with sidewalks, park benches and irrigated landscaping as an amenity for the business campus.
In reviewing the final plat for this property, (December 4, 2007 P&Z Meeting) the Commission recommended
that the applicant submit site plan for open space area lot in conjunction with initial phase of the development.
The applicant has submitted the site plan for Lot 10 and it is on the current agenda for consideration at this
time.
The Site Plan complies with all applicable technical requirements of the City of Wylie, and includes a
tabulation of how the planned development regulations will be achieved.

Discussion
The applicant (Nicom Construction, Inc.) is proposing to develop two single-story, 6,030 sq. ft. office
showroom/warehouse facilities on one lot. The property is zoned Planned Development-2007-14-Light
Industrial (PD-2007-14-LI) and is 0.261 acre in size. City Council established this PD in May 2007 to
accommodate an innovative commercial business campus within the Regency industrial area.
Office showroom/warehouse uses are permitted within the PD. This item represents the second phase of a ten
(10) lot commercial campus (including one open space area) and is in conformance with overall development
plan for the campus. Exterior building materials will consist primarily of brick veneer with minimum 20%
stone on front facade.
This site plan is in conformance with the provisions of the PD as well as the overall adopted development plan;
including setbacks, parking, and landscaping.
City Council approved the final plat on December 11, 2007. P&Z Commission will consider Phase 1 (Lots 3 &
10) on this current agenda.
The Site PIan complies with all applicable technical requirements of the City of Wylie, and includes a
tabulation of how the planned development regulations will be achieved.

The property totals 64.69 acres and creates and establishes (17) seventeen commercial lots for a retail shopping, dining
and family entertainment center.
The property was annexed into the City of Wylie in November 1985 and continues to be used for agricultural purposes.
The subject property is part of the Iarger 186.56 acre planned development tract assembled by Herzog Development
Corporation and was successfully rezoned PD2006-01 in January 2006. At that time, the PD established five major use
areas, which include a commercial shopping center component, sports complex, and retirement housing. Specific
provisions were defined as part of the PD, including a Development Plan to serve as an overall site plan for the
development consistent with the City Comprehensive Plan. The development plan accompanies the preliminary plat. The
shaded area reflected on the development plan represents Phase 1 of the commercial development as shown.
This item represents `Tract 1' as indicated in the adopted master plan to allow for those uses permitted within Commercial
Corridor (CC) zoned districts. Tract 1 fronts F.M. 544, has a depth of approximately 1,000 feet and extends from
McCreary Road east to Springwell Parkway. As part of this plat, rights-of-way for both secondary collectors (McCreary
Road & Springwell Parkway)are being dedicated.
The plat will establish the boundaries for 17 Iots including the major and junior anchors located along the rear and
multiple pads for future restaurants, fast food and miscellaneous personal services sites fronting F.M. 544. Designated
access points and traffic signal locations are being evaluated by the City's Engineering Department & TXDOT at this
time.
The Preliminary Plat complies with all applicable technical requirements of the City of Wylie.
The applicant is preparing final site plan for major and junior anchors to be presented at a future P&Z meeting.

Recommendation
Consider a recommendation of approval to the City Council regarding a change in zoning from Light Industrial (LI)
District to Light Industrial-SUP (LI/SUP)District for an Auto Repair Major use, located at 101 Regency Drive,
Block B, Lot I in the Regency Business Park Phase I Addition.
Discussion
Owner: Mr. Wala Hameed Applicant: Mr. Wala Hameed, (Wallace Collision Center)
The subject property is located within the Regency Industrial district at the southeast corner of Regency Drive and
Steel Road (101 Regency Drive) and totals 0.33 acre. The property is currently zoned Light industrial and has been
used for miscellaneous light & heavy industrial uses, including salvage yard, contract construction and open storage
uses. An 800 sq. ft. metal building occupies the southern region of the property along with a fenced open storage
area towards the rear.
Light Industrial districts are intended to provide for less-intensive assembly, warehousing and distribution of
products from previously prepared materials and parts. The primary focus should be industrial and commercial uses
that serve regional, state and national markets. The applicant proposes automotive paint and body repair facility,
which is designated/defined as an Automotive Repair, Major use by the Zoning Ordinance. Auto Repair, Major use
is defined as a facility used for maintenance, repair, and restoration or rebuilding of vehicles under 6,000 pound
gross vehicle weight. This includes engine rebuilding, body work and painting.
City Council voted to amend the Zoning Ordinance to allow Automotive Repair, Major uses within the Light
Industrial zoning district by Specific Use Permit (SUP). An SUP provides a means of oversight and evaluation by
the Commission and City Council of certain uses as to its probable effects upon adjacent properties and the
community's welfare by assuring appropriateness and compatibility with surrounding land.uses.

The applicant is requesting to redevelop an existing salvage yard on the property and has submitted a site plan in
conjunction with this request. The accommodating site plan is on the current agenda for your review. As reflected
on the zoning exhibit,the applicant proposes two(2) one-story buildings on the site:
® Building 1 is a 6,733 sq. ft body shop with paint booth
o Building 2 is a 6,214 sq. ft office and shop area
The proposed redevelopment of the property shall be in compliance with current nonresidential design requirements
including exterior building material, site and landscape designs. In addition, the applicant has committed to
prohibiting any outdoor open storage of inoperable vehicles including miscellaneous automotive parts.
The Comprehensive Plan designates Light Industrial uses for the area of this request. Surrounding properties to the
north, south and east are zoned Light Industrial and are being used for similar uses within the immediate area.
(Metro Fleet.Collision Repair)
In summary, the request for an SUP to redevelop the property for Auto Repair, Major facility is generally consistent
with Light Industrial designated land uses. Therefore, the applicant's request for an SUP to operate such facility
within LI is acceptable subject to adequate landscaping and other safeguards to ensure possible effects of such use
will not be detrimental to the surrounding properties. Staff recommends approval subject to City Council final
adoption of pending text amendment to Zoning Ordinance regarding Automotive Repair, Major uses within certain
districts. (Section 5.1 (F))
Notification/Responses: Twelve (12) notifications were mailed, with no written response returned favoring the
request and two (2)responses opposing the request at the time of packet distribution.

My husband and 1 own the building next. door to the propose.property. We oppose the
petition for several reasons:
"Three years ago we were told that no more body shops would be allowed in our area and
we spent 2 months proving that we were given permission to build and we should be
grandfathered in. Finally we were given the occupancy permit but with the stipulation
that it would not ever be sold as a body shop. So now you are considering to approve
another body shop when there is a body shop next door on both sides and directly across
the street (see map attached). Isn't it the responsibility of the city to promote some
diversity? Surely you wouldn't put 3 Stnrbucks next to each other, or three Walgreens
within 5.0 feet of each other?"
One of the reasons we moved to Wylie is because the council advertised that they want
business to thrive in this community.
Allowing one body shop next to another,next to another,next to another is not something
I have seen in any modern city where there has been some constructive and conscientious
planning by the city.
We feel even consideration of approval is extremely prejudicial considering the
constraints placed on us.

Recommendation
Motion to approve a Site Plan for Regency Business Park, Phase 1, Block B, Lot 1, for a proposed Auto Repair,
Major facility on one lot on 0.30 acre, generally located east of Regency Drive and south of Steel Road, subject
to final adoption of pending text amendment to Zoning Ordinance, Article 5, Section 5.1 (F).
Discussion
The applicant (Wallace Collision Repair) is proposing to redevelop the existing property which will include
converting the existing 800 square foot structure into a 6,214 square foot office and auto repair garage and
construct and additional 6,733 square foot collision repair and paint booth facility on the property.
The property is zoned Light Industrial and previous uses consisted of salvage yard, contract construction and
various outdoor open storage uses. Currently, Auto Repair, Major is not an allowed use within LI zoned
districts. City of Wylie initiated an ordinance amendment to allow this use by SUP only, and therefore this
Site Plan approval is contingent upon P&Z recommendation and City Council issuance of an SUP. The
accompanying request for an SUP is on the current agenda for your consideration at this time.
The Site Plan complies with all applicable technical requirements of the City of Wylie, including site,
architectural and landscape design requirements. As noted on the site plan, the applicant has committed to
restricting open outdoor storage (on-site) of any and all inoperable vehicles beyond normal business hours and
at times when necessary & within limited time frame.
