Those present besides Chairman Larson were, Vice-Chair Scott Ames, Commissioner Ramona Kopchenko, Commissioner Willie Osborne, Commissioner Phillip Johnston, Commissioner Tim Bennett and Commissioner Ruthie Wright. Staff present was Renae 011ie, Planning Director, Jasen Haskins, Assistant Planner, and Mary Bradley, Administrative Assistant. INVOCATION & PLEDGE OF ALLEGIANCE Commissioner Bennett gave the invocation and Commissioner Osborne led the pledge of allegiance. CITIZENS COMMENTS Chairman Larson opened the Citizens Participation. No one approached the Commissioners; Chairman Larson closed the Citizens Participation. CONSENT ITEMS 1. Consider and act upon approval of the Minutes from the March 4, 2008, Regular Meeting. A motion was made by Commissioner Johnston, and seconded by Commissioner Osborne, to approve the minutes from March 4, 2008 Regular Meeting, as submitted. Motion carried 7 — 0. Minutes March 18,2008 Wylie Planning and Zoning Board Page 1 of 7 REGULAR AGENDA Action Agenda 1. Consider and act upon approval of a Site Plan for Wylie Professional Park, being Lot 4 Block A of the Martinez Addition for four 4,800 square foot buildings, generally located on Kirby just east of SH 78. Mr. Haskins stated that the applicant is proposing to develop a professional office/retail park consisting of four 4,800 square foot buildings on just over 1.9 acres. The property is located adjacent to Brookshire's grocery store east of Highway 78 and south of Kirby. The property is zoned Community Retail (CR) District and the potential retail or professional office uses are allowed by right within this district. The property currently has several large trees, in which the site plan does specify preservation of the trees. The applicant is proposing a combination of iron fence with masonry posts and landscape to screen between the property and the adjacent residential development to the rear of the property. This is in lieu of required six-foot masonry wall required by the Zoning Ordinance. With no questions for the applicant or staff a motion was made by Vice-Chairman Ames and seconded by Commissioner Johnston, to approve the Site Plan for a Wylie Professional Park on Lot 4 Block A of the Martinez Addition, and allow a combination masonry and landscape screen in lieu of a solid masonry wall. Subject property is generally located on Kirby just east of State Highway 78. Motion carried 7 — 0. 2. Consider and act upon approval of a Site Plan for Woodbridge Crossing, Lots 1, 2, 6-9, 14, 17 Block A for a 532,442 square foot development on 64.68 acres, generally located on the south side of FM 544 between McCreary Road and Springwell Parkway. Mr. Haskins stated that the applicant is proposing to develop 550,000 square foot buildings for commercial uses on approximately 65 acres. The property is generally located on the south side of FM 544 between McCreary Road and Springwell Parkway. The property is zoned as Planned Development Ordinance 2006-01, with allowed uses similar to Commercial Corridor. The current site plan detailing only lots 1, 2, 6-9, 14 and 17 consist of Phase One of the development. The remaining lots will be submitted later as those pad sites are sold and developed. The PD 2006- 01 allows the use of 9 feet by 18 feet parking spaces as shown on the site plan. The current Zoning Ordinance requires 10 feet by 20 feet. Minutes March 18,2008 Wylie Planning and Zoning Board Page 2 of 7 The landscaping is determined by all of the lots combined within the current site plan (lots 1, 2, 6-9, 14, and 17).Therefore, the overall percentage as outlined within PD 2006-01 has been met. The applicant is proposing to construct the development with Prodema-Baq+ product. Although the Prodema-Baq+ is not a primary material defined within the "Building Articulation" section of the Zoning Ordinance, staff along with the Building Official, agree that the product is aesthetically durable. Ms. 011ie stated that the Fire Marshal and the Building Official both have submitted a report approving the Prodema-Baq+ product, stating that the product meets the intent of the Zoning Ordinance as well as the design theme for Woodbridge Crossing set forth within the PD 2006-01. Commissioner Bennett expressed concern of the size of the parking spaces and the radius of the driveways off FM 544. Commissioner Bennett stated that the radius on the site plan indicating 20 feet needs to be increased to 30 feet and the radius along the main drive within the parking lot, needs to be increased to 25 feet. He also stated he wanted to see the parking spaces increased to 10 feet by 20 feet. Ms. 011ie stated that the size of the parking spaces were within the conditions of the PD 2006-01, and the PD was approved by Council. The Commissioners can not deny the Site Plan based on the size of the parking spaces, because it is a condition within the PD, which is a zoning use. Commissioner Bennett questioned the number of parking, which is in excess of the required numbered parking. The number of parking spaces required is 2,100 and the number provided is 2,700. Bryan Burger, Lawrence A. Cates and Associates, 14800 Quorum Drive, Suite 200, Dallas, Texas, represented the civil engineer for the property stated that the requirement for the parking spaces is generally a 1 to 250 ratio for retail parking, and this ratio is not enough parking for Target. The ratio is set at 4.28 per 1,000 for retail parking and the remainder parking is set on straight commercial parking. Therefore the intent is to provide parking not only for retail but for other commercial uses not yet determined. The parking lot may not be full on any one day, except during peak seasonal times and with a possibility of restaurants coming into the development, the additional parking spaces will be needed. Commissioner Bennett asked the applicant to increase the parking spaces to 10 feet by 20 feet. Mr. Burger responded that he could not make that change, that the way the agreement is set between Target and the real estate committee with the City of Wylie, the parking spaces can not be revised. Commissioner Bennett questioned the right turn lane in front of the property and the radius for the drives. Mr. Burger stated that the turn lanes start and stop at each drive approach, and the drive is 245 feet of storage and 100 feet of transition, essentially 345 feet. The radius for all the main drives is 30 feet, except for the minor entry drive which is 24 feet. The drive width is increased to 30 feet and the radius width is decreased to 20 feet. Ms. 011ie stated that the Fire Marshal has approved the radius width to 20 feet being that the drive is 30 feet in width. Minutes March 18,2008 Wylie Planning and Zoning Board Page 3 of 7 Commissioner Kopchenko questioned the number of turning lanes. Mr. Burger stated that the entryway in the middle of the development will be two-lane divided by median and a signal light. The main entries from McCreary and Springwell will be three lanes, one going left, one right, and the center lane remaining straight. There will be smaller two lane entries, which will be one lane coming in and one lane exiting turning right. Commissioner Wright questioned the type of trees, Bald Cypress, proposed for the entire landscaping in the parking lot. Mr. Burger stated that he was open for changes or revisions. Ms. 011ie stated that the Ordinance does have a replacement contingency for trees, and the property owner is responsible for replacement. However, if the Commission would like for a variation of tree species, then within the motion the stipulation would need to be made stating that a variation of tree species be included. A motion was made by Commissioner Johnston, and seconded by Vice-Chair Ames, to approve the Site Plan for new development on Lots 1, 2, 6-9, 14, 17 Block A of Woodbridge Crossing. Subject property is generally located on the south side of FM 544 between McCreary Road and Springwell Parkway, with the stipulation that a variety of tree species be planted throughout the parking lot. Motion carried 6 — 1, with Commissioner Bennett voting in opposition. 3. Consider a recommendation to the City Council regarding a Final Plat for Woodbridge Crossing creating seventeen (17) commercial lots on 64.68 acres, generally located south of FM 544 between McCreary Road and Springwell Parkway. Mr. Haskins stated that the property totals 64.68 acres and creates and establishes (17) seventeen commercial lots for a retail shopping, dining and family entertainment center. The property is part of the larger 186.56 acre planned development tract assembled by Herzog Development Corporation and was successfully rezoned as PD 2006-01 in January 2006. The plat will establish the boundaries for 17 lots including the major and junior anchors located along the rear and multiple pads for future restaurants, fast food and miscellaneous personal services sites fronting FM 544. Commissioner Bennett questioned the right-of-way acquisition for McCreary Road and FM 544 and Springwell Parkway and FM 544. Mr. Sam Satterwhite, WEDC stated that the acquisitions are in the final stages of being purchased. The right-of-way acquisition from FM 544 and Springwell Parkway is being donated to the city for dedication for right-of-way. The existing billboard is included in the acquisition and will be taken down. Minutes March 18,2008 Wylie Planning and Zoning Board Page 4 of 7 A motion was made by Commissioner Johnston, and seconded by Vice-Chair Ames, to recommend approval to the City Council for a Final Plat establishing seventeen (17) commercial lots on 64.68 acres, generally located south of FM 544 between McCreary Road and Springwell Parkway. Motion carried 7 — 0. Public Hearing 1. Hold a Public Hearing and consider a recommendation to the City Council regarding a change in zoning from Agriculture (AG) to Planned Development-Agricultural District (PD-AG/30), generally located west of FM 1378 (Country Club Road) and south of FM 2514 (Parker Road). ZC2008-03. Ms. 011ie stated that the applicant is proposing to construct an 113,150 square foot church/worship facility for Gateway Community Church on 12.6 acres. The property to the north is zoned Agricultural, and being used for bona fide agricultural purposes. The property to the west is occupied by Wylie Independent School District and platted as Rita Smith Elementary School. Properties to the south are zoned Planned Development for single-family residential dwelling. The applicant is proposing tilt wall construction in lieu of the required masonry exterior. The applicant is requesting the use of tilt wall on walls that will not be permanent exterior walls. The northern and western exterior wall of Phase 1 will be constructed with at least 20% stone, brick or cast stone per current Zoning Ordinance requirement, and the eastern and southern walls will be tilt wall construction to allow for future phases of development. Landscaping shall be provided in proportion with each phase. Overall, upon completion of all phases, landscaping shall encompass 37.4 percent. In an effort to shield property owners along the southern border of the property, shrubs or trees shall be planted as development of the property moves southward. During the first phase of the development, the PD proposes to construct 61 on-site spaces to accommodate the 2,280 seat sanctuary. Off-site spaces of 77 will be located on the adjacent WISD Smith Elementary School site. When the development is complete with all phases, 570 parking spaces will be provided on site. The shared parking agreement with WISD shall be approved by City Council in accordance with Article 7, Section 7.3.F.2 Shared Parking. Mr. Bryce Greene, 1333 W McDermott, Allen Texas represented the Gateway Community Church, stated that tilt wall will be constructed with concrete with textured finish. Minutes March 18,2008 Wylie Planning and Zoning Board Page 5 of 7 Commissioner Bennett addressed concerns for the retention/detention pond. Mr. Greene stated that the long-term intent is for a well to be installed and have the property irrigated from that pond. Ms. 011ie stated that civil engineer drawings will be submitted with the Final Site Plan, and the city engineer will review and approve the storm drainage for the retention and detention on the property. The Planned Development only approves the Conceptual Plan and not the Final Site Plan. The Commission will have the opportunity to review and approve a Final Site Plan. A motion was made to recommend approval, however, the motion was rescinded due to the public hearing was not opened. Chairman Larson opened the Public Hearing, and with no one approaching the Commissioners, Chairman Larson closed the Public Hearing. A motion was made by Commissioner Johnston, and seconded by Vie- Chair Ames, to recommend approval to the City Council on Zoning Case 2008 — 03 regarding a change in zoning from Agriculture District (AG/30) to Planned Development — Agricultural District (PD-AG/30). Motion carried 6 — 1, with Commissioner Kopchenko voting in opposition. Action endo 4. Consider and act upon adoption of the Planning and Zoning Commission Rules of Procedure. Ms. 011ie stated that the Planning and Zoning Commission Rules of Procedure was never formally adopted. The only revision made when the original Rules of Procedure were drafted, was the open meeting act in Section 2.3, which is a requirement and the time for the meetings to begin at 6:30pm instead of 7:00pm. With no questions for staff, a motion was made by Vice-Chair Ames, and seconded by Commissioner Johnston, to approve and adopt the Planning and Zoning Commission Rules of Procedure. Motion carried 7 —O. MISCELLANEOUS Ms. 011ie distributed a draft Ordinance amending the Zoning Ordinance for posting signs on the property requesting a change in zoning. Prior to 2001 Zoning Ordinance amendment, Section 35 was revised by Ordinance 98-23. Ms. 011ie presented additional revisions to the Ordinance 98-23, and asked the Commissioners for direction. The consensus from the Commissioners was to review and submit for public hearing. Discussion The subject property is part of the larger tract totaling 10.485 acres and consisting of two commercial/retail lots. The applicant is proposing to develop two single story retail buildings on one lot. The lot is 5.713 acres in size. Two 22,100 square foot buildings will be constructed on this lot.No plans for Lot 2 have been submitted as of yet, but will be commercial/retail in nature. The property is zoned Commercial Corridor (CC) District. The Wylie Ranch East residential subdivision abuts the subject property to the south. Therefore a six (6) foot high solid screening wall will be required to separate the CC district from the Residential District. In addition, consideration is being given to building height and site lighting. A replat is on the current agenda for consideration, and dedicates .282 acres of existing right-of-way for Kreymer Lane. In summary, The Site Plan complies with all applicable technical requirements of the City of Wylie including site, architectural and landscape design requirements and staff supports and recommends approval of the site plan. In January of 2006, Council adopted a minimum lot size of 10,000 square feet for single-family residential dwellings. The subject tract is located in the un-incorporated portion of Collin County outside of the city limits of Wylie. The Twin Lakes Subdivision located to the north and zoned SF-10-24 lies within Wylie city limits. Southbrook Phases I&II are within the city limits and are located to the east and south of the subject tract and zoned PD 2002-08. Properties to the west are owned and occupied by Eastfork Utility District. Southbrook Phase I & Phase II (PD-2002-08) are developed as single-family dwelling units providing a minimum lot size of 8,000 square feet with a minimum lot width of 65 feet. The Twin Lakes Subdivision is developed as single-family residential dwellings and was platted in 1988 under the 1985 Zoning Ordinance providing for a minimum lot size of 8,000 square feet on 8 lots and minimum 10,000 square feet on 86 lots and with a minimum lot width of 60 feet. The applicant does not wish to annex the subject property into the City of Wylie. If zoning were to occur, the property would first have to be annexed pursuant to Section 2.2.B and then a Planned Development would have to be approved in order to meet the proposed lot and width sizes as presented. The Preliminary Plat does not comply with the requirements of the Subdivision Regulations. Section 3.6 states that lots shall conform to the minimum requirements of the established zoning districts. The established zoning districts in accordance to the City's Zoning Ordinance requires a minimum lot size of 10,000 square feet with a minimum lot width of 75 feet. The subject tract would not be serviced by sewer through the City of Wylie.In order for the property to install septic tanks,all lots must be a minimum of 1 acre as required by Collin County Court Order No.2001-297-05-14. Helen Starnes, Ex-Officio Clerk Commissioners' Court Collin County, TEXAS Court2001 VmiscellalRutes•OSSF • ORDER ADOPTING RULES OF COLLIN COUNTY, TEXAS FOR ON-SITE SEWAGE FACILITIES PREAMBLE WHEREAS, the Texas Natural Resource Conservation Commission has established Design Criteria for on-site sewage facilities to provide the citizens of this State with adequate public health protection and a minimum of environmental pollution; and WHEREAS, the Legislature has enacted legislation, codified as Texas Health and Safety Code, Chapter 366 which authorizes a local government to regulate the use of on- site sewage disposal facilities in its jurisdiction in order to abate or prevent pollution, or - • - injury to public health arising out of the use of on-site sewage facilities; and WHEREAS, due notice was given of a meeting and public hearing to determine whether the Commissioners' Court of Collin County, Texas should enact an order controlling or prohibiting the installation or use of on-site sewage facilities in the county of Collin, Texas; and WHEREAS, said meeting and public hearing were held in accordance with the notice thereof, and the evidence and arguments there presented were considered by the Commissioners' Court of Collin County, Texas; and WI II:RFAS, the Commissioners' Court of-Collin County, Texas finds that the use of on-site sewage facilities in Collin County, Texas is causing or may cause pollution, and is injuring or may injure the public health; and WHEREAS, the Commissioners Court of Collin County, Texas has considered the matter and deems it appropriate to enact an Order adopting Rules regulating on-site sewage facilities to abate or prevent pollution, or injury to public health in Collin County, Texas. NOW, THEREFORE, BE IT ORDERED BY THE COMMISSIONERS COURT OF COLLIN COUNTY, TEXAS: SECTION 1. THAT the matters and facts recited in the preamble hereof are hereby found and determined to be true and correct; SECTION 2. THAT the use of on-site sewage facilities in Collin County, Texas is causing or may cause pollution or is injuring or may injure the public health; SECTION 3. THAT an Order for Collin County, Texas BE adopted entitled "On-Site Sewage Disposal," which shall read as follows: AN ORDER ENTITLED ON-SITE SEWAGE DISPOSAL SECTION 4. CONFLICTS. • All Orders or parts of the Orders of Collin County, Texas not consistent with or in conflict with the provisions of this Order are hereby repealed. SECTION 5. ADOPTING CHAPTER 366. The County of Collin, Texas clearly understands the technical criteria, legal requirements, and administrative procedures and duties associated with regulating on-site sewage facilities, does adopt and will fully enforce Chapter 366 of the Texas Health and Safety Code. SECTION 6. AREA OF JURISDICTION. (a) The Rules shall apply to all the area lying in Collin County,Texas except-__.- for the area regulated under an existing Rule and the areas within incorporated cities. (b) These Rules shall apply to those incorporated cities or towns that have executed intergovernmental contracts with Collin County,Texas. SECTION 7. ON-SITE SEWAGE FACILITY RULES. Any structure discharging sewage into an on-site sewage facility within the jurisdictional area of Collin County,Texas must comply with the Rules adopted in Section 8 and 10 of this Order. SECTION 8. ON-SITE SEWAGE FACILITY RULES ADOPTED. The Rules ("Design Criteria For On-Site Sewage Facilities" and Administrative Rules 30 TAC 285.1 —285.91),attached hereto, promulgated by the Texas Natural Resource Conservation Commission for on-site sewage systems are hereby adopted, and all officials and employees of Collin County, Texas having duties under said Rules are authorized to perform such duties as are required of them under said Rules. SECTION 9. INCORPORATION BY REFERENCE. The Design Criteria and all future amendments and revisions thereto are incorporated by reference and are thus made a part of these Rules. A copy of the current design Criteria is attached to these Rules as Appendix I. SECTION 10. AMENDMENTS. The County of Collin, Texas wishing to adopt more stringent Rules for its onsite Sewage Facility Order understands that the more stringent conflicting local Rule shall take precedence over the corresponding Texas Natural Resource Conservation Commission requirement. Listed below arc the more stringent Rules adopted by Collin County, Texas: (a) Platted or unplatted subdivisions of single family dwellings served by a public water supply, but utilizing on-site sewage facility methods for sewage disposal, platted or designed after the effective date of this order shall provide for individual lots having a surface area of at least one (1) acre. (b) Platted or unplatted Subdivisions of single family dwellings served by individual water systems and utilizing on-site sewage facility methods for sewage disposal, platted or designed after the effective date of this order shall provide individual lots having a surface area of at least one and one half(1.5) acres. (c) Either a registered professional sanitarian or registered professional engineer who has completed a site-evaluator's course shall perform site evaluations_ (d) All OSSF Systems in Collin County's jurisdiction shall be subject to Licensing Requirements regardless of lot size. (e) Maintenance inspections shall be performed every four months, with no fewer than 120 days and no more than 130 days between inspections. (1) All surface irrigation spray heads shall be subsurface (pop-up) heads. SECTION 11. DUTIES AND POWERS The Environmental Services Specialists of Collin County, Texas are herewith declared the designated representatives for the enforcement of these Rules within its jurisdictional area. The appointed individual(s) must be approved and certified by the Texas Natural Resource Conservation Commission before assuming the duties and responsibilities of the Designated Representative of Collin County. SECTION 12. COLLECTION OF FEES All fees collected for permits and/or inspections shall be made payable to Collin County, Texas. SECTION 13 APPEALS. Persons aggrieved by an action or decision of the Designated Representative may appeal such action or decision to the Commissioners' Court of Collin County, Texas. SECTION 14. PENALTIES This Order adopts and incorporates all applicable penalty provisions related to on- site sewage facilities, which includes, but is not limited to, those found in Chapters 341 and 366 of the Texas Health and Safety Code, Chapter 7 and 26 of the Texas Water Code and 30 TAC Chapter 285. SECTION 15. SEVERABILITY. It is hereby declared to be the intention of the Commissioners' Court of Collin County, Texas that the phrases, clauses, sentences, paragraphs, and sections of this Order are severable, and if any phrase, clause, sentence, paragraph, or section of this Order should be declared unconstitutional by the valid judgement or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this Order, since the same would have been enacted by the Commissioners' Court without incorporation in this Order of such unconstitutional phrases, clause, sentence, paragraph, or section SECTION 16. RELINQUISIIMENT OF ORDER If the Commissioner's Court of Collin County, Texas decides that it no longer wishes to regulate on-site sewage facilities in its area of jurisdiction, the Commissioner's Court shall follow that procedure outlined below: (a) The Commissioner's Court shall inform the Texas Natural Resource Conservation Commission by certified mail at least 30 days belure the published date of the public hearing notice that it wishes to relinquish its On-Site Sewage Facility Order. (h) The Authorized Agent shall post the required public notice in a newspaper regularly published or circulated in the area of jurisdiction at least 30 days prior to the anticipated date of-action by the authorized agent. (c) The Authorized Agent shall send a copy of the public notice, a publisher's affidavit of public notice, and a certified copy of the minutes to the Texas Natural Resource Conservation Commission. (d) The executive director shall process the request for relinquishment and may issue an order relinquishing the authority to regulate OSSF's within the authorized agent's jurisdiction or may refer the request to relinquish to the commission. (e) Prior to issuance of a relinquishment order the local governmental entity and the executive director shall determine the exact date the authorized agent would surrender its authorized agent designation to the executive director. SECTION 17. EFFECTIVE DATE. This Order shall be in full force and effect from and after its date of approval as required by law and upon the approval of the Texas Natural Resource Conservation Commission. Applicant: Greenway Investment Company The applicant Greenway Investment Company is under contract to purchase the subject property and is seeking a change in zoning to allow for flexibility in parking requirements.The current CC zoning requires parking for retail uses at 1 space per 200 square feet of gross floor area; parking for a restaurant establishment is 1 space per every 3 seats under maximum seating arrangement. Standard planning practice for restaurants when parking is based on square footage is 1 space for every one hundred (100) square feet of gross floor area; general office or medical office use is 1 space for every 300 square feet of gross floor area and retail uses require 1 space for every 200 square feet of gross floor area. The PD as proposed would allow for parking to be based on 5 spaces per 1,000 square feet of gross floor area (1:200) regardless of the use. The PD also restricts some land uses currently allowed under the CC District. The retail center is approximately 12,105 square feet on 1.24 acres with 63 total parking spaces. The center is 7.5%leased with a retail tenant occupying 1,610 sq. ft. and utilizing 9 parking spaces per C.O.received 01/29/08. The applicant states that the flexibility would allow them to invite a wide variety of tenants and will allow them the ability to lease the shopping center to a larger restaurant(s) and other food service tenants than would otherwise be allowed. As the property management company is seeking to lease spaces, it is apparent that restaurant tenants could exceed the original floor area designated,thereby requiring and occupying additional parking spaces. Several scenarios can be drawn as to how the tenant spaces would be leased. For your review,we have included five scenarios indicating a mix of office, Page 1 of 2 Page 2 of 2 retail and restaurant uses. The spreadsheet clearly indicates that currently the center could not support mixed uses under our current parking restrictions. However, scenario 4 if developed primarily as an office complex,the need would be meet under current codes. Scenario 5 more than likely will not happen,but is illustrated to show what an open-ended relaxation could produce. If the entire center under current codes were to be occupied by retail users the parking ratio would be 1:200,thereby not requiring any special variances or reductions. PD Conditions The applicant proposes to prohibited the following land uses: Hotel or Motel Mortuary or Funeral Home Automobile Repair,Major Automobile Repair,Minor Car Wash Motor Vehicle Fueling Station Pawn Shop Vehicle Display, Sales or Service Staff recommends the following stipulations be added to the conditions of the PD: 1. Animal Boarding/Kennel with Outside Pens are prohibited 2. Animal Boarding/Kennel without Outside Pens are prohibited 3. Automobile Rental are prohibited 4. Contractor's Maintenance Yard are prohibited 5. Restaurants shall occupy no more than 6,000 total sq. ft of the entire center These cited uses could possibly lend themselves to a higher volume of traffic in and out of the center,or in the case of the Automobile Rental would in fact have a higher volume of stationary vehicles. The parking ratio for the entire center would be 1 space per 200 square feet of gross floor area,regardless of the user. Consideration: The Comprehensive Plan Philosophy designates this tract as Commercial Corridor. As defined in the philosophy, the mixed use corridor is the most diverse and intensive mixture of commercial uses. These uses are located along major thoroughfares to accommodate easiest vehicular access. Such uses are planned and constructed as common "strip" developments with common joint/cross access. In reviewing the proposed amendment consider the following: 1. Safety issues regarding egress and ingress of the site from a major thoroughfare. 2. Whether the proposed number of spaces or ratio of 1:200 is appropriate for restaurant use. 3. Whether relaxing a use specific parking ratio will set an undesirable precedent. 4. Whether the possibility of expanded restaurant and other food service use would be a beneficial support to the City. Current development trends, which has changed since the site plan was approved, calls for more restaurant uses. Recommendation No action. Discussion Prior to the 2001 Zoning Ordinance amendment, Section 35 was revised by Ordinance 98-23 to include requiring applicants to post signs on the subject property indicating a proposed zoning change.However,with the adoption of Zoning Ordinance No.2001-48 this provision was repealed. At the direction of the Commission,staff has drafted an ordinance that will provide regulations for posting proposed zoning change signs on the property in question.The attached Ordinance is language from the previously approved regulations with a few modifications. Staff is requesting that the Commission review and further discuss the proposed amendment. Public Hearing to be scheduled for May 6,2008. WHEREAS,the Planning and Zoning Commission and the governing body of the City of Wylie, Texas, in compliance with the laws of the State of Texas with reference to the amendment of the Comprehensive Zoning Ordinance, have given the requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally and to owners of the affected property, the governing body of the City is of the opinion and finds that the Comprehensive Zoning Ordinance should be amended; NOW,THEREFORE BE IT,ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE,TEXAS: SECTION 1:That the Comprehensive Zoning Ordinance of the City of Wylie,Texas,be,and the same is hereby,amended by the addition of Section,$.1.A.3,which shall read as follows: _ ,_--(Deleted:35.3b j3.Posting property for zoning changes. _--(Deleted:35.3b J Any person,firm or corporation requesting a change in zoning from one district classification to another district classification shall be required to place and maintain a sign or signs,provided py __--(Deleted:and caused to be placed the Planning Department, upon the property for which a change in zoning has been requested, which sign or signs shall be located as follows: a. One sign for the first three hundred(300)feet of each street frontage and one sign for each additional pne thousand(1,000)feet of street frontage,shall be located within thirty(30) __ _--(Deleted:three hundred feet of the abutting street,or as determined by the Director of the Planning Department or -- Deleted:300 his/her designee. b. So as to be clearly visible and readable from the public right-of-way and not obstructed in any manner. c. So as not to create a hazard to traffic on the public rights-of-way abutting the property. d. On the subject property at least ten(10)days prior to the hearing of such zoning request by the Planning and Zoning Commission,and to remain continuously on said property until final action by the City Council or withdrawal of the case by the applicant.Removal of the sign by the applicant after a recommendation by the Planning and Zoning Commission shall constitute a withdrawal of the request. e. The signs,caused to be placed by the Planning Department shall be of a size,type,and message content as determined by the Director of the Planning Department but shall advise that rezoning is requested and shall list the telephone number of the Department of Planning for more information. f. SECTION 3:Any person,firm or corporation violating any of the provisions of this ordinance or the Comprehensive Zoning Ordinance,as amended hereby,commits an unlawful act and shall be subject to the general penalty provisions of Section,1.5 of the Zoning Ordinance,as the same now -{Deleted:38 exists or is hereafter amended. SECTION 4: Should any paragraph,sentence,subdivision,clause,phrase or section of this ordinance be adjudged or held to be unconstitutional,illegal or invalid,the same shall not affect the validity of this ordinance as a whole or any part or provision thereof,other than the part so declared to be invalid,illegal or unconstitutional,and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5.This ordinance shall be in full force and effect from and after its adoption by the City Council and publication of its caption as the law and the City Charter provide in such cases. SECTION 6.The repeal of any ordinance,or parts thereof,by the enactment of this Ordinance, shall not be construed as abandoning any action now pending under or by virtue of such ordinance; nor shall it have the effect of discontinuing,abating,modifying or altering any penalty accruing or to accrue,nor as effecting any rights of the municipality under any section or provisions of any ordinances at the time of passage of this ordinance.
