CALL TO ORDER
Chairman Dennis Larson called the meeting to order at 6:33PM. Those present
besides Chairman Larson were, Vice-Chair Scott Ames, Commissioner Willie
Osborne, and Commissioner Phillip Johnston. Commissioner Tim Bennett
arrived at 6:35PM and Commissioner Ramona Kopchenko arrived at 6:40PM.
Commissioner Ruthie Wright was absent.
Staff present was Renee 011ie, Planning Director, Jasen Haskins, Assistant
Planner, and Mary Bradley, Administrative Assistant.

Vice Chairman Ames gave the invocation and Commissioner Johnston led the
pledge of allegiance.
CITIZENS COMMENTS
Chairman Larson opened the Citizens Participation. No one approached the
Commissioners; Chairman Larson closed the Citizens Participation.

1. Consider and act upon approval of the Minutes from the April 15,
2008, Regular Meeting.
A motion was made by Commissioner Johnston, and seconded by Vice-Chair
Ames, to approve the minutes from April 15, 2008 Regular Meeting, as
submitted. Motion carried 4 — 0. Commissioner Bennett and Commissioner
Kopchenko arrived after the vote was taken.

Action Agenda
1. Consider a recommendation to the City Council regarding a Final
Plat for Bozman Farm Estates, Phase 2 creating 103 single family
residential lots and 3 common areas/open spaces, generally
located east of Troy Road and south of Stone Road.
Ms. 011ie stated that the property totals 27.546 acres and creates one hundred
and three (103) single family residential lots and three common areas/open
spaces to be owned and maintained by the Homeowners Association. The
subject property is part of a Planned Development Ordinance 2002-52 District,
which consists of mixed uses including residential, multi-family, commercial,
possible school site and open spaces.
The Concept Plan approved by City Council on December 11, 2001 serves as an
approved Preliminary Plat.
The plat will establish the boundaries for 103 residential lots and dedicates
several utility easements throughout the property. The designated access points
will be Troy Road from the west and Saddle Ridge Drive from the southeast.
The open spaces will be developed with trails, park benches and lighting, and will
be completed with the development of Phase 2.
Commissioner Bennett questioned the separate instrument for the utility
easements. Ms. 011ie stated that the separate instrument will be filed with the
County along with the filing of the Final Plat. This will take place upon
acceptance of the development after the final plat has been approved for
construction by City Council. Construction will begin upon engineering plans
being released for construction by the City Engineer. Commissioner Bennett
responded that the Plat is getting the cart before the horse.
Melodie Geisler, Jones & Boyd, 17090 North Dallas Parkway, Dallas,
represented the engineer for the property, stated that the infrastructure for the
development is available through the surrounding existing development. The
easements will be obtained prior to final acceptance from the City of Wylie, and
will be filed along with the Final Plat. Commissioner Bennett questioned Ms.
Geisler why the development is submitted if the utility easements are not
obtained. Ms. Geisler stated that the easements were laid out at the time of
initial zoning of the property, and the developer would be risking a lot of money if
the easements were not obtainable, or knew that a chance for the easements
were not going to be obtained. The subdivision will not be developed without the
instruments for the utility easements obtained and filed with the County of
Record. Ms. 011ie stated that prior to the instrument for the utility easements filed
with the County, the City Engineer will write a letter of acceptance, and neither
the utility easement instrument nor the Final Plat can be filed with the County
until the letter of acceptance is written. Commissioner Bennett again expressed

opposition of utility easement not obtained before the development is
constructed. Ms. Geisler stated that when the subdivision is developed the utility
connection will be made and four easements and right-of-way acquisition will be
obtained prior to acceptance of Final Plat.
Ms. 011ie stated the Planning and Zoning Commissioners role is to consider the
layout of the subdivision, the construction of the subdivision is approved by City
Engineer and Building Inspections. The Final Plat as submitted is considered for
approval, it is not being approved for construction or accepted for filing.
Commissioner Osborne questioned the plans for expansion of Troy Road that is
within the County. Ms. Geisler stated that she is not aware of expansion past the
development.
A motion was made by Vice-Chair Ames, and seconded by Commissioner
Johnston, to recommend approval to City Council for the Final Plat for Bozman
Farm Estates, Phase 2, generally located east of Troy Road and south of Stone
Road. Motion failed 3 — 3, with Commissioners Bennett, Osborne and
Kopchenko voting in opposition.
Chairman Larson opened up discussion for reasoning. Commissioner
Kopchenko and Commissioner Osborne expressed the concern of roads not in
place prior to development. Commissioner Kopchenko stated that the roads up
to the property line were gravel and narrow. She stated that the roads need to
be in place prior to development. Commissioner Osborne stated the access from
Stone Road onto Troy Road is a county road and not well maintained. Chairman
Larson stated that the county does not plan for a road to be constructed or
expanded unless development is in place to justify the construction and
expansion. Ms. 011ie asked the Commissioners that opposed the development to
clarify if they were saying that their desire was for all county and city roads are
built before development is constructed. Commissioner Osborne and
Commissioner Kopchenko expressed desire to see a plan and time frame of
when the roads will be constructed and completed. Chairman Larson stated that
the requirement for the need to construct a road will not be in place until after the
subdivision is developed. Mr. Haskins stated that the Fire Department and City
Engineer reviewed the Final Plat and did not express concerns of the access to
the development. The utility easement is not for the Planning and Zoning
Commissioners to review or consider, the easements will be reviewed and
considered by the City Engineer.
Commissioner Kopchenko asked if a re-vote could be done. Ms. 011ie stated that
one of the opposing commissioners would have to recommend.
A motion was made by Commissioner Kopchenko, and seconded by
Commissioner Osborne, to recommend approval to City Council for the Final Plat
for Bozman Farm Estates, Phase 2, generally located east of Troy Road and
south of Stone Road. Motion carried 5 — 1, with Commissioner Bennett voting in
opposition.

Public Hearing
1. Hold a Public Hearing and consider a recommendation to the City
Council to amend Ordinance No. 2001-48 to provide for regulations
of posting signs on property for zoning changes. ZC 2008-05
Ms. 011ie stated that prior to the 2001 Zoning Ordinance amendment, Section 35
was amended by Ordinance 98-23, which required the applicant to post signs on
the subject property indicating a proposed zoning change. With the adoption of
Zoning Ordinance 2001-48 this provision was repealed.
The attached Ordinance is language from the direction received from the
Commission that will provide regulations for posting proposed zoning change
signs on the property in question.
The City of Wylie will provide signs to applicants seeking a zoning change, and
the signs must be in place within fifteen days prior to the hearing of the zoning
request. The placement of the signs will require the first at three hundred (300)
feet of each street frontage and one sign for each additional one thousand
(1,000)feet of street frontage.
In addition, a fee of one hundred and no/dollars ($100.00)will be assessed to
applicants that do not return the sign to the Planning Department within ten days
after City Council has taken action on the zoning change or the request is
withdrawn by the applicant.
When the Ordinance is adopted it shall be unlawful for anyone to remove,
destroy, deface or obstruct the view of a sign which gives notice that a rezoning
has been requested, becomes the law enforceable by Zoning Ordinance 2001-
48, Article 1, Section 1.5.
Chairman Larson opened the Public Hearing. With no one approaching the
Commission, Chairman Larson closed the Public Hearing.
A motion was made by Commissioner Johnston, and seconded by Vice-Chair
Ames, to recommend approval to City Council for Zoning Case 2008-05, to
amend Ordinance No. 2001-48 to provide for regulations of posting signs on
property for zoning changes. Motion carried 6—0.

A motion was made by Commissioner Bennett, and seconded by Commissioner

Discussion
The applicant (Nicom Construction, Inc.) is proposing to develop a single story, 6,500 sq. ft. office
showroom/warehouse facility on one lot. The property is zoned Planned Development-2007-14-Light
Industrial (PD-2007-14-LI) and is 0.383 acres in size. City Council established this PD in May 2007 to
accommodate an innovative commercial business campus within the Regency industrial area.
Office showroom/warehouse uses are permitted by right within the PD. This item represents the continuation
of a ten(10) lot commercial campus and is in conformance with overall development plan for the campus.
This site plan is in conformance with the provisions of the PD as well as the overall adopted development plan;
including setbacks,parking, and landscaping.
The Site Plan complies with all applicable technical requirements of the City of Wylie, and includes a
tabulation of how the planned development regulations will be achieved.

Discussion
The applicant (Nicom Construction, Inc.) is proposing to develop a single story, 5,980 sq. ft. office
showroom/warehouse facility on one lot. The property is zoned Planned Development-2007-14-Light
Industrial (PD-2007-14-LI) and is 0.383 acre in size. City Council established this PD in May 2007 to
accommodate an innovative commercial business campus within the Regency industrial area.
Office showroom/warehouse uses are permitted by right within the PD. This item represents the continuation
of a ten(10)lot commercial campus and is in conformance with overall development plan for the campus.
This site plan is in conformance with the provisions of the PD as well as the overall adopted development plan;
including setbacks,parking, and landscaping.
The Site Plan complies with all applicable technical requirements of the City of Wylie, and includes a
tabulation of how the planned development regulations will be achieved.

Recommendation
Motion to recommend approval to City Council for a Final Plat establishing one lot on 7.704 acres, generally
located on the northwest corner of S.H. 78 and Oak Street.
Discussion
The property totals 7.704 acres and creates and establishes one Community Retail(CR)lot for a church/place of worship.
The property is currently owned by First Baptist Church and currently consists of numerous lots on several different
blocks. The Church wishes to expand its facilities as it has grown in membership as Wylie has grown in population. In
order to accomplish their goals FBC has purchased several lots near the Downtown Historic District (DTH) over the
years. Their current expansion plans, as presented to the City in 2007, call for buildings that would not have met the
setback requirements. In addition, the growth of the Church has presented a safety issue as people regularly cross Marble
and First streets to get from the parking lots to the church facilities.
In order to solve both of those issues FBC asked the City to abandon the R.O.W. on First Street from Marble to Jefferson
and Marble Street from the DTH boundary to Second Street. FBC's request was approved and the church paid the
appraised value of the land to the City. In addition, FBC agreed to allow public access on the streets to the point in time
when the expansion takes place.
Therefore,the purpose of this plat is to incorporate the abandoned right-of-way into the adjacent platted lot(s), as required
by Section 2.12 Abandonment of right-of-way of the Subdivision Ordinance.
The Final Plat complies with all applicable technical requirements of the City of Wylie.

Discussion
This item was tabled at the request of the applicant at the Planning and Zoning meeting held on April 15,2008. The applicant is
again requesting to table the item to allow for additional time to review the house standards for the proposed development
agreement.
The subject tract is located in the un-incorporated portion of Collin County outside of the city limits of Wylie. The Twin Lakes
Subdivision located to the north and zoned SF-10-24 lies within Wylie city limits. Southbrook Phases I&II are within the city
limits and are located to the east and south of the subject tract and zoned PD 2002-08. Properties to the west are owned and
occupied by Eastfork Utility District. Southbrook Phase I & Phase II (PD-2002-08) are developed as single-family dwelling
units providing a minimum lot size of 8,000 square feet with a minimum lot width of 65 feet. The Twin Lakes Subdivision is
developed as single-family residential dwellings and was platted in 1988 under the 1985 Zoning Ordinance providing for a
minimum lot size of 8,000 square feet on 8 lots and minimum 10,000 square feet on 86 lots and with a minimum lot width of 60
feet.

Discussion
Applicant: City of Wylie
The current Zoning Ordinance limits non-residential uses within residentially zoned areas.Under current regulations,
a library, general/governmental offices are not allowed within Residential Districts.
Therefore, staff is requesting the establishment of a Business Government District to accommodate municipal
facilities located within residentially zoned districts. The Business Government(BG)District is intended to serve as
a pedestrian-friendly center for governmental, office, cultural, entertainment and light commercial uses.
Several parcels throughout the city would be affected by this proposed zoning change.
1. City-owned property (ABSTRACT A0563 MILLIRON, M, TRACT 2) generally located north of FM 544, south
of FM 3412 (Brown Street) and east of FM 1378 (Country Club Road). The subject property consists of
approximately 160 acres. The property was annexed in 1995 (Ordinance No. 95-51 & 95-52), and is zoned AG/30.
Typically, properties annexed within the city are designated with Agricultural (AG/30) zoning category. This
classification is considered temporary until permanent zoning is established by the Council or the proposed use is
allowed within the AG/30 District.

City-owned property (ABSTRACT A0196 CURTIS, JOHN W., TRACT 1,), generally located north of FM 544,
south of FM 3412 (Brown Street) and west of FM 1378 (Country Club Road). The subject property consists of
approximately 68 acres. The property was annexed in 1995 along with Tract 6, and is zoned AG/30. Properties to the
north are currently zoned Agricultural, and are developed as single family uses. Properties to the west are zoned
Agricultural and Planned Development for single family dwellings as well.
The tracts are traversed by FM 1378 (Country Club Road); FM 3412 (Brown Street)to the north, and FM 544 to the
south. Both FM 1378 and FM 3412 are scheduled for improvements (realigning & widening) in year 2008-09.
Properties to the north are zoned Neighborhood Services (NS) and has been partially developed for retail service
uses. Properties to the east are currently zoned Agricultural, and are developed as single family uses along the
frontage of Brown Street.
The tracts were acquired by the City of Wylie in January 2005 in conjunction with 2005 voter approved bond
referendum, and subsequently selected for the site of the new Civic Center, consisting of city hall administration,
library, and recreation facilities.
2. City-owned property, (ABSTRACT A0023 ATTEBURY, ALLEN, TRACT 23, ACRES 28.3920), located at 800
Thomas Street, currently the home of Smith Public Library. Although it is uncertain at this time how this building
will be utilized once the new Library is constructed,its current zoning is SF-10/24 and is a non-conforming use.
3. City-owned property located at 949 Hensley Lane, currently housed by Public Works, Parks and Animal Control.
The property is approximately 80 acres in size.
In summary, the request to create a Business Government District would allow for current municipal facilities to be
brought into conformity with Article 5 Land Use Charts and to establish a zoning category for future municipal
facilities.
In considering the parking requirements, the BG District shall utilize shared parking when buildings are developed
as complexes. Providing parking through shared municipal lots placed behind pedestrian-oriented mixed-use streets,
takes advantage of the fact that different land use types (i.e., municipal offices, recreational and entertainment)need
parking at different times of the day, so the demand at any given time is less than the aggregation of demand of the
individual uses.Utilizing such requirements eliminates large dead spaces that are not aesthetically pleasing and make
it difficult for visitors to walk to building entrances. Typically,parking would be calculated on a cumulative basis for
each proposed use. The BG District would allow for more relaxed parking requirements that adhere to pedestrian-
friendly,more open space areas.
The BG District shall comply with the provisions of Wylie's Comprehensive Zoning Ordinance No. 2001-48, as
amended and conform to Article 4 Nonresidential Design Standards.
Notification/Responses: Ninety-two (92) notifications were mailed, with one written response returned favoring the
request and one written response opposing the request within the 200-foot notification buffer at the time of posting.

managed, or operated,in whole or in part by a governmental agency.
b. Permitted Districts: See Land use Charts in Section 5.1.
c. Required Parking: Shared parking calculated at thirty percent(30%) of peak
demand period based on use. Buildings must be designed as complexes with parking
placed behind pedestrian-oriented walkways. The total number shall be detennined
during a site plan review process that considers:
Library=One space for every 200 square feet of floor area.
Office=One space for every 300 square feet of floor area.
Recreational Center=The following general standards when applicable:
i. One space for every 100 square feet of floor area for structures
ii. Three spaces for every game court;
iii. One space for every three seats in any assembly area;
iv. Seventy spaces for every playing field used for league play.
4. College or University
a. Definition:A college or university is an academic institution of higher learning
beyond the level of secondary school.

was located within the City limits as of May 13,2006. For property annexed
into the City after May 13, 2006, a restaurant that sells alcohol must obtain a

(3) A restaurant that sells alcohol shall not be located closer than 300 feet to a
public or private school measured in a direct line from property line to
property line, and in direct lines across intersections.
(4) The distance between a restaurant that sells alcohol and a private school can
be increased to 1,000 feet if the City Council receives a request from the
governing body of the private school to do so.
(5) Restaurants that derive more than 75% of their revenue from the sale of
alcohol are only permitted by specific use permit and may only be located in
the zoning districts where the applicable type of restaurant is designated as
"P*" on the Land Use Chart, Section 5.1, Subsection F, paragraph 20 or 21
of this Article 5.
(6) BG District: Restaurant Use must be incorporated into the Civic Center

Discussion
In an effort to provide for kiosk type signs within City rights-of-way,staff is proposing changes to the now in effect Sign
Ordinance No. 2003-14,as a means of providing directions to new subdivisions and/or municipal buildings or events.
The program is a tool to eliminate clutter of bandit type signs in the public rights-of-way and have a more uniform design
throughout the city.
Background
In 2002, at the direction of Council the sign regulations were removed from the zoning ordinance and administered
through Building Inspections Department. Modifications were again adopted in 2003 to eliminate the use of pole signs
throughout the city. The current ordinance prohibits signs within the public right-of-way unless a permit was received for
the sign prior to July 1,2001. The ordinance further states that any permit issued under the current ordinance shall expire
on December 31, of the year it was issued, except that all permits issued after December 31, 2003 shall expire on July 1,
2004,and shall not be renewed.
Consideration
With Wylie being the eighth fastest growing city in the nation, and new subdivisions continually being developed, staff is
seeking approval to revise the Sign Ordinance to allow for kiosk type signs to be placed in the public right-of-way in an
effort to guide potential homebuyers to new subdivisions.
Adopting the proposed revisions to the Sign Ordinance would provide a means for builders to advertise and maintain a
24/7 coverage. The kiosk program would consist of signs that contain individual panels that are used to promote
residential development that provides direction to subdivisions, public facilities, information centers, and/or community
events and is located in City rights-of-way.

The program would also generate a revenue stream for the city in that the builders lease space from a qualified person or
company (The Contractor) approved by Council through the issuance of a Service Contract. The Service Contract would
grant the company the right to design, erect and maintain directional kiosk signs within the city. The Contractor shall
provide, at no cost to the city, municipal directional kiosk sign panels, which will comprise up to 10% of all sign panels
permitted, for uses of public purpose directional signage to municipal sites, and or events as designated by the city. All
kiosk signs, individual panels and locations must be approved by Council prior to installation. All unauthorized, illegally
placed and non-permitted signs placed in city rights-of-way may be removed by the city upon discovery and destroyed
immediately.
The attached draft indicates the proposed changes for Ordinance 2003-14. Sections 11 & 12 are where the primary
revisions take place. A definition has been added to Section 2 to clearly state what is defined as a kiosk sign. Section 12:
Signs Prohibited in the City Right-Of-Way has been deleted in its entirety with the exception of:
No sign may be erected within a right-of-way unless a permit has been obtained and the proper
permit fee paid in accordance with Section 11 of this Ordinance, effective 06/24/2008. No sign shall
be placed on private property or in the right-of-way adjacent to developed private property without
the private property owner's written consent.
In Summary, the proposed revisions and the kiosk sign program will provide a uniform, coordinated method of providing
homebuilders and developers a means of utilizing directional signs, while minimizing the negative impacts to the City of
Wylie and its residents.

Sign area means the actual area of a face of the sign, unless the sign is not of a regular
(square, rectangle, triangle, and circle) shape. In the case of an irregularly-shaped sign,
the entire area within a single continuous perimeter forming the most applicable single
regular shape enclosing the extreme limits of each sign shall be the "gross surface
area." In the event two or more signs share a single structure, each sign or panel may
be considered separately for square footage purposes, except that the combined
footage of such signs cannot exceed the total square footage allowed for the sign.
Sign, Attached means any sign attached to, applied on, or supported by, any part of a
building (such as a wall, roof, window, canopy, awning, arcade, or marquee) which
encloses or covers usable space. Neon tubing attached directly to a wall surface shall
be considered a "wall sign" when forming a border for the subject matter, or when
directing attention to the subject matter or when forming letters, logos, or pictorial
designs.
Sign, Awning means a sign attached to an Awning.
Sign, Canopy means a sign attached to a Canopy.
Sign, Changeable Message means a sign whose face is designed and constructed in
a manner capable of changing messages through a system of removable characters or
panels attached to the face of the sign or changed by electronic means.
Sign, Development means a temporary on-site sign providing identification or
information pertaining to a residential or commercial development and may include the
builder, property owner, architect, contractor, engineer, landscape architect, decorator,
or mortgagee, within that development, but shall not include a subdivision marketing
sign.
Sign, Directional means any on-site sign to direct the public to entrances, exits and
services located on the property on which the sign is located.
Sign, Directory means any sign listing occupants within shopping centers, industrial
sites, retail districts, office districts and commercial sites. Directory sign also means a
permanent on-site sign identifying the buildings in the development or providing
information on their location.
Sign, Garage sale means any on-site Promotional Sign for the sale of personal
household goods in a residential zoning district or on the property of a nonprofit
organization.
Sign, Home Improvement means any on-site sign that displays the name of a roofing,
fence, pool painting, landscape or other home improvement contractor.
Sign, Inflatable means any hollow sign expanded or enlarged by the use of air or gas.

Sign, Institutional means a permanent on-site sign used to identify governmental and
municipal agencies, public schools, churches, or similar public institutions, and used to
communicate messages of public importance to the general public.
Sign, Kiosk means a ladder-style sign with multiple panels that is installed within the
public right-of-way, complies with Section 9(E), and either provides direction to Wylie
residential subdivisions and/or municipal facilities or provides the public with information
about upcoming city-sponsored events. To aid in the identification and location of
residential subdivisions, a Kiosk Sign may include the name of a developer or
homebuilder when providing directions to that developer's or homebuilder's residential
subdivision.
Sign, Menu Board means an on-site sign that displays a menu and pricing for food
services and may include an audible speaker and microphone integral to the sign.
Sign, Model Home means any sign identifying a new home, either furnished or
unfurnished, as being a builder's or contractor's model open to the public for inspection.
Sign, Movement Control means a sign providing direction or traffic flow information for
persons or vehicles located the same premises as the sign. Movement Control Signs
shall not advertise or otherwise draw attention to the premises, an individual, business,
commodity, service, activity or product.
Sign, Municipally-Owned means any sign that identifies a park, entrance to the City,
place of interest within the City, any City sponsored event or any municipally-owned
facility and is erected by or at the direction of a City official. A municipally-owned sign
does not include traffic or street identification signs.
Sign, Monument means any detached sign made from masonry, concrete materials,
wood or plastic provided that a masonry or metal base is incorporated into the sign, with
no separation between the base of the sign and grade.
Sign, Nonconforming means a sign and its supporting structure which does not
conform to all or part of the provisions of this Ordinance, and:
1. Was in existence and lawfully erected prior to the effective date of this
Ordinance;
2. Was in existence and lawfully located and used in accordance with the
provisions of the prior ordinance applicable thereto, or which was
considered legally nonconforming there under, and has since been in
continuous or regular use; or
3. Was in existence, located, and used on the premises at the time it was
annexed into Wylie and has since been in regular and continuous use.
Sign, Obsolete means any sign that no longer serves a bona fide use or purpose.

Sign, Off-Premise means a sign displaying advertising copy that pertains to a
business, person, organization, activity, event, place, service or product not principally
located or primarily manufactured or sold on the lot on which the sign is located.
Sign, Pole means any sign erected on a vertical framework consisting of one or more
uprights supported by the ground and where there is a physical separation between the
base of the sign and the ground.
Sign, Vehicular means any sign on a vehicle parked temporarily, incidental to its
principal use for transportation. This definition shall not include signs being transported
to a site for permanent erection.
Sign, Zoning means any sign provided by the City of Wylie Planning and Zoning
Department to publicize the request for zoning or rezoning of a property.
Sign Setback means the horizontal distance between a sign and the front or side
property line, as measured from that part of the sign, including its extremities and
supports, nearest to any point on any imaginary vertical plane projecting vertically from
the front or side property line.
Wall means any exterior surface of a structure that has a slope of 60 degrees or more.
Zoning District, Non-Residential means any zoning district designated by the Zoning
Ordinance of the City of Wylie as NS, CR, BP, CC, I, PD, FP, DTH.
Zoning District, Residential means any zoning district designated by the Zoning
Ordinance of the City of Wylie as AG/28, SF-1A/26, SF-30/24, SF-20/21, SF-10/19, SF-
8.5/17, TH/15, MF, and MH.

any governmental agency or other entity which has or could have acquired
the property through the exercise of its power of eminent domain. Such
relocated sign shall be placed, insofar as possible, as to comply with all
the provisions of this Ordinance.
F. Inspection
The City may inspect annually, or at such other times as it deems
necessary, each sign regulated by this Ordinance for the purpose of
ascertaining whether the same complies with provisions of this Ordinance,
is secure or insecure, whether it still serves a useful purpose, and whether
it is in need of removal or repair.
G. Removal of Obsolete Signs
Any sign which the City determines no longer serves a bona fide use or
does not conform to this Ordinance shall be removed by the owner, agent
or person having the beneficial use of the land, buildings or structure upon
which the sign is located within ten (10) days after written notification to do
so from the City.
H. Removal or Repair of Dilapidated or Deteriorated Signs
If the City shall determine that any sign exists in a dilapidated or
deteriorated condition, or is a menace to the public, he shall give written
notice to the person or persons responsible for the sign. The permit
holder, owner, agent or person having the beneficial use of the premises
shall remove or repair the sign within ten (10) days after the notice. The
City may remove or have removed, without notice, and assess the owner
for the costs, any sign which is an immediate peril to persons or property.
I. Removal of Illegally Erected Signs
Any temporary sign that is erected, constructed or otherwise displayed,
which the City determines to be in violation of this Ordinance, may be
removed by City personnel. Any such sign removed by City personnel
may be held for a period of seventy-two (72) hours and upon expiration of
the time may be disposed. The City is not required to notify the permit
holder or owner of the sign that it has been picked up or that disposal of
the sign is imminent.
For permanent signs, the sign must be removed by the permit holder,
owner of the sign, or owner of the property on which the sign is located
within ten (10) days after the City sends written notice to remove the sign.

with this Ordinance, the City is authorized to cause the removal of the sign
and assess the permit holder, owner of the sign and/or owner of the

E. Wind Pressure and Dead Load Requirements
All signs shall be designed and constructed to withstand a wind pressure
of not less than 30 pounds per square foot of area, and shall be
constructed to receive dead loads as required by the building code and
regulations of the City of Wylie.
F. Obstructing Doors, Windows, or Fire Escapes
It shall be unlawful to erect, relocate, or maintain a sign in any manner that
prevents free ingress to or egress from any door, window or fire escape,
or to attach any sign to a standpipe or fire escape.
G. Placement of Advertising Matter
1. No person shall place on or suspend from any building, light fixture,
pole, structure, sidewalk, parkway, driveway or parking area, any
goods, wares, merchandise or other advertising object or structure for
the purpose of advertising such items other than a sign, as defined,
regulated and prescribed by this Ordinance, except as otherwise
allowed by this Ordinance or another ordinance.
2. No person, firm, corporation or association of persons shall paste,
stick, tack, nail or otherwise place any advertisement, handbill, placard,
printed, pictured or written matter or thing for political advertising or
other advertising purposes upon any fence, railing, sidewalk or public
telephone, electric or other utility pole, or any other public property,
including trees thereon or to knowingly cause or to permit the same to
be done for his benefit.
3. It shall be unlawful for any person to scatter or throw any handbills,
circulars, cards, tear sheets or any other advertising device of any
description, along or upon any street or sidewalk in the City of Wylie.
H. Signs Prohibited On or Over Public Property
Except as otherwise provided for in this ordinance, nNo portion of any sign
shall be erected on or over public property, or in the right-of-way of any
thoroughfare within the City_ , or with the permission of the City of public
purposes, except for Projecting Signs in the Downtown Historic District

considered illegal signs and may be removed and disposed of by the City
in accordance with this Ordinance.
I. Illumination of Signs

1. No sign shall be illuminated to such intensity or in such a manner as to
cause a glare or brightness to a degree that it constitutes a hazard or
nuisance.
2. Moving, flashing, changing color, beacons, revolving or similarly
constructed signs shall not be allowed, except for electronic signs
showing time and temperature.
3. Sign illumination may only alternate on and off at a rate equal to or less
than twice an hour, excluding time and temperature signs.

2. Institutional Signs may include a reader board, subject to the following
limitations:
a. Reader board must be integral to the permitted sign for the site;
b. Messages on the reader board, whether electronic or manual, may
not scroll, flash, or change more frequently than once a day;
c. Manual reader boards using movable lettering must have a
lockable covering;
d. The reader board display cannot exceed two-thirds of the gross
sign area per sign face, excluding a Monument Sign border.
e. Internal illumination may be utilized for the reader board sign panel.
E. Kiosk Signs
Kiosk Signs must meet the following regulations:
1. Procedures for Installing a Kiosk Sign
a. Kiosk signs may only be installed pursuant to an executed
concession contract approved by City Council. This concession
contract shall grant a person or company (the "Concessionaire") the
right to design, erect, and maintain Kiosk Signs within Wylie and
administer the Kiosk program as set forth by that concession contract.
b. Once a concession contract is approved by City Council, the
Concessionaire shall submit a map, elevations, and any other
documentation deemed necessary by city staff, showing the
location and design of the proposed Kiosk Signs to the Director of
Planning, Building Official, and the Director of Public Works. Upon
review of the map, elevations, and any other applicable
documentation, the Director of Planning, Building Official, and
Director of Public Works shall make a recommendation to City Council
as to whether the location and design of the proposed Kiosk Signs
should be approved, denied, or modified.
c. City Council may approve, deny, or approve with modifications the
location and design of the proposed Kiosk Signs as shown on the
map, elevations, and other applicable documentation. Modifications
include, but are not limited to, modifications to the color of, or materials

used in, the sign panels. No party may erect a Kiosk Sign without City
Council approval of the location and design of the kiosks.
d. The Concessionaire must comply with all permitting requirements
set forth in this Ordinance.
2. Location of Kiosk Signs. Although the City Council has the authority to
determine where Kiosk Signs may be located, locations must at least
meet the following criteria:
a. The location of Kiosk Signs must not create traffic hazards. The
obstruction of the visibility of motorists, pedestrians, or traffic
control signs will constitute a type of traffic hazard. Wylie's Engineering
Division shall review the location of each proposed Kiosk Sign. A Kiosk
Sign shall not be installed if Wylie's Engineering Division determines
that the location of the proposed sign would create a traffic hazard.
b. The location of Kiosk Signs must not interfere with the general use
of and handicap accessibility of sidewalks, walkways, bike, and hiking
trails.
c. The location of Kiosk Signs must not interfere with any public
utilities or be located in a utility easement.
d. Kiosk Signs must not be located within a sight visibility triangle.
e. Kiosk Signs must not be placed adjacent to a lot with a residential
use without the prior written consent of the owner(s) of that lot as
shown on the most current tax roles. Proof of prior written consent
must be attached to the Concessionaire's permit application. If a
residential use is placed on a lot adiacent to a pre-existing Kiosk Sign,
no written consent is necessary for that Kiosk Sign to remain.
f. A Kiosk Sign must be located at least one-hundred (100) feet from
all other Kiosk Signs.
g, Kiosk Signs must not be located within a median.
h. Kiosk Signs must be located at least five (5) feet from the edge of
curb or pavement line, which includes improved surfaces and
shoulders.
3. Design of Kiosk Signs. Although City Council has the authority to
determine which designs are appropriate, designs must at least meet
the following criteria:
a. At least one sign panel on each Kiosk Sign must provide directions
to a municipal facility or provide information about an upcoming city-
sponsored event.
b. Kiosk Signs may not exceed twelve (12) feet in height and four (4)
feet in width.
c. Kiosk Signs must include breakaway design features as required by
the Texas Department of Transportation's Sign Mounting Details for
Roadside Signs. Break-away fittings must be installed below grade

or concealed from public view in another manner approved by City
Council through the Building Inspections Department.
d. The font and color of the Kiosk Signs must be uniform throughout
the entire sign.
e. Kiosk signs shall not be illuminated.
f. There must be an identification panel at the top of each Kiosk Sign
that displays only the name and official logo of the city.
g No signs, pennants, flags, streamers, balloons or other devices or
appurtenances used for visual attention may be attached to Kiosk
Signs.
4. Variances to Kiosk Sign Regulations. No person or party may obtain a
variance to the Kiosk Sign procedures or regulations set forth in this
Ordinance.
