10-24-2002 (Construction Code) Minutes MINUTES CONSTRUCTION CODE BOARD WYLIE MUNICIPAL COMPLEX 2000 Highway 78 North, Wylie, Texas 75098 Regular Business Meeting October 24, 2002 7:00 p.m. A quorum was present and notice was posted in the time and manner required by law. Board Members Present: William Jowers Jess Calhoun Frankie Delgado - Acting Chair Steve Repasky Frank Spingola Staff Members Present: Dale Jackson - Building Official Board Members Absent: Mike Phillips - Chair Wayne Morman - Vice-Chair CITIZEN PARTICIPATION No participation. CALL TO ORDER The meeting was called to order at 7:20 and the Board elected Frankie Delgado as acting chair. 1. Approval of the minutes of the July 18, 2002 meeting William Jowers made a motion to approve the minutes of the July 18, 2002 meeting as written and Jess Calhoun seconded the motion. The motion was approved by a vote of 5-0. 2. Approval of the minutes of the August 7, 2002 meeting Jess Calhoun made a motion to approve the minutes of the August 7, 2002 meeting as written and William Jowers seconded the motion. The motion was approved with a vote of 5-0. 3. Discuss, consider and act upon a variance requested by Scott Silvis of Fox & Jacobs Homes regarding the construction of a fence within the front yard of a lot. Section 22-394 of the Code of Ordinances of the City of Wylie prohibits the erection of a fence within the front yard of residential property. Mr. Silvis wishes to erect a temporary fence in the front yard of the model homes constructed by Fox & Jacob s Homes for the Birmingham Farms subdivision and the Cimarron Estates subdivision. The property in question is 1106, 1108 and 1110 .v64,416Ann Street and is further described as Lots, 14, 15 and 16 of Block P Birmingham Farms Phase 2A and 2806, 2808 and 2810 Deerborn Street and further described as Lots 3, 4, and 5 of Block H Cimarron Estates Scott Silvis of Fox & Jacobs presented the variance request to the Board. He stated that the request was only temporary in nature. As soon as the subdivision was completed, the model homes would be sold and the fences would be removed from the front yards. After some discussion, William Jowers made a motion to approve the variance for a period not to exceed 3 years or when the model homes were sold and converted to single-family dwellings - whichever came first. Jess Calhoun seconded the motion and the motion was approved with a vote of 5-0. 4. Discuss, Consider and act upon a variance requested by Tabor Maxwell of Ryland Homes regarding the construction of a fence within the front yard of a lot. Section 22-394 of the Code of Ordinances of the City of Wylie prohibits the erection of a fence within the front yard of residential property. Ms. Maxwell wishes to erect a termpo0rary fence in the front yard of the model homes .00 constructed by Ryland Homes for the meadows of Birmingham Farms subdivision. The property in question is 408, 410 and 412 Oxford and is further described as Lots, 6, 7 and 8 of Block G Meadows of Birmingham Tabor Maxwell of Ryland homes states that her variance was exactly the same as the variance requested by Fox & Jacobs. After some discussion among the Board members, Jess Calhoun made a motion to approve the variance for a period not to exceed 3 years or when the model homes were sold and converted to single- family dwellings -whichever came first. William Jowers seconded the motion and the motion was approved with a vote of 5-0. 5. Discuss, consider and act upon a variance requested by David Landry of Centex Homes regarding the construction of a fence within the fron yard of a lot. Section 22-394 of the Code of Ordinances of the City of Wylie prohibits the erection of a fence within the front yard of residential property. Mr. Landry wishes to erect a temporary fence in the front yard of the model homes constructed by Centex Homes for the Birmingham Farms subdivision. The property in question is 1411, 1413 and 1415 Millbrook Lane and is further described as Lots 2, 3 and 4 of Block E of Birmingham Farms Phase 3A David Landry of Centex Homes stated that the variance he was requesting was exactly the same as the variances requested by Fox & Jacobs and Ryland Homes. After some discussion among the Board members, Jess Calhoun made a motion to approve the variance for a period not to exceed 3 „ , years or when the model homes were sold and converted to single- family dwellings -whichever came first. Discuss, consider and act upon a variance requested by Ken French of Buescher Homes regarding the construction of a fence within the front yard of a lot. Section 22-394 of the Code of Ordinances of the City of Wylie prohibits the erection of a fence within the front yard of residential property. Mr. French wishes to erect a temporary fence in the front yard of the model homes constructed by Buescher Homes for the Cascades subdivision. The property in question is 1902 Crystal Court and is further described as lot 4 block D Cascades Phase I Ken French of Buescher Homes stated that the variance he was requesting was exactly the same as the variances requested by Fox & Jacobs, Ryland and Centex Homes. After some discussion among the Board members, Steve Repasky made a motion to approve the variance for a period not to exceed 3 years or when the model homes were sold and converted to single- family dwellings -whichever came first. Frank Spingola seconded the motion and the motion was approved with a vote of 5-0. 7. Discuss consider and act upon a recommendation to the City Council to enter into an agreement with the North Central Texas Council of Governments (NCTCOG) to establish NCTCOG as the electrical licensing agency for the City of Wylie Building Official Dale Jackson stated that electricians were currently required to obtain a license in each city they worked in. Attempts to institute a state licensing law have failed in the past. Local building officials saw the problem with the current system and saw the need in a more centralized licensing agency. The centralized licensing agency would issue electrical licenses for all electricians in the North Central Texas Region. The centralized licensing approach would standardize licensing requirements and make it much easier for electricians to work within the region. After some discussion among the Board members, Jess Calhoun made a motion of recommend to City Council that the City of Wylie establish the North Central Texas council of Governments as the electrical licensing agency for the City of Wylie. Stever Repasky seconded the motion and the motion was approved with a vote of 5- 0. 8. Discuss and consider other possible ordinances to be considered at a future meeting No items were discussed.
