Those present besides Chairman Larson were, Vice-Chair Scott Ames, Commissioner Phillip Johnston, Commissioner Tim Bennett, Commissioner Ramona Kopchenko, and Commissioner Ruthie Wright. Consider a recommendation to the City Council regarding a Preliminary Plat for Southbrook Phase III, creating twenty-seven (27)residential lots on 7.0 acres, generally located east of S. Ballard, south of Martin Drive and south of the Twin Lakes Subdivision Phase I. Ms. 011ie stated that the applicant is requesting the Preliminary Plat for Southbrook Phase III to be tabled to July 15, 2008. Chairman Larson questioned the number of times the item has been tabled and expressed concern over the inability to proceed. Ms. 011ie stated that this is the third request from the applicant, who is unable to obtain a development agreement. A motion was made by Vice-Chair Ames, and seconded by Commissioner Wright, to table the Preliminary Plat for Southbrook Phase III to July 15, 2008, with the provision that the Preliminary Plat for Southbrook Phase III will not be tabled again. Motion carried 6 —0, with Commissioner Osborne being absent. 2. Consider a recommendation to the City Council regarding a Replat for American National Bank Addition#2, Block A, Lot 1. Subject property being generally located on the northwest corner of FM 544 and Westgate Way. Mr. Haskins stated that the applicant is proposing to replat of Block A Lot 1. The replat will create two lots, Lot IA and Lot 1B. The property was originally platted in April 2005 for two commercial lots. An existing bank kiosk drive through ATM facility is located on Lot 2, and in late 2007, an Arby's restaurant was developed on currently Lot 1. The replat will separate the lot developed as Arby's facility, and will allow additional development or the sale of the vacant property to the north of the property. A motion was made by Vice-Chair Ames, and seconded by Commissioner Johnston, to recommend approval to the City Council regarding a Replat for American National Bank Addition #2, Block A, Lot 1. The subject property being generally located on the northwest corner of FM 544 and Westgate Way. Motion carried 6 — 0, with Commissioner Osborne being absent. Recommendation Motion to recommend denial to the City Council regarding a Preliminary Plat for Southbrook Phase III, creating twenty-seven(27)residential lots on 7.0 acres, generally located east of S. Ballard, south of Martin Drive and south of the Twin Lakes Subdivision Phase I. Discussion This item was tabled at the request of the applicant at the Planning and Zoning meeting held on April 15, 2008, May 20, 2008 and again on June 17th in order to work on the contents of a Development Agreement. The subject tract is located in the un-incorporated portion of Collin County outside of the city limits of Wylie. The Twin Lakes Subdivision located to the north and zoned SF-10-24 lies within Wylie city limits. Southbrook Phases I &II are within the city limits and are located to the east and south of the subject tract and zoned PD 2002-08. Properties to the west are owned and occupied by Eastfork Utility District. Southbrook Phase I & Phase II (PD-2002-08) are developed as single-family dwelling units providing a minimum lot size of 8,000 square feet with a minimum lot width of 65 feet. Lots abutting the subject property to the south were built with an average dwelling size of 2,121 square feet. The Twin Lakes Subdivision is developed as single-family residential dwellings and was platted in 1988 under the 1985 Zoning Ordinance providing for a minimum lot size of 8,000 square feet on 8 lots and minimum 10,000 square feet on 86 lots and with a minimum lot width of 60 feet. Lots abutting the subject property to the north were built with an average dwelling size of 2,179 square. Feet. The Preliminary Plat proposes 27 lots on 7 acres for a density of 3.8 lots per acre with a minimum lot size of 8,176 square feet. The current Comprehensive Land Use Plan designates this property as Low Density Residential requiring a one acre minimum lot size with a minimum dwelling size of 3,000 square feet. The plat as submitted does not conform to the Comprehensive Land Use Plan nor does it conform to the minimum requirements for residential properties located in the County as required by Collin County Court Order No. 2001-297-05-14. In addition, the current zoning ordinance requires a front yard setback of twenty-five (25) feet and a side yard of ten (10) feet, with a side yard corner lot of 25 feet. The Preliminary Plat proposes a side yard corner lot of fifteen (15) feet. It has been recommended by the Building Inspections Department to maintain at least a 25 foot side yard setback on all corner lots. This is a safety precaution as to ensure that any vehicle parking in a driveway does not extend onto a sidewalk. Page 1 of 1 9 Page 2 of 2 Although this could be considered as infill development and allowed to vary somewhat from the current zoning regulations staff recommends that it adhere to the surrounding developed area. Because the property is not annexed into the city, zoning is unknown at this time.As adopted in December 2006 with Ordinance No. 2006-73,no application for zoning can be accepted for filing unless annexation of the property for which the zoning is sought has been completed. The applicant is seeking a Development Agreement as means to accomplish zoning. The Agreement was submitted for review on July 10th. Staff as well as the city attorney is currently reviewing the document.As the Development Agreement could affect the plat, staff is recommending denial of the Preliminary Plat. The Plat as submitted does not conform to the standards of the City's Subdivision Regulations and does not meet the applicable technical requirements of the City of Wylie or Collin County. Discussion The subject properties are currently part of one larger tract totaling 1.38 acres. The applicant is proposing to develop two single story retail buildings on two lots for restaurant uses. The property is zoned Commercial Corridor (CC) District and the proposed restaurant use is allowed by right. A preliminary plat dividing the lot into two separate lots is on the current agenda for consideration. There is a building currently on the lot that does not meet current design standards for the City of Wylie and will be demolished prior to construction of the two new buildings of 2,763 and 2,239 square feet. The southern most drive on Commerce Drive does not meet current Design Standards as required by the City Engineer. However, while the applicant cannot be forced to close or modify this access point by the City because it is an existing drive, the applicant has voluntarily agreed to mark it as an exit only thereby more closely meeting the intent of the design standards. The original plat was approved in 1984 and consisted of 153 residential lots and two commercial lots as part of the overall development of the Pointe North Addition Phase I. A Replat of lot 58 was approved in order to separate the commercial tract from the residential subdivision in 1988. Again, in 2000 a Replat to divide lot 58 into two separate lots was approved as the lst Revision of Block E, Lot 58R to accommodate the construction for a day care on lot 58R-1. The 2nd revision of the plat simply shifted the center lot line one foot to the east. This 3rd Revision creates a lot feasible for the development of a commercial site for a medical office use. Recommendation Motion to recommend approval of Option No. to the City Council, amending regulations to Zoning Ordinance No. 2001-48, Article 6, Section 6.3 as it relates to district boundaries and design standards. Discussion The purpose of these revisions is to clarify the boundaries of the DTH and to establish clear and concise guidelines for new and renovated structures. As time and technology change so must our ordinance as it relates to design and function. However, it is also important to identify those areas that we desire to preserve and maintain as close as possible to reflect the rich history of Wylie. Background The Downtown Historic District(DTH)was created in November 2001 with the adoption of the city-wide revisions to the Zoning Ordinance and Map. The DTH District allows for a broad mixture of compatible uses and provides special development and design standards that preserve the historic and architectural character of the area. The residential design standards allows for residential structures to be placed/constructed adjacent to other such structures within blocks with existing residential character designs. The exterior design should be of similar character of surrounding historic style structures regardless of the internal use and design. Common design features of existing historical residential structures range in variety from as early as the Colonial Style (1600-1820) to the Arts and Crafts Movement from the 1870-1920 periods. Most of the existing structures feature low pitched gabled roof with wide unenclosed eave overhangs with exposed roof rafters and/or decorative beams or braces underneath the gables. The features are typical styles of the Arts and Crafts Movement as well as the Bungalow style homes. The district also consists of Victorian style homes built in the late 1800's. It is because of these type features that it is important that we preserve this history throughout our DTH district and replicate it in new or renovated structures. In addition to the overall style of the dwelling, most residential structures include foundation piers and crawl spaces that are usually covered by wood skirts and/or plantings and have windows Page 1 of 3 27 Page 2 of 3 with multiple lights. Again, these features are typical of this historic period. Consideration Several options are being presented under this revision. Boundary Option #1: Extend boundary west along railroad right-of-way and continue south to the rear of lot 1 Cornerstone Private School at Industrial Court as notified. Boundary Option #2: Extend the boundary west along railroad right-of-way to just south of Elliot Street and then east to the rear of Block 3, Lot 1R to the east side of Jackson and south to SH 78. This would remove Lot 1, Block A (Inwood Bank) and Lot R1, Block 3. Being that Inwood fronts SH 78 this would be a good transition point from Commercial Corridor District to the DTH. Extend the eastern boundary to include lots along the east side of 2nd Street and south to Marble,but excluding First Baptist Church Worship Center and parking lots. This option would require re-notification. Boundary Option #3: Extend the boundary west along railroad right-of-way to just south of Elliot Street and then east to the rear of Block 3, Lot 1R to the east side of Jackson and south to SH 78. The proposed amendment offers Sherwin Williams Preservation, or Valspar's Historic Color Palette or an equal color palette as the colors of choice for the primary facade, various architectural elements, or details within the Historic District. The current ordinance names Valspar Southern Heritage Group or an equal as the palette of choice. Valspar Southern Heritage Group was a color palette offered through Lowes a few years ago, but has been discontinued. In order to get the colors, we would have to contact the local store to get the formulas from the manufacturer directly. In an effort to provide customer efficiency we are offering a color palette that is readily available and one that has a wider spectrum of colors that could be easily matched through any paint supplier. The National Trust for Historic Preservation has worked extensively with Valspar to develop an exclusive collection of historic colors documented from historic sites across the country. The resulting palette, sold exclusively at Lowe's, features over 250 historic colors. Staff is also requesting that sign regulations specific to the DTH be adopted. Signage for the DTH falls under the current guidelines of the Sign Ordinance as applied throughout the city. Because the intent of the DTH is to preserve the historic and architectural character certain elements of the Zoning Ordinance and other city ordinances must be amended to reflect such desire. By creating such elements that are specific to the DTH sets the area apart and makes it unique from other districts within the city. Pole type signs in the DTH are appropriate designs for residential structures regardless of their use. Summary Regardless of the option selected, the design standards would remain as presented in this request. Exterior materials proposed by this amendment specify materials based on the historic period of the structure. Very rarely were stone or masonry materials used for residential type structures. Masonry products whether brick or stone were commonly used on commercial structures. Again the intent of the design elements of the ordinance is not to regulate the use of the structure, but rather the design of the structure. 28 2 Page 3 of 3 Text Amendments are only required to be notified 15 days prior to the public hearing in the official newspaper of the City. This requirement has been met. Because the notification included increasing the boundary which would result in a zoning change those properties were notified in accordance with State Law. Staff received several phones calls requesting clarification of the proposed amendments, but no written responses were received at the time of this posting. This item to be considered by City Council at its August 12, 2008 meeting. Purpose Wylie's downtown has been identified by the Comprehensive Plan as a valuable resource worthy of preservation as a historic district.This district provides development and design standards that preserve the historic and architectural character of existing development,provides for adaptive reuse of existing buildings,and the compatibility of new structures and uses with the historic nature of downtown. B. District Boundaries 1. The Downtown Historic District(DTH)is generally bounded by State Highway 78 on the south, Brown Street on the north,the St.Louis Southwestern Railroad right-of-way pn the west,and the I Deleted:to the mid block property line rear property of lots facing the east side of Ballard to the east.These boundaries are shown on the of lots facing the west side of Jackson map in Figure 6-1 for informational purposes. 2. The precise boundaries of the Downtown Historic District shall be shown on the official zoning map of the City of Wylie.The boundaries of the Downtown Historic District may be amended from time to time based on a request from area property owners,a request of the staff,the Commission,or at the pleasure of the Council.In considering a request for a change in district boundaries,the Council shall require: a. Any additions to the district shall be contiguous to the existing boundaries of the district; b. Any reductions in the district shall be located on the edge of the district such that a hole is not left inside the district;and c. If requested by a property owner,a petition shall be presented showing owners of more than 50 percent of the land within the district,excluding streets,and owners of more than 50 percent of the building sites in the district are in support of the requested change in boundaries. General Provisions 1. Site plan and design review is required for new construction and substantial renovation of existing buildings within the Downtown Historic District.Substantial renovation means: a. Alterations to the exterior of existing buildings that change the placement or design of windows,doors or other exterior features of the building such as coping or pilasters; b. An increase in the floor area of the building greater than 10 percent. 2. Interior renovation of existing buildings that do not alter the exterior appearance of the building do not require site plan and design review under the provisions of this article.(e.g.,a drop ceiling that covers part of an existing window would alter the exterior appearance and require review) 3. Physical properties of an existing building such as setbacks,foot prints,height,or other similar characteristics that cannot be altered without substantial hardship are not required to meet the development or design standards within this article.All other provisions shall apply. Parking Placement for Residential and Nonresidential Uses (1) Parking for single family residential use shall be on site and conform to standards for residential uses in other single family districts. (2) Parking for nonresidential uses in commercial structures must be provided off-site from the main use or behind the use with access from the alley if at plp�p1Cple. (3) Parking for nonresidential uses in residential structures shall be behind and/or to the side of the main structure,provided no parking spaces are closer to the front of the main building than the mid-point of the side facade. Street Facade—Commercial Structures (1) Primary street facades for nonresidential buildings in the Downtown Historic District shall have the following basic features of existing historic buildings: (a) Cornice at top of facade; (b) Display windows with transom windows above and lower window panels below. (c) Pilasters that divide the facade vertically and separate the display windows units into discrete visual elements. (d) Second floor windows,recessed with multiple lights,lintels,and sills.
