Ordinance 2006-09 ORDINANCE NO. 2006-09 AN ORDINANCE OF THE CITY OF WYLIE, TEXAS ESTABLISHING A FOUR-WAY STOP SIGN AT THE INTER-SECTION OF P ARKBL VD. AND BLOCKTON WAY, WYLIE, COLLIN COUNTY, TEXAS; PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR REPEALING, SAVINGS AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF. WHEREAS, Section 544.003 of the Texas Transportation Code provides that a local authority may designate, place and maintain a traffic-control device on a highway under the authority's jurisdiction in conformance with the Texas Transportation Commission's Manual on Uniform Traffic Control Devices; and WHEREAS, the City Council of the City of Wylie, Texas ("City Council") has investigated and determined that it would be advantageous and beneficial to the citizens of the City of Wylie, Texas ("Wylie") to establish a four-way stop sign at the intersection of Park Blvd. and Blockton Way, Wylie, Collin County, Texas, which is under the jurisdiction of Wylie, in accordance with the Texas Transportation Commission's Manual on Uniform Traffic Control Devices as described below. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION I: Findings Incorporated. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: Establishing a Four- W av Stop Sign. Based upon an engineering and traffic investigation heretofore made, and the Texas Transportation Commission's Manual on Uniform Traffic Control Devices, a four-way stop sign is to be erected at the intersection of Park Blvd. and Blockton Way, Wylie, Collin County, Texas to control traffic at the intersection. SECTION 3: Placement of Signs. The City Manager, or hislher designated representative, is hereby authorized and directed to cause the placement of stop signs at the intersection of Park Blvd. and Blockton Way, Wylie, Collin County, Texas. The signs shall conform to the Texas Transportation Commission's Manual on Uniform Traffic Control Devices and be located as near as practicable to the nearest line ofthe crosswalk, or in the absence of a crosswalk, at the nearest line of each roadway. SECTION 4: Violation. It shall be unlawful to operate a vehicle on Park Blvd. or Blockton Way, Wylie, Collin County, Texas, without bringing the vehicle to a full and complete stop at the intersection ofBlockton Way and Park Blvd., Wylie, Collin County, Texas, before proceeding into the intersection. All vehicles shall remain stopped until the intersection is free and clear of all oncoming vehicles which might constitute a hazard to life or property under the condition then and Ordinance No. 2006-09 4- W ay Stop Sign - Park BlvdIBlockton Way 442491-1 Page 1 there existing. SECTION 5: Savings/Repealing Clause. All provisions of any ordinance in conflict with this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining portions of said ordinances shall remain in full force and effect. SECTION 6: Severability. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions ofthis Ordinance shall remain in full force and effect. Wylie hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof irrespective of the fact that anyone or more sections, subsections, sentences, clauses and phrases be declared unconstitutional or invalid. SECTION 7: Penalty Provision. Any person violating this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined a sum of not less than One Dollar ($1.00) nor more than Five Hundred Dollars ($500.00). Wylie retains all legal rights and remedies available to it pursuant to local, state and federal law. SECTION 8: Effective Date.
