Ordinance 2017-05ORDINANCE NO. 2017-05 AN ORDINANCE OF '1'H.E CITY OF WYLIE, TEXAS, AMENDING ORDINANCE NO. 2016-20, WHICH ESTABLISHED THE BUDGET FOR FISCAL YEAR 2016-2017; PROVIDING FOR REPEALING, SAVINGS AND SEVERABILITY CLAUSES; AND PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the City Council of the City of Wylie, Texas ("City Council") desires to amend Ordinance No. 2016-20 (2016-2017 Budget) of the City of Wylie, Texas ("Wylie") for the purpose of distributing funds that were previously budgeted for merit increases to the proper departments and accounts; and WHEREAS, the City Council originally budgeted Two Hundred Ninety -Four Thousand and 00/100s Dollars ($294,000.00) for merit increases; and WHEREAS, based upon the results of the performance evaluations, the actual estimated cost of the merit increases, including benefits, is Two Hundred Thirty -Nine Thousand Four Hundred Eighteen and 21/100s Dollars ($239,418.21), as shown in Exhibit 2; WHEREAS, funds in the amount of Three Hundred Thirty -Five Thousand Two Hundred Ninety -One and 55/100s Dollars ($335,291.55) which were previously received, for costs related to damage repairs incurred in the 1st Quarter of FY 2016-17 (October 1, 2016 — December 31, 2016) resulting from the April 11, 2016 hail storm, will be allocated, as shown in Exhibit 3; WHEREAS, based on the approval of Ordinance No. 2016-29 which removed the provisions requiring the assessment of credit card fees on payments made by citizens will result in a reduction of budgeted revenues in the amount of Forty -Six Thousand and 00/100s Dollars ($46,000) and an increased allocation of funds in the amount of One Hundred Three Thousand and 00/100s Dollars ($103,000), as shown in Exhibit 4; WHEREAS, the City Council has investigated and determined that it will be beneficial and advantageous to the citizens of Wylie to amend Ordinance No. 2016-20 (2016-2017 Budget) as set forth above. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: Ordinance 2017-05 Amending 2016-2017 Budget (Ordinance No. 2016-20) Page 1 of 2 SECTION I: The proposed amendments to the FY2016-2017 Budget of the City of Wylie, as heretofore adopted by Ordinance No. 2016-20, are, completely adopted and approved as amendments to the said FY2016-2017 Budget. SECTION II: All portions of the existing FY2016-2017 Budget and Ordinance No. 2016-20, except as specifically herein amended, shall remain in full force and effect, and not be otherwise affected by the adoption of the amendatory ordinance. SECTION III: Should any paragraph, sentence, sub -division, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part or parts as declared to be invalid, illegal, or unconstitutional. SECTION IV: This ordinance shall be in full force and effect from and after its adoption by the City Council and publication of its caption as the law and the City Charter provide in such cases. SECTION V: That all other ordinances and code provisions in conflict herewith are hereby repealed to the extent of any such conflict or inconsistency and all other provisions of the Wylie City Code not in conflict herewith shall remain in full force and effect. SECTION VI: The repeal of any ordinance, or parts thereof, by the enactment of the Ordinance, shall not be construed as abandoning any action now pending under or by virtue of such ordinance; nor shall it have the effect of discontinuing, abating, modifying or altering any penalty accruing or to accrue, nor as affecting any rights of the municipality under any section or provision of any ordinances at the time of passage of this ordinance.
