Hold a Public Hearing and consider, and act upon, a change in zoning from Multifamily District (MF) to a Planned Development (PD 2017-XX-TH) to allow for a Town House development of 4 units on 0.281 acres located on 202 N Fifth Street, southeast of the intersection of State Highway 78 and N 5th Street (ZC 2016-15) (R. 011ie, Development Services Director) Executive Summary The property totals 0.281 acres and will create 4 townhome residential lots.The applicant has requested that the item be withdrawn from consideration. 2. Hold the 2°a Public Hearing for the annexation of approximately 3,100 linear feet of Sachse Road from Muddy Creek to the Dallas/Collin County line. 2017-01A (R. 011ie, Development Services Director) Executive Summary This annexation is at the request of Dallas County and defined as Orphan Roads. Orphan Roads are all or part of a street or road right-of-way, which is outside the incorporated limits of a municipality (or municipalities) and the incorporated area of the municipality (or municipalities) abuts or extends into the right-of-way. 3. Consider, and act upon, Resolution No. 2017-04(R) establishing a public newspaper of general circulation to be the "Official Newspaper" for the City of Wylie. (C. Ehrlich, City Secretary) Executive Summary Texas Local Government Code, §52.004 states that at the beginning of each fiscal year,municipalities must designate an official newspaper. This must be done as soon as practicable. The municipality shall contract with the newspaper designated by ordinance or resolution. 4. Consider, and act upon, acceptance of the Comprehensive Annual Financial Report (CAFR)for FY 2015-2016 after a presentation by the audit firm of Weaver L.L.P. (L. Bantz, Finance Director) Executive Summary The City Charter in Article VII,Municipal Finance, Section 13: Independent Audit requires that at the end of the fiscal year an independent audit be made of all accounts of the City by a certified public accountant. In compliance with the City Charter, our outside auditor, Weaver has performed an audit as of September 30,2016. This is the third year for the audit to be performed by Weaver after their selection to continue as the City's independent auditors following an RFP process done during 2014. Prior to that Weaver had served as the City's auditors for six years. Mr. John DeBurro, Partner-Assurance Services, with Weaver will briefly present the CAFR, including the Independent Auditors' Report and answer any questions that the City Council may have regarding the report. Consider, and act upon, a request to provide alternative roofing options to the current cedar shingle roof located at 301 N Ballard Avenue, for City of Wylie Brown House. (R. 011ie, Development Services Director) Staff Comments Assistant City Manager Chris Hoisted addressed Council stating staff had emailed Council a list of properties with the Grand Manor shingle and that Council had done research on some other options and he was there to discuss those options. Mayor Hogue stated he had reached out to Hoisted regarding metal roofs but that there was some concerns regarding the turret. He also stated that he was interested in fake cedar shingles due to the historic nature of the house and while he did look at the Grand Manor shingles, he would like to look at other options. Councilwoman Culver stated she also looked at the Grand Manor and the shingle looked no different than any other shingle on a home; it has no aesthetic value for one of the homes that has the most significant historical value to the City. She stated she would like to explore a more viable option for the Brown House. Councilman Dahl also looked at the Grand Manor shingles and sent Hoisted some information on a fire retardant cedar shingle. He stated he would like to see a cost for the fire retardant shingle, what the ongoing maintenance on it is, and what the fire code requirements on it are. He stated we have a historic building, could we make a specific variance for a specific type of code to this particular area. Councilman Forrester felt that the Grand Manor had no depth or three dimensional feel to it. He mentioned a company called Euroshake that does a hand split rubber roof covering that does not rot or crack and comes in multiple colors. He felt it was worth looking at. He mentioned that we did need to pay attention to cost as well as wanting to remain as historically viable as possible. Mayor pro tem Stephens looked at the Grand Manor shingles and felt that they did lack dimension and were flat. He stated he would like to find something that looks a little closer in appearance to cedar. Councilman Dahl asked what the requirements were for that house since the house has a historical designation. Councilwoman Arrington stated she did not feel cedar shingles were viable but was not impressed with the homes she saw with the Grand Manor so she is interested in seeing some other options. Council Action A motion was made by Councilman Forrester, seconded by Mayor pro tem Stephens to table the request to provide alternative roofing options to the current cedar shingle roof located at 301 N Ballard Avenue, for City of Wylie Brown House until such time staff has viable options to present to council. A vote was taken and the motion passed 7-0. Public Hearing 2. Hold the 1st Public Hearing for the annexation of approximately 3,100 linear feet of Sachse Road from Muddy Creek to the Dallas/Collin County line. 2017-01A (R. 011ie, Development Services Director) Staff Comments Development Services Director Renae 011ie stated that the item is a request from Dallas County to annex a portion of Sachse Road (an orphan road) for the City to take over the road which would mean the City Minutes January 10, 2017 Wylie City Council Page 3 would take over the maintenance. 011ie stated per Dallas County they will install 3 inch asphalt overlay as well as additional maintenance and that the work was currently underway. Mayor Eric Hogue asked City Engineer Porter if the plan is to make the roadway 4 to 6 lanes from Ballard to Collin County line. Porter replied that is the plan. Mayor Hogue asked if we are the ones that would be responsible to expand that portion of the road if we take over maintenance. City Manager Manson stated that if we want Dallas County to participate in the future with widening, then it needs to be annexed. The Mayor asked if that agreement was going to be in writing to protect the City in the future when we are ready to expand it. Manson stated that we can definitely ask for that. Councilman Forrester asked if the current construction will help the longevity of the road. Porter stated that they did feel that the current work would lengthen the life span of the road. Councilwoman Culver felt that we needed to get Dallas County's promise to assist later down the road in writing and asked if there was an expected time frame on the expansion. Porter responded that in 2014 Dallas County approved and put money aside for the project. Manson stated that orphan roads have been an issue and the state legislature has changed the annexation laws so that cities can no longer annex up to the road, but have to annex the road. Mayor pro tem Stephens stated he had mixed emotions. He feels like it should look good because it is the first impression entrance into the City; however, he feels like the current work will not hold up for years with the amount of traffic on that particular roadway so he feels we are taking on a huge financial responsibility. Councilman Forrester asked if there are additional costs associated if the road is annexed. Manson stated that it would be just the maintenance of the roadway and the public safety response of police and fire. Public Hearing Mayor Hogue opened the public hearing at 6:50 p.m. asking anyone present wishing to address Council to come forward. No one was present to address Council during the public hearing. Recommendation Motion to approve Ordinance No. 2017-05 amending Ordinance No. 2016-20, which established the budget for fiscal year 2016-2017; providing for repealing, savings and severability clauses; and providing an effective date of this ordinance. Discussion Following the adoption of the Compensation Study in FY 2013-14, Council directed staff to develop a performance based evaluation and pay plan for non-public safety personnel. That plan is now in place and an average salary increase of 3% was included in the FY 2016-17 Budget. Individual performance evaluations have been done and the allocation of the funds budgeted for salary increases to the proper departments and accounts is now being brought back for Council consideration in the form of an ordinance amending the 2016- 2017 Budget Ordinance. Exhibit 2 As part of this budget amendment, staff is also recommending allocating funds which were previously received, in the amount of $335,291.55, to cover the costs of ongoing repairs related to last April's hail storm. This amount represents costs incurred over the first quarter of FY 2016-17 (October 1, 2016 —December 31, 2016). Exhibit 3 On November 14, 2016, Ordinance No. 2016-29 was approved updating the City's comprehensive fee schedule. This ordinance removed provisions requiring the assessment of a fee for the processing of a payment by credit or debit card and the assessment of a fee for the acceptance of such payment online. Staff proposed that credit card fees be paid as an operating cost as part of the City's budget. Staff is now recommending a reduction in budgeted revenues, as well as, allocating additional funds related to these changes. Exhibit 4 Page 1 of 1 ORDINANCE NO. 2017-05 AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING ORDINANCE NO. 2016-20, WHICH ESTABLISHED THE BUDGET FOR FISCAL YEAR 2016-2017; PROVIDING FOR REPEALING, SAVINGS AND SEVERABILITY CLAUSES; AND PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the City Council of the City of Wylie, Texas ("City Council") desires to amend Ordinance No. 2016-20 (2016-2017 Budget) of the City of Wylie, Texas ("Wylie") for the purpose of distributing funds that were previously budgeted for merit increases to the proper departments and accounts; and WHEREAS, the City Council originally budgeted Two Hundred Ninety-Four Thousand and 00/100s Dollars ($294,000.00)for merit increases; and WHEREAS, based upon the results of the performance evaluations, the actual estimated cost of the merit increases, including benefits, is Two Hundred Thirty-Nine Thousand Four Hundred Eighteen and 21/100s Dollars ($239,418.21), as shown in Exhibit 2; WHEREAS, funds in the amount of Three Hundred Thirty-Five Thousand Two Hundred Ninety-One and 55/100s Dollars ($335,291.55) which were previously received, for costs related to damage repairs incurred in the 1st Quarter of FY 2016-17 (October 1, 2016 — December 31, 2016)resulting from the April 11, 2016 hail storm, will be allocated, as shown in Exhibit 3; WHEREAS, based on the approval of Ordinance No. 2016-29 which removed the provisions requiring the assessment of credit card fees on payments made by citizens will result in a reduction of budgeted revenues in the amount of Forty-Six Thousand and 00/100s Dollars ($46,000) and an increased allocation of funds in the amount of One Hundred Three Thousand and 00/100s Dollars ($103,000), as shown in Exhibit 4; WHEREAS, the City Council has investigated and determined that it will be beneficial and advantageous to the citizens of Wylie to amend Ordinance No. 2016-20 (2016-2017 Budget) as set forth above. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: Ordinance 2017-05 Amending 2016-2017 Budget(Ordinance No.2016-20) Page 1 of 2 SECTION I: The proposed amendments to the FY2016-2017 Budget of the City of Wylie, as heretofore adopted by Ordinance No. 2016-20, are, completely adopted and approved as amendments to the said FY2016-2017 Budget. SECTION II: All portions of the existing FY2016-2017 Budget and Ordinance No. 2016-20, except as specifically herein amended, shall remain in full force and effect, and not be otherwise affected by the adoption of the amendatory ordinance. SECTION III: Should any paragraph, sentence, sub-division, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part or parts as declared to be invalid, illegal, or unconstitutional. SECTION IV: This ordinance shall be in full force and effect from and after its adoption by the City Council and publication of its caption as the law and the City Charter provide in such cases. SECTION V: That all other ordinances and code provisions in conflict herewith are hereby repealed to the extent of any such conflict or inconsistency and all other provisions of the Wylie City Code not in conflict herewith shall remain in full force and effect. SECTION VI: The repeal of any ordinance, or parts thereof, by the enactment of the Ordinance, shall not be construed as abandoning any action now pending under or by virtue of such ordinance; nor shall it have the effect of discontinuing, abating, modifying or altering any penalty accruing or to accrue, nor as affecting any rights of the municipality under any section or provision of any ordinances at the time of passage of this ordinance. The purpose of this policy is to establish procedures for the acceptance of donations to the City of Wylie and specific City departments. A uniform set of procedures shall be followed in acceptance of all solicited or unsolicited donations and proper approval shall be obtained prior to acceptance. All cash, equipment, in-kind services, materials and sponsorships donated to the City of Wylie or City departments shall be accounted for in accordance with the procedures set forth in this policy. (2) Official Acceptance. In order for donations of funds, equipment or in-kind services to be accepted, a formal review as outlined within this policy must be conducted. If it is determined that the donation is not in the best interest of the citizens of the Wylie, the donation shall be refused. (3) Review prior to Acceptance. The City Manager or his/her designee shall review all donations for appropriateness and best use, Acceptance or refusal of donations shall be as determined by the City Manager. (4) Approval. Donations with a value up to and including $5,000 may be approved by the City Manager. Donations with a value that exceeds $5,000 must be approved by the City Council. (5) Specific Use Donations of Funds. All donated funds which are given for a specific use shall be recorded in such a manner as to easily identify the intended use. Donations shall be receipted by the Finance Department, and a budget notation shall be prepared for all donations in excess of $5,000 specifying the intended revenue and expenditure account(s) to be increased. -- (6) Memorials. Donations in Honor of Individuals. Donations which are contingent upon recognition of an individual by plaque, sign, or other insignia on City property shall be accepted only after approval of the City Council. The exception being those donations which fall under the Ordinance No.2005-57 Donation Policy criteria of the Park Memorial Dedication Policy approved by the City Council on June 24, 2003 (attached). (7) Donations of Equipment. Donations of equipment will be considered based on program outcomes, department goals and needs. Each donation will be evaluated for usefulness and costs of potential replacement/rental rates will be considered. If there is any question as to the legal owner of the donated item,proof of ownership may be requested. (8) Non-Specific Use Donations. Donors who wish to give a gift which is not specific to a given department may give a gift to the City in general. The City Manager will determine if such gifts should go to a specific department or to a general City donation fund. Once determined, the donated money will be expended either for general purposes, or as a one-time supplement to a departmental operating budget. (9) Solicitations for Community Events. In-kind contributions and sponsorships for specific events will be treated in the same way as donated funds. (10) Solicitations for City of Wylie Programs. Programs which will involve solicitations for program specific donations and/or in-kind donations (i.e. Reach For a Star) must receive prior approval from the City Manager and may, after approval, establish separate program criteria. If determined necessary by the City Manager, additional review of the proposed program may be required to evaluate potential risk and liability. (11) Acknowledgement and Receipt. A donation receipt form will be completed when donations are received, with the form completed by City staff. The donor shall retain a copy, the director shall be sent a copy and a copy will be sent to Finance. The Park Superintendent, or designee, shall have the responsibility for administering the City of Wylie Parks and Recreation Department Memorial Dedication Policy. 2. Under the guidance of the Park Superintendent, Wylie citizens may request the installation of memorial items including but not limited to: trees, landscaping, granite markers,benches, tables, pavilions,playground equipment, and other park-related items. 3. All requests for the installation of memorial items must be accompanied with a complete written description of the item, such as the item dimensions, material of construction, caliper size, mounting requirements, the desired location, the desired time for installation, etc. The Park Superintendent reserves the authority to limit the number, size, type, brand, variety, species, color, location, and date of installation of all memorial items. 4. Prior to installation, all costs associated with the purchase, acquisition, shipping, transportation, mounting, placement, and/or installation of the item shall be paid by the individual requesting the installation of the memorial item. 5. No memorial items shall be installed without the approval of the Park Superintendent. 6. Memorials shall be installed by the Park and Recreation Department employees and/or a Parks and Recreation Department designated contractor only. 7. The Park and Recreation Department assumes no responsibility for any damage, breakage, or vandalism occurring to the item either before, during, or after installation, nor does the Department guarantee the item's maintenance, upkeep, life span,or duration of usefulness. Discussion This annexation is at the request of Dallas County and defined as Orphan Roads. Orphan Roads are all or part of a street or road right-of-way, which is outside the incorporated limits of a municipality (or municipalities) and the incorporated area of the municipality(or municipalities) abuts or extends into the right-of-way. FIRE SERVICES 1.Fire protection by the present personnel and the present equipment of the Fire Department, within the limitations of available water and distances from existing fire stations, and in a manner consistent with any of the methods of the City, extends fire service to any other area of the municipality, will be provided to this area within sixty (60) days of the effective date of the annexation ordinance. 2.As development and construction commence in this area, sufficient fire and emergency ambulance equipment will be provided to furnish this area EXHIBIT “B” the maximum level of fire services consistent with the characteristics of topography, land utilization and population density within the area as determined by the City Council within four and one-half (4-1/2) years from the effective date of the annexation ordinance, or upon commencement of development within the area, whichever occurs later. 3.Upon ultimate development of the area, the same level of fire and emergency ambulance services will be provided to this area as are furnished throughout the City. C.ENVIRONMENTAL HEALTH AND CODE ENFORCEMENT SERVICES 1.Enforcement of the City's environmental health ordinances and regulations, including but not limited to, weed and brush ordinances, junkedand abandoned vehicle ordinances and animal control ordinances, shall be provided within this area sixty (60) days of the effective date of the annexation ordinance. These ordinances and regulations will be enforced through the use of existing personnel. 2.Complaints of ordinance or regulation violations within this area will be answered and investigated within sixty (60) days of the effective date of the annexation ordinance. 3.Inspection services, including the review of building plans, the issuance of permits and the inspection of all buildings, plumbing, mechanical and electrical work to ensure compliance with City codes and ordinances will be provided within sixty (60) days of the effective date of the annexation ordinance. Existing personnel will be used to provide these services. 4,The City's zoning, subdivision, sign and other ordinances shall be enforced in this area beginning within sixty (60) days of the effective date of the annexation ordinance. 5.All inspection services furnished by the City, but not mentioned above, will be provided to this area beginning within sixty (60) days of the effective date of the annexed ordinance. 6.As development and construction commence in this area, sufficient personnel will be provided to furnish this area the same level of Environmental Health and Code Enforcement Services as are furnished throughout the City. D.PLANNING AND ZONING SERVICES The planning and zoning jurisdiction of the City will extend to this area within sixty (60) days of the effective date of the annexation ordinance. City planning will thereafter encompass this property, and it shall be entitled to consideration for zoning in accordance with the City’s Comprehensive Zoning Ordinance and Comprehensive Plan. EXHIBIT “B” E.PARK AND RECREATIONSERVICES 1.Residents of this property may utilize all existing park and recreational services, facilities and sites throughout the City, beginning within sixty (60) days of the effective date of the annexation ordinance. 2.Additional facilities and sites to serve this property and its residents will be acquired, developed and maintained at locations and times provided by applicable plans for providing parks and recreation services to the City. 3.Existing parks, playgrounds, swimming pools and other recreational facilities within this property shall, upon dedication to and acceptance by the City, be maintained and operated by the City of Wylie, but not otherwise. F.SOLID WASTE COLLECTION 1.Solid waste collection shall be provided to the property inaccordance with existing City policies, beginning within sixty (60) days of the effective date of the annexation ordinance. Residents of this property utilizing private collection services at the time of annexation shall continue to do so until it becomes feasible because of increased density of population to serve the property municipally. Commercial refuse collection services will be provided to any business located in the annexed area at the same price as presently provided for any business customer within the City, upon request. 2.As development and construction commence in this property and population density increases to the property level, solid waste collection shall be provided to this property in accordance with the current policies of the Cityas to frequency, changes and so forth. 3.Solid waste collection shall begin within sixty (60) days of the effective date of the annexation ordinance. G.STREETS 1.The City’s existing policies with regard to street maintenance, applicable throughout the entire City, shall apply to this property beginning within sixty (60) days of the effective date of the annexation ordinance. Unless a street within this property has been constructed or is improved to the City’s standards and specifications, that street will not be maintained by the City. 2.As development, improvement or construction of streets to City standards commences within this property, the policies of the City with regard to participationin the costs thereof, acceptance upon completion and maintenance after completion, shall apply. EXHIBIT “B” 3.The same level of maintenance shall be provided to streets within this property which have been accepted by the City as is provided to City streets throughout the City. 4.Street lighting installed on streets improved to City standards shall be maintained in accordance with current City policies. H.WATER SERVICES 1.Connection to existing City water mains for water service for domestic, commercial and industrial use within this property will be provided in accordance with existing City policies. Upon connection to existing mains, water will be provided at rates established by City ordinances for such service throughout the City. 2.As development and construction commence in this property, water mains of the City will be extended in accordance with provisions of the Subdivision Regulations and other applicable ordinances and regulations. City participation in the costs of these extensions shall be in accordance with the applicable City ordinances and regulations. Such extensions will be commenced within two (2) years from the effective date of the annexation ordinance and substantially completed with four and one-half (4 1/2) years after that date. 3.Water mains installed or improved to City standards which arewithin the annexed area and are within dedicated easements shall be maintained by the City of Wylie beginning within sixty (60) days of the effective date of the annexation ordinance. 4.Private water lines within this property shall be maintained by their owners in accordance with existing policies applicable throughout the City. I.SANITARY SEWER SERVICES 1.Connections to existing City sanitary sewer mains for sanitary sewage service in this area will be provided in accordance with existing City policies. Upon connection, sanitary sewage service will be provided at rates established by City ordinances for such service throughout the City. 2.Sanitary sewage mains and/or lift stations installed or improved to City standards, located in dedicated easements, and which are within the annexed area and are connected to City mains will be maintained by the City of Wylie beginning within sixty (60) days of the effective date of the annexation ordinance. 3.As development and construction commence in this area, sanitary sewer mains of the City will be extended in accordance with provisions of the Subdivision Regulations and other applicable City ordinances and regulations. J.MISCELLANEOUS 1.Any facility or building located within the annexed area and utilized by the City in providing services to the area will be maintained by the City commencing upon the date of use or within sixty (60) days of the effective date of the annexation ordinance, whichever occurs later. 2.General municipal administrative services of the City shall be available to the annexed area beginning within sixty (60) days of the effective date of the annexation ordinance. 3.Notwithstanding, anything set forth above, this Service Plan does not require all municipal services be provided as set forth above if different characteristics of topography, land use and population density are considered a sufficient basis for providing different levels of service. 4.The Service Plan is valid for ten (10) years from the effective date of this Ordinance. RECEIVED VIA EMAIL COMMUNICATION FROM HAMID BAHA ON 01/23/17. Dallas County Public Works has received a request from Wylie for answers to the following questions in order to provide clarifications to their City Council which is considering the annexation of Sachse Road (please provide limits and date); 1) Wylie: What is the durability of the 3" asphalt overlay section? Mayor Pro -Tem Stephens mentioned that he had seen other asphalt overlays that have not stood up to the test of time, even short-term. What is the life expectancy of the 3" section you all are providing? Also, will the County fix any immediate issues resulting from the construction? Dallas County response: Life expectancy of Dallas County roads with asphalt overlay is 10 years. 2) Wylie: The Council would like more information regarding the future expansion of this roadway. I don't believe I have a current copy of the County's MCIP. Has the Commissioners Court selected the Sachse Road expansion project as a part of the upcoming 5 year program? Dallas County response: Sachse Road (from State Highway 78 to Dallas County Line) was approved in the Dallas County MCIP 5th Call for Projects in January 2010 (Project # 22806). The County has completed the preliminary design for Sachse road from Highway 78 to Dallas County line under the MCIP project (#22804). Additional funds were allocated to this project in MCIP 6th Call. The limits for initial phase to be constructed were determined to be from State Highway 78 to Miles road based on availability of City funding match Road design and construction documents for this project are completed and construction scheduled for early 2018. Replacing the Sachse Road Bridge over Muddy Creek (including the bridge approaches) and reconstruction of Sachse road to County line is a separate project was selected (MCIP #28202) in the MCIP 6th in 2014. Both cities agreed to collaborate on providing the 50% funding required for MCIP participation. Wylie: In relation to item 2, the City Council would like written confirmation from the County that the annexation of this roadway would not have any effect on priority level or anticipated funding level by the County related to design or construction of the future roadway expansion project. Is this something you all can provide? Dallas County response: County at present has completed preliminary design for Sachse road from Highway 78 to Dallas County line in anticipation of future annexation of Sachse road from Muddy Creek County line.
