State Highway 78, Wylie, Texas 75098 (the "Subject ' opert WHEREAS, WICDL has paid ad valorem tgroperty taxes to Art Collin (county Tax Assessor/Collector on the Subject Property each oxO1 every ye.g- ince it a iu._:moo'''ee title; WHEREAS, through no act or o uia:on of W1[tt L, the C•1 'n ounty Appraisal District failed to identify the City of W., 'e .axing Lelative A.6 he Subject Property and as a result, for tax years 2009, 21,,[( 2011, ??0, and 25 fly t.,.:rs were not billed for or paid to the City of Wylie by WICDL rela',ive to the ga1i'ect Pro: r y; WHEREAS, WICD w, bsequen `1v, ©ii-he error by the Collin County Appraisal District and subs=que-* woks iter a ing taxes on behalf of the City of Wylie; WHERE pon rec t;;ving the 1h: 1 from the Collin County Tax Assessor/Collector for the outstandi-g due ;n, - Ci o ie, WICDL contacted the City of Wylie and sought relief from the i ljplo `"tion of pa. and interest which accrued against the Subject Property; \` HEREAS, 1qDL :'X11 rot make a tender of payment to the Collin County Tax As ess•,.'sllector beca.)o: it bWeved that it was waiting for a formal response and/or action to be take i.:?j the City o ylie; NOW .:14 RE, BE IT RESOLVED THAT: 1. The C'.z' of Wylie does hereby authorize and approve for the wavier of interest and penalty which have accrued on the Subject Property pursuant to Section 33.011(a) (1) of the Texas Property Tax Code. Accordingly, WICDL shall make tender and payment to the Collin County Tax Assessor/Collector of the sum of $ which amount constitutes the base tax (and attorney's fees/no attorney's fees) and said amount shall be paid within 21 days of the entry of Resolution. In the event that said amount is not tendered and paid within the 21 days following the entry of this Resolution, the action taken by the City of Wylie Resolution No.2017-09(R) Waiver of penalties and interest pursuant to section 33.011 of the Texas Property Tax Code - 1 - shall be declared null and void, and WICDL shall pay the full amount of taxes, penalties, interest and fees which are due and owing on the Subject Property. 2. The above and foregoing recitals be, and are hereby, found to be true and correct and incorporated into the body of this Resolution as if copied in their entirety; 3. The City of Wylie acting through its governing body does hereby authorize its City Manager or designated person to take all actions necessary to advise the Collin County Tax Assessor/Collector of this Resolution and the City of Wylie's intentions pursuant thereto.
