REGULAR AGENDA Public Hearing Agenda Minutes November 15,2016 Wylie Planning and Zoning Board Page 1 of 3 Page 5 of 50 Public Hearing 1 —Amend PD 2015-11-SF (ZC 2016-16) Hold a Public Hearing and consider a recommendation to the City Council amending Planned Development 2015-11-Single Family District (PD2015-11-SF) to allow a minimum lot size of 7,200 sf on Lots 2-9 Block B, Lots 13-16 & 19-22 Block C, Lots 2-6 & 9-13 Block D, and Lots 2-8 Block F on approximately 38 acres, generally located at the northeast corner of W. Alanis Drive and South Ballard Avenue. ZC2016-16. Staff Presentation Mr. Molina stated that the applicant is requesting to amend the current Planned Development Ordinance 2015-11 to allow for the re-configuration of the 7,200 square foot minimum lots. Within the PD the 7,200 square foot lots backed up to Westwinds Meadows Addition. Due to an existing Gas Easement running east and west along the northern property line, the lots were re-configured. Upon submittal of Final Plat, staff noticed a different configuration than the concept plan approved with the PD. Staff recommends denial due to no direct correlation with having to decrease the 8,500 square foot lots. Sixty-Nine notifications were mailed, with one response returned in favor of the request, and none received in opposition. Board Discussion Mr. Jim Douglas, Douglas Properties, 2309 Avenue K, Suite 100, Plano; applicant for the request, stated that there is approximately 20,650 square foot of open space over the easement. To keep the same number of lots, the layout of the development was changed. Atmos Gas is requiring the lots side the easement instead of backing the lots to the easement. Mr. Douglas stated that curb cuts are already done. He was impression that Final Plat was already approved by City Council. Public Comments Chair Smith opened the Public Hearing. Alexis Tapp, 2250 Sachse Road, spoke in opposition of the request, stating that the applicant should abide by the approved PD. Chair Smith closed the Public Hearing. Board Action A motion was made by Commissioner Owens and seconded by Vice Chair Larson to recommend approval to the City Council amending PD 2015-11-SF, ZC 2016-16. Motion carried 7 —0. The property was annexed into the City in November 2016. Additionally, this request is part of an overall larger request that includes an additional 16 acres to the north (already within city limits) that was rezoned in August 2016 The applicant is requesting straight zoning with lots to be a minimum of 10,000 sq ft and single family homes of 2,400 sq ft minimum. As currently planned there would be a total of 65 lots (from all three tracts) on approximately 22 acres. If approved, construction plans for each residential dwelling will be submitted to Building Inspections for approval and must meet the design standards in accordance with Article 3, Section 3.4 before the issuance of a permit. If the development is approved, impact fees will be paid by the applicant and a Final Plat submitted for approval which shall dedicate the necessary rights-of-way to the City, including the expansion of Kreymer Lane. Currently, the Capital Improvement Plan has Kreymer Lane as a 10-year project and coordination with Collin County would be required as Kreymer extends into that jurisdiction to the south. ZC 2016-14 Discussion Owner: Cross Development Applicant: Kimley-Horn The applicant is requesting a change in zoning to a Planned Development with Commercial Corridor being the underlying zoning district. The applicant has requested the change of zoning to a planned development as the developer encountered issues with compliance of the zoning ordinance due to the unique location of the lot having 3 street frontages. The proposal includes the development of a grocery store to be called Lidl that measures 35,962 square feet. Variations between the PD and the Zoning Ordinance are the allowance for the building to be setback 10 feet away from Regency Drive, signage being allowed a maximum height of 10 feet and the architectural exterior material requirements having some variation to the requirements of the zoning ordinance as shown in Exhibit "D" of the Planned Development Regulations. The developer was able to get to 16% stone on the Front Facade of the elevations which is 4% short of the 20%requirement. The developer encountered limitations in allocating area for the stone due to the design of the building including a large percentage of curtain wall windows. Staff has reviewed the final elevations and believes that the exterior materials used complies with the intent of the zoning ordinances in regards to achieving visual variety. An additional difference from the zoning ordinance in the Planned Development is the allowance for parking lots that measure 18' by 10' with a 2' overhang. The minimum parking requirements will remain the same and the developer is in compliance by providing 185 parking spaces surpassing the minimum requirement of 120 Page 1 of 2 Page 17 of 50 Page 2 of 2 parking spaces. The developer will also be placing a 4' wide meandering sidewalk along FM 544 and Springwell Parkway and complies with all of the landscaping requirements of the zoning ordinance. The Planned Development is written in a manner that ensures that any variations to the zoning ordinance in the PD can only be allowed to the grocery store's development. Any future development that doesn't match the concept plan shown in the Planned Development will be required to adhere to the underlying Commercial Corridor base zoning. Staff recommends approval of the Planned Development and exhibits as submitted, to achieve the innovative aspects of the development. Notification/Responses: Twenty Seven notifications were mailed to property owners within 200 feet of the proposal and one was returned in favor while none where returned in opposition of the request. Discussion ENGINEER: RLK Engineering, INC OWNER: CSD Woodbridge, LLC The applicant desires to develop a one story restaurant to contain an IHOP on a single lot consisting of 1.046 acres. A Replat for this site is also on the agenda for consideration. The lot is currently zoned within a Planned Development (2003-01) and a restaurant is an allowed use by right within the Planned Developments allowed uses. Exterior material is comprised of brick, stucco and EIFS. The front Facade includes a cementitious fiber material that resembles a cedar finish. The developer has worked with staff on selecting this material to comply with the architectural requirements of the Zoning Ordinance. The restaurant use requires for the site to provide 59 parking spaces. The development complies with the parking requirements of the zoning ordinance by providing 40 on-site parking spaces and 19 off-site shared parking spaces. Variance case #2016-10 allowed for the reduction of on-site parking as the developer was able to provide a reciprocal easement agreement that stated that shared parking was allowed for the lots within the PD. During the review process of the variance case staff was able to confirm that there was excess parking that could be counted towards the sites parking requirement and that the use of the shared parking would not negatively affect the surrounding properties. As presented this item complies with the minimum site, landscaping and exterior materials requirements of the Zoning Ordinance. Staff recommends approval of the site plan on the condition that construction of the building doesn't occur until the Replat is approved by City Council and subject to additions and alterations as required by the City En•ineerin• De s artment. ARTICLE II-EASEMENTS SECTION 2.1 The parties hereby establish, grant and convey in favor of each Parcel a non-exclusive easement for parking and access over the Common Area on the Parcels in such locations designated for parking areas and driveways on the Plot Plan and on such other parking areas, driveways and service areas from time to time established to permit parking of motor vehicles, and for unobstructed pedestrian and vehicular passage on each Parcel by the other Parcel owners and their Permittees, provided that nothing herein shall prevent any Retail Parcel owner or its tenant or licensee from storing bascarts or selling merchandise on the Common Area on its Parcel (subject to the limitation set forth below), and further provided that nothing herein shall prevent the exclusive use of any receiving area situated on a servient Parcel by the owner thereof or its tenant or licensee. The parties hereby establish, grant and convey a non-exclusive easement over the Common Area located on each Parcel in favor of the other Parcels to permit parking by passenger vehicles (excluding all construction, delivery and service vehicles) in designated parking spaces within said Common Area. Each Parcel owner shall use reasonable good faith efforts to insure that its employees and Permittees park only on its respective Parcels. 3 Page 42 of 50 DAL-578 SECTION 2.2 The parties hereby establish a non-exclusive easement over the Common Area (exclusive of any portion of the Common Area identified as future Building Area on the Not Plan) in favor of each Parcel to permit the construction, maintenance, repair, replacement, operation and use of all apparatus necessary to provide utility services to a Parcel, including without limitation telephone, electricity, water, cable, natural gas and storm and sanitary sewers, provided that same are constructed underground and in a manner so as to minimize interference with the use of the affected portion of the Common Area, Upon request by any Parcel owner, each Parcel owner agrees to execute and grant such other non-exclusive easements in a location or locations as shall be mutually acceptable to the foregoing parties and the relevant public utility companies, in favor of the other Parcels or any part thereof, to permit the construction, maintenance, repair, replacement, operation and use of all apparatus necessary to provide utility service to all portions of the Shopping Center. No such utilities shall be installed or maintained that serve any property other than the Shopping Center. Except as otherwise required by • governmental authorities, each Parcel owner shall service, maintain, repair and replace, and pay the cost of any fees or charges in connection therewith for utility lines located on such owner's Parcel if such utility lines service only the improvements on that Parcel. To the extent that any utility lines exclusively servicing any Parcel cross another owner's Parcel, such utility lines shall be serviced, maintained, repaired and replaced by the party served by the utility lines, at such benefited party's sole cost and expense, subject to the other terms of this Agreement. Any utility lines serving more than one Parcel shall be serviced, maintained, repaired and replaced by the Parcel owner owning the largest portion of the properties served by such utility lines. Each Parcel owner served by such a utility line shall reimburse the Parcel owner performing such service, maintenance, repair and replacement for such owner's proportionate share of the reasonable cost thereof. Such proportionate share shall be a fraction, the numerator of which shall be the total acreage of all Parcels owned by such contributing owner that are served by such utility line, and the denominator of which shall be the total acreage of all Parcels served by such utility line. Any disruption or demolition of a servient Parcel by reason of the use of this easement shall be kept to a minimum, and shall not exceed one day in duration, unless such disruption or demolition cannot be reasonably completed within one day, in which event the disruption and demolition shall be completed as soon as reasonably practicable and such area forthwith shall be promptly restored by the dominant Parcel owner, as the case may be, to its original condition at no expense to the servient Parcel owner.
