CALL TO ORDER
Announce the presence of a Quorum.
Vice Chair Linda Jourdan called the meeting to order at 7:17 p.m. and that a
quorum was present. Board Members present were; Board Member Karyn
McGinnis, Board Member William Baumbach, Board Member Willie Osborne.
Board Members absent were; Chair Jeff Ellis, Board Member Layne LeBaron,
and Board Member Marilyn Herrera.
Staff members present were: Planning Director Renae 011ie, Assistant Planner
Jasen Haskins and Administrative Assistant Mary Bradley.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes of the October 22,
2007 Meeting.
A motion was made by Board Member Osborne, and seconded by Board
Member Baumbach, to approve the Minutes from the October 22, 2007 Meeting
as submitted. Motion carried 4 — 0.
Ms. 011ie reviewed the revisions to the report and packet, stating that the purpose
of the revisions was to remind the Board Members the reasons that a variance
may be granted and reasons a variance is not granted. When a variance is
granted there are eight specifications that all must be met. When a variance is
not granted there are six specifications that are to be considered.

PUBLIC HEARINGS
1. Hold a public hearing to consider and act upon a request by
Kenneth Anderson for a Variance to PD 2002-52 requiring a side
yard setback of 11.25 feet. (ZBA 2007-21).
Mr. Haskins stated that the subject property is located at 1613 Crescent Oak,
created with the platting of the Bozman Farm Addition.
The applicant is requesting a variance to the side yard setback from 11.25 feet to
two feet in order to maintain an existing patio cover. The applicant states that a
hardship exists due to the main structure being built at or near the build lines,
thus limiting the size of the patio cover. In addition, the unique topography of the
back yard would potentially require leveling and water drainage work before a
concrete patio could be built.
Public comment forms were mailed to 15 property owners, and one response in
favor of the request was received.
Vice Chair Jourdan opened the Public Hearing.
Mr. Kenneth L. Anderson, 1613 Crescent Oak Street, Wylie, the applicant for the
subject property, stated that the patio cover was constructed by a contractor, and
assumed that the contractor obtained necessary permits from the City.
Board Member Osborne questioned if the Homeowner's Association expressed
concerns of the patio cover. Mr. Anderson stated that no, but had no supporting
documents stating their approval.
Board Member McGinnis requested clarification on the photos included within the
packet. Mr. Haskins stated that all of the photos were submitted by the applicant.
One of the photos shows the unique topography of the back yard which would
potentially require leveling and water drainage work before a concrete patio could
be built.
Board Member Baumbach questioned the status of the text amendment
discussed in previous meetings, and if the subject property would be allowed to
be built, if the City Council approves the Ordinance. Mr. Haskins stated that the
applicant would need to come in for a variance as the patio cover is large and
placed on the side yard.
Mr. Todd Stone, 1607 Crescent Oak Street, Wylie, property owner within the 200
feet of the notification, spoke in favor of the request.

A motion was made by Board Member Baumbach, and seconded by Board
Member Osborne, to Grant the request by Kenneth Anderson for a variance to
PD 2002-52, for a side yard setback from 11.25 to 2 feet, the property generally
located at 16123 Crescent Oak Street, Lot 24 Block G, Bozman Farm Estates,
Phase 1C Addition. Motion failed 2 — 2, request for a variance was DENIED.
2. Hold a public hearing to consider and act upon a request by
Chrissie Ezell for a Variance to Section 3.2.B.3 of the Zoning
Ordinance requiring a rear yard setback of 25 feet. (ZBA 2007-22).
Mr. Haskins stated that the subject property is located at 1722 Harvest Crossing
within the Pheasant Creek Phase 2 Addition.
The applicant is requesting a variance to the set back requirements from 25 feet
to 21 feet in order to maintain an existing patio cover. The Board has approved
several similar requests within the last twelve months. A text amendment to the
Zoning Ordinance for patio covers, if approved by City Council would be allowed
by right without a variance. However, the applicant desired to obtain a variance
and not wait on Council's decision.
The applicant states that a hardship exists due to the main structure being built at
or near the build lines, thus limiting the size of the patio cover.
Public comment forms were mailed to 29 property owners, and one response
was received in favor of the request.
Vice Chair Jourdan opened the Public Hearing.
Mr. Vernon Kizer and Mr. Willard Thomas, representative of Fox and Jacobs
Homes, stated that the patio cover was built without a permit, and upon
requesting a final inspection of the main structure, the City of Wylie Building
Inspections informed the builder that no permit was obtained. The contractor
built 18 or 19 patio covers within the development, and did not obtain a permit for
four of them.
Board Member Osborne questioned the distance between the driveway and the
patio cover. Mr. Thomas stated that there is approximately six feet between the
driveway and fence and then approximately two feet between the fence and the
patio covers.
Chairman Ellis closed the Public Hearing.
A motion was made by Board Member LeBaron, and seconded by Board
Member McGinnis, to grant the variance to Section 2.5.4.3(d) and (f)
development standards of the Zoning Ordinance to reduce the side yard setback
from the required five feet to zero feet and reduce the five feet separation from
other structures to three inches. Motion carried 4 — 1, with Board Member
Herrera in opposition.

Discussion
The subject property is located at 417 Elliot Street.
The applicant requests a variance to the requirement for a side yard setback of 5 feet to 0 feet in order to maintain an
existing accessory building. The requested variance of 5 feet represents a 100% adjustment to the requirements of the
Zoning Ordinance. The setback means that any structure more than 48"in height must be that minimum distance from the
property line. The purpose of the building setback requirement is to preserve and promote open space and increase
neighborhood safety. This Board has approved similar variances within the past 12 months.
The applicant has provided a survey showing the location of the accessory building and a letter to the Board regarding his
variance request. The applicant states that a hardship exists due to the building being in place, with a concrete slab, before
his purchase of the property.
Public comment forms were mailed to 32 property owners within 200 feet of this request, as required by State
Law. Two (2)responses in favor of the request have been received at the time of this posting.
The Board shall not grant a variance to the development code which:
(1) Permits a land use not allowed in the zoning district in which the property is located; or
(2) Is in the public right-of-way or on public property; or
(3) Alters any definition of the development code; or
(4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements
of the development code; or
(5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably
make practicable the formulation of a general regulation to be adopted as an amendment to the development code;
or
(6) Is based exclusively on findings of personal or financial hardship.

In order to grant a variance to the development code the Board shall find that all the following have been satisfied:
(1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition
particular to the affected property;
(2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed
or used in compliance with the provisions of the development code;
(3) That due to such unique physical circumstances or conditions, the strict application of the development code
would create a demonstrated hardship;
(4) That the demonstrable hardship is not self-imposed;
(5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or
neighborhood;
(6) That the variance,if granted will not change the character of the zoning district in which the property is located;
(7) That the variance,if granted is in keeping with the intent of the development code; and
(8) That the variance,if granted will not adversely affect the health, safety or welfare of the citizens of Wylie.

Members of the Board,
I am applying for a Variance or Appeal in response to a building inspection ticket I
received on February 27th due to there being no building permit for the storage shed
located on my property, addressed above. _260
I am presenting the board with copies of a"Land Title Survey"dated Jaftualy- `II-914-996
showing existence and location of the storage shed prior to our purchasing the property in
2000.
The Shed is a well kept wooden structure painted to match the house trim and is not
highly visible from the street owing to the privacy fencing on all the neighboring
properties. The property it is closest to has a tall privacy fence that blocks any view of the
shed from that back yard, and the surrounding properties along the rear alley all have
privacy fencing so I feel it would not be considered an eyesore by any of my neighbors.
I am appealing to the board to allow the existing structure to remain as is.

Variance to Section 2.5.4.3(d) of the Zoning Ordinance requiring a side yard setback of 25 feet on a corner lot.
Discussion
The subject property is located at 207 Edison Lane.
The applicant requests a variance to the requirement for a side yard setback on a corner lot of 25 feet to 5 feet in order
place an accessory building. The requested variance of 20 feet represents an 80% adjustment to the requirements of the
Zoning Ordinance. The setback means that any structure more than 48"in height must be that minimum distance from the
property line. The purpose of the building setback requirement is to preserve and promote open space and increase
neighborhood safety. This Board has approved similar variances within the past 12 months.
The applicant has provided a survey showing the location of the accessory building and a letter to the Board regarding his
variance request. The survey also shows the location of other elements within the yard, such as the pool,which would not
allow for placement in an area that is allowed by the ordinance. The applicant states that a hardship exists due to the
limited space within the yard due to the setback requirements,however this hardship is self imposed.
Public comment forms were mailed to 32 property owners within 200 feet of this request, as required by State
Law. Two responses have been received at the time of this posting, both in favor of the variance.
The Board shall not grant a variance to the development code which:
(1) Permits a land use not allowed in the zoning district in which the property is located; or
(2) Is in the public right-of-way or on public property; or
(3) Alters any definition of the development code; or
(4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements
of the development code; or
(5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably
make practicable the formulation of a general regulation to be adopted as an amendment to the development code;
or
(6) Is based exclusively on findings of personal or financial hardship.

In order to grant a variance to the development code the Board shall find that all the following have been satisfied:
(1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition
particular to the affected property;
(2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed
or used in compliance with the provisions of the development code;
(3) That due to such unique physical circumstances or conditions, the strict application of the development code
would create a demonstrated hardship;
(4) That the demonstrable hardship is not self-imposed;
(5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or
neighborhood;
(6) That the variance,if granted will not change the character of the zoning district in which the property is located;
(7) That the variance,if granted is in keeping with the intent of the development code; and
(8) That the variance,if granted will not adversely affect the health, safety or welfare of the citizens of Wylie.

I am requesting a variance to the accessory building requirements at 207 Edison Lane
(Lot 18, Block 3 Meadowview Estates). I would like to place a storage shed in the spot depicted
on the survey plot map. The area is technical in my front yard but to the west side of my house.
This past year I recently installed a patio, pool with deck (which occupies space in both the back
and front yards), retaining wall, new fence, and stone 6'x 6' grill pad. These improvements
created no space to place the shed in the backyard.
The shed will be a Taff Shed purchase through Home Depot. It is the TR-800 with
dimensions of 10'x 12'x 10' 2". There will a 2'—3' space which the fence and the shed. It will
be built behind a 6' fence which sits on top on an approximately 3'tall retaining wall which runs
the length of the fence. I will be painting the shed with a color that is coordinated with the
outside colors of the house. Below is a picture of what the shed will look like but without the
windows.
