ORDINANCE NO. 2005-75
AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING
ORDINANCE NO. 2005-64; ADOPTING AMENDMENTS TO THE 2003
EDITION OF THE INTERNATIONAL RESIDENTIAL CODE
REGARDING FIRE SPRINKLER SYSTEMS IN TOWNHOMES;
PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS
ORDINANCE; PROVIDING FOR REPEALING, SAVINGS AND
SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE
DATE OF THIS ORDINANCE AND PROVIDING FOR THE
PUBLICATION OF THE CAPTION HEREOF.
WHEREAS, the City Council of the City of Wylie, Texas ("City Council") has
investigated and determined that it would be advantageous and beneficial to the citizens of the
City of Wylie, Texas ("Wylie") to amend Wylie Ordinance No. 2005-64; and
WHEREAS, the City Council has investigated and determined that it would be
advantageous and beneficial to the citizens of Wylie and in the health, safety and welfare of the
public to adopt an amendment to the 2003 Edition of the International Residential Code
regarding fire sprinkler systems in townhomes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WYLIE, TEXAS:
SECTION 1: Findings Incomorated. The findings set forth above are incorporated into
the body of this Ordinance as if fully set forth herein.
SECTION 2: Amendment to Ordinance No. 2005-64 and the 2003 International
Residential Code. Ordinance No. 2005-64 and the 2003 International Residential Code is hereby
amended to change the definition of "Townhouse" and change R317.2 as follows:
Section R202 Definitions: TOWNHOUSE. A single-family dwelling unit constructed in a
group of two or more attached units in which each unit ex-tends
from foundation to roof and with open space on at least two sides.
Section R31 7.2: Any townhouses over one story in height to be equipped with a fire
sprinkler designed to NFP A 13 D Standard.
SECTION 3: Savings/Reoealing Clause. All provisions of any ordinance in conflict
with this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall
not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal
prevent a prosecution from being commenced for any violation if occurring prior to the repeal of
the ordinance. Any remaining portion of conflicting ordinances shall remain in full force and
effect. A reference in any ordinance to an earlier or different version of a residential code is
hereby amended to refer to the 2003 International Residential Code as it is adopted herein or may
be subsequently amended.

SECTION 4: Penalty Provision. Any person, firm, corporation or entity violating this
Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be
subject to a fine not to exceed the sum of TWO THOUSAND AND NOli 00 DOLLARS
($2,000.00). Each continuing day's violation under this Ordinance shall constitute a separate
offense. The penal provisions imposed under this Ordinance shall not preclude Wylie from
filing suit to enjoin the violation. Wylie retains all legal rights and remedies available to it
pursuant to local, state and federal law .
SECTION 5: Severability. If any section, subsection, sentence, clause or phrase of this
Ordinance is for any reason, held to be unconstitutional or invalid by a court of competent
jurisdiction, such decision shall not affect the validity of the remaining portions of this
Ordinance. Wylie hereby declares that it would have passed this Ordinance, and each section,
subsection, clause or phrase thereof, irrespective of the fact that anyone or more sections,
subsections, sentences, clauses, and phrases be declared unconstitutional.
SECTION 6: Effective Date. This Ordinance shall become effective upon its passage
and publication as required by the City Charter and by law.
