Those present were: Chair Jourdan, Board Member Robert Holcomb, Board Member Kevin Finnell, and Board Member Andre Gonzalez. Staff members present were: Renae' 011ie, Development Services Director, Kevin Molina, Planner and Mary Bradley, Administrative Assistant. CONSENT ITEMS 1. Consider and act upon approval of the Minutes of the November 21, 2016 Meeting. A motion was made by Board Member Finnell and seconded by Board Member Holcomb, to approve the Minutes as submitted. Motion carried 4 - 0. PUBLIC HEARINGS Item 1 —ZBA 2016-13 Hold a public hearing to consider and act upon a request from Rusty Roach for a variance to Section 10.3.(1) of the 1985 Zoning Ordinance for properties requiring a minimum of 7 foot side yard setback for building, property located at 427 Kylie Lane, Lot 14, Block E of the Pointe North Phase 2 Addition. ZBA 2017- 01 Staff Comments Mr. Molina stated that the subject property is located at 427 Kylie Lane and is currently zoned Single Family Residential Lot 10/24. Minutes January 16, 2017 Wylie Zoning Board of Adjustment Page 1 of 2 The residential home was built in 1992, with an 6.5 foot side yard setback. By the current ordinance, the property is legally non- conforming, due to the 6.5 foot setback. The applicant is requesting a variance in order to expand residential home with the 6.5 foot side yard setback. The addition will be 30 feet in length and approximately 25 feet in width. The rear setbacks will remain in compliance at 25 feet. Public comment forms were mailed to eight property owners, and no responses were received in opposition or in favor. Public Comments Chair Jourdan opened the Public Hearing. Mr. Rusty Roach, 901 Robison Creek, Prosper, represented as the contractor for the subject property, stated that the current garage will be converted into a bedroom with a separate entry from the main house. The exterior material will match the existing residential home. The expansion will serve as a bedroom for senior parents, and the room will not be rented out. Chair Jourdan closed the Public Hearing. Board Action A motion was made by Board Member Holcomb, and seconded by Board Member Gonzalez, to Grant the variance 6.5 foot side yard setback. Motion carried 4 — 0. The property is located at 2806 West FM 544, being 1.074 acres of Lot 3R block B of the Freddy's Addition. ZBA 2017-02. Discussion Applicant: Brian Mitchell/Tommy Bell Owner: Josey JBB Development,LLC The subject property is located at 2806 West FM 544. The property measures 1.074 acres and is currently zoned Commercial Corridor. The applicant is proposing to place three attached wall signs to the main structure. The proposed sign is 6' in height and 10' in length with an area of 60 square feet. The current sign ordinance allows for signs to have a maximum of 3' in height when mounted to a building that is between 100 to 200 feet from a street. The main structure in question is approximately 110' from FM544. The intent of the Ordinance is to reduce distraction for motorists and pedestrians and reduce visual clutter. However, a unique circumstance may exist in this case as FM544 is a 6-lane road making a larger sign appropriate for west bound motorists. Additionally, staff is actively working to amend the sign ordinance which would, if approved by City Council, allow the requested sign by right. The Board has approved other signs of this size in other cases and staff is working to amend the ordinance to reduce future needs for Variances. For reference, staff has included an exhibit showing the proposed sign in three sizes; the requested size, the maximum allowed under the current ordinance, and the maximum allowed under the proposed amendment. Public comment forms were mailed to 17 property owners within 200 feet of this request, as required by State Law. One comment form was received in favor and no responses were received in opposition at the time of posting. CONSIDERATIONS: Page 1 of 2 Page 2 of 2 ZBOA 2017-02 The Board shall not grant a variance to the development code which: (1) Pe-Inuits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie.
