Consider and act upon approval of the Minutes of the January 16, 2017 Meeting. A motion was made by Board Member Gonzalez and seconded by Board Member Holcomb, to approve the Minutes as submitted. PUBLIC HEARINGS Item 1 —ZBA 2017-02 Hold a public hearing to consider and act upon, a request from Brian Mitchell/Tommy Bell for a Variance to Ordinance 2014-44, Section 22-447 Wall Signs, requirements for the maximum height of a wall sign. The property is located at 2806 West FM 544, being 1.074 acres of Lot 3R block B of the Freddy's Addition. ZBA 2017-02 Staff Comments Mr. Haskins stated that the subject property is located at 2806 West FM 544. The property measures 1.074 acres and is currently zoned Commercial Corridor. The applicant is proposing to place three attached wall signs to the main structure. The proposed sign is six feet in height and ten feet in length with an Minutes February 20, 2017 Wylie Zoning Board of Adjustment Page 1 of 2 area of 60 square feet. Currently, the Sign Ordinance allows for signs to have a maximum of three feet in height on a structure that measures 100 to 200 feet from a street. The main structure is approximately 110 feet from FM 544. The total right-of-way measurements for FM 544 are 100 feet. When traveling westbound on FM544, on the opposite side of the ROW from the location of the structure, the distance is approximately 220 to 240 feet. Mr. Haskins presented to the Board Members a sign set to scale the size of the requested sign versus the size of the sign allowed within the current Sign Ordinance. Mr. Haskins further stated that in March or early April a revised Sign Ordinance will be considered by the Planning & Zoning Commission and City Council. Exhibits will include signs that are drawn to scale complying with the current and compared to the revised sign ordinance. Public Comment Forms were mailed to seventeen property owners. One comment form was received in favor, and no comment forms were received in opposition. Public Comments Chair Jourdan opened the Public Hearing. Mr. Tommy Bell, Barnett Signs, 4250 Action Drive, Mesquite, the applicant for the subject property, stated that the logo for the company is extremely small when complying with the current sign ordinance. The proposed six by ten feet sign is the franchise standard trademark. Chair Jourdan closed the Public Hearing. Board Action A motion was made by Board Member Holcomb, and seconded by Board Member Prendergast, to Grant the variance for three attached wall signs measured six feet in height and ten feet in length with an area of 60 square feet. The property is located at 1801 Stone Glen Drive in River Chase,Phase 3, Block 8, Lot 20. Discussion The subject property is located at 1801 Stone Glen Drive in the River Chase, Phase 3 subdivision and is zoned within PD 2005-44. The applicant is proposing to construct a 750 square foot, 14" high accessory structure, with the use of a standard prefab building kit with a baked-on enamel exterior finish, on a residential lot of approximately 28,000 square feet (.7 acres). The intended use of the accessory structure is to be used as a workshop. The applicant requests a variance to Section 2.5.C.2e (2) of the Zoning Ordinance for residential accessory structure masonry requirements. The zoning ordinance requires a single accessory structure of more than 2% lot coverage to be built with a masonry exterior material that matches the exterior of the main building. The intent of the ordinance is to allow for the purchase and installation of accessory structures, such as those sold at local home improvement centers, if they are relatively small (<2%) compared to the lot and home size. However, larger accessory buildings, those greater than 2% are usually more visible structures that are required to have a masonry exterior that closely matches the main structure on the lot. The applicant's request is to allow for a building that measures 25x30 square feet (750 square feet). In accordance with the zoning ordinance, the maximum allowed by right would be 560 sf. The proposed accessory structure exceeds the 2% requirement by .68%. The applicant states that the HOA has granted conditional approval of the accessory structure with a condition that fence improvements are made that would screen the accessory structure from view from Stone Glen Drive. A unique physical circumstance may exist as the River Chase subdivision has larger lots compared to other lots in the city. The intent of the requirement within the Zoning Ordinance would still be met if the variance is approved as the accessory structure will be hidden from view. There have been other variance cases that have been granted in the past that are similar to this request. Page 1 of 2 Page 2 of 2 ZBOA 2017-03 The applicant has provided a survey showing the accessory structure being placed in the rear portion of an existing driveway approximately 18 feet away from the property to the northeast and 13 feet away from the adjacent rear property. Public comment forms were mailed to 17 property owners within 200 feet of this request, as required by State Law. One comment form was received in opposition of the request. Stating that the HOA approval is contingent upon the applicant meeting the zoning requirements as written and obtaining a permit. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie.
