PUBLIC HEARINGS Item 1 —ZBA 2017-02 Hold a public hearing to consider and act upon, a request from Robert Stanley for a Variance to Section 2.5.C.2e.(2) of the Zoning Ordinance for residential accessory structure masonry requirements. The property is located at 1801 Stone Glen Drive, being Lot 20, Block 8 of the Riverchase Phase 3 Addition. ZBA 2017-03 Staff Comments Mr. Molina stated that the applicant is proposing to construct a 750 square foot, fourteen foot high accessory structure, on a residential lot of approximately 28,000 square feet (.7 acres). Minutes March 20, 2017 Wylie Zoning Board of Adjustment Page 1 of 3 The zoning ordinance requires a single story accessory structure that is more than two percent lot coverage to be built with a masonry exterior material that matches the exterior of the main building. The maximum allowed by right would be 560 square feet. The proposed accessory structure exceeds the two percent requirement by .68 percent. The applicant is requesting a variance for masonry exterior material. The height of the structure is fourteen feet and eighteen feet away from the property to the northeast and thirteen feet from the adjacent rear property. The applicant states that the Homeowner's Association has granted conditional approval of the accessory structure with a condition that fence improvements are made that would screen the accessory structure from view from Stone Glen Drive. Public Comments forms were mailed to seventeen property owners. Two comment forms were received; one comment in favor and one comment in opposition of the request. Public Comments Chair Jourdan opened the Public Hearing. Mr. Robert Stanley, 1801 Stone Glen Drive, stated that the accessory structure will be used as a workshop for classic cars hobbyist. Currently, there is no fence, and if approved a six foot height fence will be constructed, which will meet the adjacent neighbors' fence. Ms. Nora Emily Boroden, 1804 Stone Glen Drive, spoke in opposition, stating that the exterior material of the accessory structure should match house. Ms. Alysha Darby Ridgway, 1803 Stone Glen Drive, spoke in opposition, stating that the accessory building will be an eyesore, and the building should meet the ordinance requirements for size and height. Chair Jourdan closed the Public Hearing. Board Discussion Board Member Holcomb questioned if there were surrounding properties with variances. Mr. Molina stated that variances were granted for lots similar to the subject size, but not within the same subdivision. ZBA 2017-04 Discussion Applicant: Amanda Peterson Owner: Robert Heath The applicant is asking for a variance for permanent cosmetics to be allowed within the Downtown Historic District by applying for a variance to the interpretation of how the permanent cosmetic use is defined within Article 5 of the Use Regulations found within the Zoning Ordinance. The permanent cosmetic use confoiuis within the Body Art Studio use of the Zoning Ordinance and is currently allowed in the Light and Heavy Industrial Districts and is defined as an establishment whose services include tattooing and/or body piercing. Tattooing shall mean the placing of designs, letters, figures, symbols, or other marks upon or under the skin by any person, using ink or other substances that result in the permanent coloration of the skin by means of the use of needles or other instruments designed to contact or puncture the skin. Body piercing shall mean the creation of any opening in an individual's body, other than ear piercing, to insert jewelry or another decoration. The specific form of Permanent Cosmetics that this variance is pertaining to is called microblading and is a manual skill of semi-permanent eyebrow drawing. The pigment is applied into the surface layer of the detmis using sterilized tools. The pigment is chosen so to match the natural hair or eyebrow's color. Strokes are drawn in the direction of natural hairs' growth to achieve a hyper-realistic look. The upkeep of microblading depends on the client's skin and preference on how often they return for touch ups. The Texas Department of State Health Services requires for the microblading service to be licensed as it is classified as tattooing due to microblading involving the insertion of pigments under the skin. The applicant has requested for the variance of permanent cosmetics for the applying of contour pigment on the eyebrows, eyelashes and lips with a possibility of adding an areola service in the future. One response was received in opposition and no responses were returned in favor at the time of posting. CONSIDERATIONS: The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2)Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. This service has the ability to give woman back what was unwillingly taken from them. It's a form a Permanent Cosmetics called Microblading. Microblading is a manual skill of semi-permanent eyebrow drawing. The pigment is applied into the surface layer of the dermis using sterilized tools. The pigment is chosen so to match the natural hair or eyebrows' color. After the healing,the color may become several hues lighter that the natural hairs' color. Strokes are always drawn in the direction of natural hairs' growth to achieve hyper-realistic look. Treatment is performed with disposable sterile tools, and pigments are produced in accordance with the highest standards (LI microblading pigments). Correction is done a month after the treatment, because between 10 and 15%of drawn strokes disappear after the first treatment. Color is extremely dark during the first 5 to 7 days. 7 days later, it loses 40 to 50%of its intensity. If you think the color is too dark, do not try to remove it yourself by no means. Patiently wait 7 days for the color to fade on its own after the healing of the skin. Color duration primarily depends on how oily the skin is.The oilier the skin,the shorter the color lasts. Sweating and sun exposure also reduce color fastness. On average, expected time until a new color refreshment is between 10 and 12 months. With oily skin it is up to 6 months. The healing is fully completed after 28 days and this is when we perform an obligatory addition of the pigment that has been lost. With problematic and oily skins,we can have several additions (corrections). Post-treatment care makes 70%of the treatment's success. Conscientiously obey advice, because if you don't do so you may lose up to 80%of drawn strokes. Rinsing and applying creams is of great importance. I am seeking a variance to update to rules to match the updated technology in makeup. I am only applying contour pigment in to the Eyebrows, Eyelashes and Lips. Discussion Applicant: Ross MacArthur Owner: Albertson's LLC The subject property is located at 921 Westgate Way. The property measures 7.25 acres and is currently zoned in the Commercial Retail Zoning District. The applicant is proposing to replace one attached wall sign on the main structure. The proposed sign is 8'- 4" in height and 34'- 8"in length with an area of 289 square feet. The current sign ordinance allows for signs to have a maximum of 4' in height when mounted to a building that is located 200 or more feet from a public right of way. The structure is located approximately 735' from Westgate Way and 210' from FM544. The intent of the Ordinance is to reduce distraction for motorists and pedestrians and reduce visual clutter. However, a unique circumstance may exist in this case as FM 544 is a 6-lane road which makes a larger sign appropriate for west bound motorists. In addition, staff is presenting an amendment to the sign ordinance to City Council on April 25th, 2017 that would allow for the sign as shown without the need of a variance. The Board has approved other signs of this size in the past and the aforementioned sign ordinance amendment should reduce the amount of sign variances that are applied for in the future. Public comment forms were mailed to 19 property owners within 200 feet of this request, as required by State Law. No responses were returned in favor or in opposition at the time of posting. Page 1 of 2 Page 2 of 2 ZBOA 2017-05 CONSIDERATIONS: The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. The property is located at 2210 West FM 544, being Lot 1 Block A of the LaQuinta Addition. ZBA 2017-06. Discussion Applicant: Brian Mitchell/Tommy Bell Owner: Karma Hotels,LLC The subject property is located at 2210 West FM 544. The property measures 2.45 acres and is currently zoned Commercial Corridor with a Planned Development (PD) overlay. The applicant is requesting two sign variances. One for a wall sign and another for a monument sign. The proposed wall sign consists of two areas, the hotel name and the hotel logo. The hotel logo is 8'3-3/4" high and 7'7-7/8" wide. The name sign is 4'10-3/16" high and 24'1-5/8" wide. Both signs exceed the current allowed 4' maximum height for a mounted wall sign 200' or more from a public street. The structure is approximately 450' from the ROW of FM544. The intent of the Ordinance is to reduce distraction for motorists and pedestrians and reduce visual clutter. However, a unique circumstance may exist in this case as FM544 is a 6-lane road making a larger sign appropriate for west bound motorists. In addition, the main structure sits more than twice the distance from the ROW as mentioned in the Ordinance. Lastly, staff is presenting proposed changes to City Council on April 25, 2017 that would allow the wall signs, (the facade of the structure is approximately 185' feet allowing a total of 370 sqft of sign with no one sign being more than 278 sqft. The proposed signs total approximately 200 sqft, being 125 and 75 sqft). The proposed monument sign is 5' high and 14'1-1/2" wide. The Ordinance allows for single tenant monument signs to be a maximum of 8' wide and total 96 square feet. As with wall signs, the intent of the Ordinance is to reduce distraction for motorists and pedestrians and reduce visual clutter. Additionally, placement and size of monument signs,being at ground level, must take into consideration vehicle driver and pedestrian sight lines. When considering these requests, it is permissible for the Board to approve neither, one, both, or any combination with modifications. No comment forms were received at the time of posting. CONSIDERATIONS: The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie.
