Commissioners present were: Vice Chair Randy Owens, Commissioner Brad Emerson, Commissioner Bryan Rogers, Commissioner Mike McCrossin, and Commissioner Roger Myers. Chair Ron Smith and Commissioner Jade Duan were both absent. REGULAR AGENDA Minutes Ociabm 17, 2017 Wylie Planning &Zoning Commission Purge 1 of 4 Public Hearing Zoning Case 2017-07—Amend PD 2016-37 & PD 2016-27 Hold a Public Hearing and Consider, and act upon, a recommendation to the City Council to amend Planned Development 2016-37-Single Family District and Planned Development 2016-27 (PD2016-27-SF) to include an additional 2 acres, adjust the allowed total lot count, and to allow a day care use, generally located east of Sachse Road/Ballard Ave. and south of Pleasant Valley Road. ZC2017-07. Staff Presentation Ms. 011ie stated that the owner is requesting to amend an existing Planned Development Ordinance to include the 2 acres tract that was annexed into the city limits on April 25,2017. The proposed PD eliminates the maximum density of 2.7 homes per gross acre. Instead, the lot mix is divided by lot types and indicates a slight increase in Type A 70' width lots, all other lot widths remain the same. The addition of the 2-acre tract will increase the lot count from 975 to 1025 maximum lot count. The current PD Conditions allow minimum of 98 lots to have a 70 feet wide. The proposed conditions will allow minimum of 148 lots with a 70 feet width. In response to State Law Two Hundred and Thirty-Six notifications were mailed and three (3) responses were received in opposition of the proposed Day Care Use. Board Discussion Mr. Ron Haynes, Wylie DPV Limited, 8214 Westchester, Suite 950, Dallas, owner/developer for the subject property, stated that when the property was zoned four years ago, the preliminary engineering drawings were done onsite. Phase I has about 200 homes, and Phase II is starting to develop about 215 homes. Extensive planning and engineering of the development, the engineer has determined more lots available in the development. The open space would remain in place, as well as the 50 foot wide and 60 foot wide minimum number of lots. The proposed allows increase width size for the larger lots. Mr. Haynes gave the Commissioner a presentation explaining the concept layout for the day care. His intention is to construct the day care at four-lane divided perimeter, which is either Pleasant Valley Road, or Sachse/Ballard Road. The exact location is not determined. The day care would not be limited to the community of Dominion of Pleasant Valley, and would not be part of the Homeowners Association. Public Comments Chair Owens opened the Public Hearing. Mr. Shawn Montague, 225 Red Bud Pass, spoke in opposition of the day care due to increase traffic, noise and parking overflow on Dominion. Mutes October 17, 2017 Wylie "kenning &Zoning Commission Page 2 of 4 Mr. Lance Barron, 223 Red Bud Pass, spoke in opposition of the day care due to increase traffic and property taxes. The proposed concept location is a major issue, would like to see either a stop sign or traffic signal at Sachse/Ballard and Dominion. Mr. Marlon Anding, 119 Live Oak Drive, spoke in opposition of the day care due to traffic, and impact to property value and taxes. He just retired from military service and would like to have peace and quality of life. Mr. Craig Brown,202 Red Bud Pass,spoke in opposition of the day care due to existing traffic and safety concerns. Commissioners questioned the City Engineer, Tim Porter, of the plans for Sachse/Ballard Road and Pleasant Valley Road. Mr. Porter stated that the County will dictate the plans for expansion of both Sachse/Ballard Road to a four-lane divided road, as well Dominion of Pleasant Valley for a four-lane divided road. The City of Wylie may fund a portion of that expansion, but the funds are not available and a plan is not designed. Mr. Haynes rebutted the comments by stating that the Day Care facility would not be developed without a four lane divided road in front of it. Commissioner Myers gave a personal experience on opposing a proposed request. He was against a WalMart Neighborhood Store coming in a couple of years ago. Today, the store is very convenient, no issues for traffic or safety. He further stated that a Day Care Facility within the Dominion Pleasant Valley would be a great asset to the community, mainly due to close to home, and convenient for the parents. He further appreciated the public to come in and voice opinion. Chair Owens closed the Public Hearing. Board Discussion Chair Owens reminded the Commissioners of another option to consider. The subject item can be approved with modification to the Planned Development with stipulation that a Day Care Facility be allowed by Specific Use Permit only. This gives the Commissioners oversight as a public hearing and allow the property owners to come in and voice concerns. A motion was made by Commissioner Rogers, and seconded by Commissioner Myers, to recommend approval to the City Council to amend Planned Development 2016-37- Single Family District and Planned Development 2016-27 (PD2016-27-SF) to include an additional 2 acres and adjust the allowed total lot count, with stipulations that a day care use be allowed with Specific Use Permit. The manufactured housing regulations have undergone several amendments since 1983. - Ord. 1983-18 included MH Park but no specific lot requirements - Ord. 1985-05 amended 83-18 added the mobile home space shall be improved & have adequate support. - Ord. 1985-40 amended 1983-18 included specific area requirements 5,500 sf min lot - Ord. 2000-11 created the MH District with 2 distinct types MH Subdivision (7,200sf) & MH Park (5,550 sf) repealed 1985-23A. 07/25/2000 - Ord. 2001-48 amend in its entirety 1985-23A and included MH Subdivision (7,200sf) & MH Park (5,550 sf) - Ord. 2005-58 deleted the MH Park section. January 24, 2006 The current ordinance has a Manufactured Home Subdivision District (MH). The allowed uses in the district are Manufactured Home and Manufactured Home Park. Manufactured Home Definition: Manufactured Home is a factory-built, single-family structure that is manufactured under the authority of 42 U.S.C. Section 5401, the National Manufactured Housing Construction and Safety Standards Act of 1974, is transportable in one or more sections, is built on a permanent chassis, and is used as a place of human habitation; but which is not constructed with a permanent hitch or other device allowing transport of the unit other than for the purpose of delivery to a permanent site, and which does not have wheels or axles permanently attached to its body or frame. Page 2 of 2 Manufactured Home Park Definition: Manufactured Home Park means a unified residential development of manufactured homes on transient stands arranged on a lot under a single ownership. Manufactured homes are factory assembled structures without permanent foundations and designed to be transported on its own wheels, arriving at the site as a complete dwelling unit. Removal of the wheels and placement on a foundation does not change its classification. The term manufactured home includes half units that are transported to the site on their own wheels and assembled. It does not include travel trailers, campers, camper buses, motor homes, or modular houses. A Manufactured Home may be constructed in any residential district, but must adhere to the requirements of the district in regards to setbacks, materials, etc. A Manufactured Home Park is only allowed within the Manufacture Home Subdivision District. In summary, in 2000 the zoning ordinance consisted of Manufactured Home Subdivision which allowed lot sizes of 7,200 sf and Manufactured Home Park which allowed lot sizes of 5,500 sf. In 2005 the MH Park section was removed. Staff researched 10 city ordinances regarding lot size and dwelling size. The average minimum lot size is 4,350 sf, with the largest being Little Elm at 6,000 sf. The average dwelling size where a minimum was listed is 820 sf with the largest being Terrell at 1,200 sf.
