Board Member Ulmer was absent from the meeting. Staff members present were City Manager, Mindy Manson, Public Services Director, Mike Sferra, Parks and Recreation Superintendent, Robert Diaz, and Parks Board Secretary, Janet Hawkes. CITIZENS PARTICIPATION No Citizens came forward. BUSINESS ITEMS 1. Consider and act upon approval of the Minutes from the January 11, 2016 meeting. Board Action: Board Member Jones made a motion, seconded by Board Member Chesnut, to approve the minutes from the January 11, 2016 meeting. A vote was taken and passed 5-1. Board Member White submitted a 'no' vote. 2. Consider and act upon parkland dedication for the Woodbridge North Development. Superintendent Diaz advised the Board that Woodbridge North Developer, Don Herzog, is proposing to meet a total of$748,000 in parkland dedication requirements with a combination of land dedication, parkland improvements, and cash contribution into the west Acquisition and Improvement (A&I)funds. Developer Herzog addressed the Board with details of his proposal. He plans to contribute nearly $190,000 in cash funds, dedicate 2.59 acres of parkland, and install approximately$454,000 worth of parkland improvements. These improvements include eight and 12 foot wide concrete trails, trail mileage markers, playground equipment, picnic tables, park benches, trash receptacles, landscaping, and irrigation. Developer Herzog noted that after the proposed project is complete, the City of Wylie would assume responsibility of utilities and maintenance. Developer Herzog specified that the 2.59 acres of parkland dedication includes 1.08 acres of North Texas Municipal Water District(NTMWD) easement. He also stated that the 12 foot portion of concrete trail he plans to install is in 8.78 acres of overhead right of way owned by Oncor. The Board expressed concern as to the likelihood of Oncor granting permission for Developer Herzog to construct the trail within their overhead right of way. Director Sferra advised the Board that City staff had already been in communication with Oncor regarding the issue. He stated that Staff has submitted an application to gain Oncor's permission to allow trail construction within their right of way, and that Oncor gave Staff every indication of accepting the City's proposal and approving the application. Superintendent Diaz explained that there is possibly a need for a small parking lot adjacent to the proposed 2.59 acre park. Developer Herzog estimated the cost of installing a 10 to 12 space parking lot would be approximately$20,000 to $25,000. The Board requested Developer Herzog provide them with a few varying parking lot concepts along with cost estimates for each. Board Action: Board Member Kinser made a motion, seconded by Board Member Harris, to approve the parkland dedication for the Woodbridge North Development with the condition that the developer provide parking lot concepts with cost estimates for the Board to consider at a future meeting. A vote was taken and passed 5-1. Board Member Chesnut submitted a 'no' vote. DISCUSSION ITEMS No Discussion items. REMOVE FROM TABLE FROM DECEMBER 2015 MEETING: (MOTION TO REMOVE TO BE CONSIDERED PRIOR TO ITEM CONSIDERATION) Consider and act upon vendor application for Wylie East High School (WEHS) Cross Country Team to sell items at a cross country meet to be held September 3, 2016 at Founders Park. Board Action 1: Board Member Jones made a motion to remove the item from the table. The motion to remove the item from the table was seconded by Board Member White. A vote was taken and passed 4-0. Superintendent Diaz updated the Board that the applicant has since clarified their intentions with Staff, and confirmed that they only intend to sell items such as prepackaged concessions and t- shirts at their meet in Founders Park on September 3, 2016. All funds raised will go to support the Wylie East High School Cross Country Team. Board Action 2: Board Member Chesnut made a motion to approve the vendor application for the Wylie East High School Cross Country Team, to sell items at a cross country meet on September 3, 2016 at Founders Park. The motion was seconded by Board Member Jones. A vote was taken and passed 4-0. 2. Consider and act upon the request from the Wylie Art Gallery for a Farmers Market to be held in Olde City Park on August 6, September 3, and October 1, 2016. Lynn Grimes, Founder/Co-owner of the Wylie Art Gallery, a non-profit organization, located at 201 N. Ballard Avenue, Suite 100, Wylie, Texas, addressed the Board to discuss details of her submitted vendor application. Ms. Grimes advised the Board that she wants to host a Wylie Farmers Market event on the first Saturday of August, September and October of this year, from 8:00 a.m. to 2:00 p.m. Ms. Grimes stated she hopes for the event to be successful and to continue on into 2017. Fees collected would support community art projects and scholarships. Types of items would include fresh produce and meats, as well as packaged items such as honey, bread, pasta, spices,jams, etc. She also hopes to have food vending trucks on site. Superintendent Diaz added that the vendor applicant would be responsible for notifying the Collin County Environmental Services for required permits. The Parks Division staff would assist with litter and park set up, and the event time frames would still allow for late afternoon and evening rentals of the Olde City Park pavilion and gazebo. Board Action: Board Member Jones made a motion to approve the vendor application for the Wylie Art Gallery to host a Farmers Market in Olde City Park on August 6, September 3 and October 1, 2016. The motion was seconded by Board Member White. A vote was taken and passed 4-0. DISCUSSION ITEMS Parking options in the proposed park for the Woodbridge North Development. Superintendent Diaz reviewed with the Board the different parking lot options in the proposed park for Woodbridge North Development: • Option A 19 parking spots $55,000 • Option B 13 parking spots $47,000 • Option C 14 parking spots $21,865 • Option D 9 parking spots $24,455 Superintendent Diaz noted that Staff recommended options A and B for Board consideration because option C does not provide safe and adequate pedestrian park access, and option D provides too few parking spaces. After discussion, the Board consensus was to go with Option B for the parking lot at Woodbridge North Development. Board Member Jones preferred option A, Board Member Rose, Board Member Chesnut, and Board Member White all preferred option B. Superintendent Diaz would communicate to the Developer that option B would be the preferred parking option. Discussion Parker Bagley, Wylie High School student, approached staff about a concert event that could be a fundraiser for victims of the recent hail storms. Parker was to perform at Wylie High School as part of their annual talent show but that event was cancelled due to the hail storms. Parker felt that a concert would not only allow students who did not perform an opportunity, but also allow the community to come together and assist those affected by the storms. Parks staff will assist with some of the coordination on the use of the park. Staff has not previously worked with Parker on events. Parker is planning on attending the meeting to answer any questions the Board might have regarding the event. Recommendation Motion to recommend approval of the request from the Parks Division to remove a large Boxelder tree on park land behind Foxwood Lane. Discussion Per the City of Wylie Ordinance 2012-23, the Parks and Recreation Board also serves as the City's Tree Advisory Board. One function of the Board under this ordinance is to process requests to prune, trim, and/ or remove trees that have been designated as "protected" by the board or the ordinance. Currently, all public trees with a caliper measurement of 16 inches or greater are designated as protected. The Parks Division was approached by a resident at 503 Foxwood Lane with a concern about this tree, which is on City property and has shed several limbs in the recent storms. An adjacent tree was removed per a citizen request two years ago, but at the time this tree was deemed to be healthy. This tree is approximately 23" in diameter, and residents are concerned that if the tree fell, it may cause a hazardous situation since children often play in this area. The Parks Division feels that this tree should ideally be removed. The Parks Division requests permission from the Tree Advisory Board to arrange to have this tree removed by a qualified contractor. On November 10, 2015 the Wylie City Council then approved Ordinance 2015-38 establishing a set of fees for the Brown House. During the current process of preparing for rental operations at the Brown House,Recreation staff reviewed the approved fees and found that some items typically used for other recreation facilities such as cancellation fees were not included in the list of approved fees. For example, the current version implies a deposit for Residents using the facility on Friday through Sunday, but the new version clearly shows that the deposit is required. Staff and the City Attorney also clarified the type of rental in the new version instead of noting a type of rental in the Additional Information column of the current version. Staff also included a cancellation fee (one half of the deposit amount)which is consistent with cancellation fees for the Wylie Recreation Center and Bart Peddicord Community Center. These changes are minor and work to improve how the current version of the ordinance is interpreted. CITY OF WYLIE, TEXAS ORDINANCE NO. Any person, firm, corporation or entity violating or refusing to comply with any provision of this Ordinance, as it exists or may be amended, shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be fined in an amount not exceeding two thousand dollars ($2,000.00) for each offense if the offense relates to public health and sanitation, otherwise the fine shall be in an amount not exceeding five hundred dollars ($500.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. The penal provisions imposed under this Ordinance shall not preclude the City from filing suit to enjoin the violation. The City retains all legal rights and remedies available to it under local, state and federal law. SECTION 4: Severability. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. The City Council hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof, regardless of whether any one or more sections, subsections, sentences, clauses or phrases is declared unconstitutional and/or invalid. SECTION 5: Savings/Repealing.
