Vice- Chair Linda Jourdan called the meeting to order at 7:05 p.m. and stated that a quorum was present. Board Members present were; Board Member Bill Baumbach, Board Member David Dahl, Board Member Marilyn Herrera, and Board Member Karyn McGinnis. Staff members present were: Planning Director Renae 011ie, Assistant Planner Jasen Haskins, and Administrative Assistant Mary Bradley. ELECTION OF CHAIR AND VICE CHAIR A nomination was made by Board Member McGinnis to nominate Board Member Linda Jourdan as the Chair, nomination was seconded by Board Member Herrera. A vote was taken and passed 5 — 0. A nomination was made by Board Member McGinnis to nominate Board Member Marilyn Herrera as the Vice-Chair, nomination was seconded by Board Member Baumbach. A vote was taken and passed 4 — 0 — 1, with Board Member Herrera abstaining. CONSENT ITEMS 1. Consider and act upon approval of the Minutes of the June 23, 2008 Meeting. A motion was made by Board Member McGinnis, and seconded by Board Member Herrera, to approve the Minutes from the June 23, 2008 Meeting as submitted. Motion carried 5 — 0. Minutes July 28, 2008 Wylie Zoning Board of Adjustment Page 1 of 4 PUBLIC HEARINGS 1. Hold a public hearing to consider and act upon a request by Aaron Lanman for a Variance to Sections 5.5.A and 5.5.E.2 requiring a Temporary Use to operate for more than 90-days and the use to conform in all respects to all other City regulations and standards, respectively. (ZBA 2008-05) Mr. Haskins stated that the subject property is located at 117 N. Ballard, and that the applicant is requesting two variances. One of the requests is to Sections 5.5.A and 5.5.E.2 Zoning Ordinance requiring a Temporary Use to operate for more than 90-days. The applicant is requesting the placement of a temporary structure while a new office facility is constructed. The second request is to Section 6.3.E.5(e) of the Zoning Ordinance for the Downtown Historic District requiring the base façade materials for commercial structures to be brick or stone. The applicant is proposing a structure constructed with corrugated Cor- Ten Steel with fully welded seams. The requested variances represent a 100% adjustment to the requirements of the Zoning Ordinance. The applicant is stating that his current business is out of room and needs to be expanded. With the business growing, new property was recently purchased, and the timeframe for submitting a Site Plan, and getting the property platted, is part of the hardship. Mr. Haskins stated that the Site plan and Final Plat have been submitted to the city, and will be considered within the next 30 days at the Planning and Zoning meeting and the City Council meeting. Additionally, another part of the hardship exists due to the unique nature of the size of the lot and the DTH ordinances which are necessarily restrictive on expansion and remodeling. Once approval is received from the city, and construction plans submitted, the applicant is proposing that the new office be completed by May 2009. Public comment forms were mailed to 46 property owners, as required by State Law. Four comment forms were received, all in favor of the request. Chair Jourdan opened the Public Hearing. Mr. Aaron J. Lanman, 117 N Ballard Avenue, Wylie, the owner of the property and 119 N Ballard Avenue, stated that his wife has a pediatric office at these locations. The property at 117 N Ballard is about 1800 square feet, and the property at 119 N Ballard is about 1500 square feet, with both combined offices totaling about 3200 square feet. Currently there is not enough office space for the growing pediatric facility. The administrative staff will occupy the temporary building, and the existing offices will be turned into examining rooms. Currently, there are three physicians, and a new nurse practitioner that starts in August, and about thirteen employees right now. There are nine exam rooms, which are three per doctor, and then the conversion of the two offices will give room for the Minutes July 28, 2008 Wylie Zoning Board of Adjustment Page 2 of 4 nurse practitioner to have two exam rooms. Once the nurse practitioner comes in, a possibility for two additional staff will be hired. Mr. Lanman stated that they have purchased 2.5 acres to construct a 7000 square foot building, which is adjacent to Cooper Junior High School. The properties on Ballard will be leased out, once the new facility is completed. To expand the existing buildings does not make sense financially, and aesthetically will not meet requirements for the downtown historic area. The primary goal is to keep all employees on-site, and keep the communication fresh and provide better service to patients. Mr. Lanman stated that the temporary building will sit flat on the ground, easy access for all employees. There will no requirement for steps or ramps. In his personal opinion it is an easy solution, it may not be visually appealing but it will serve the purpose for a temporary solution. The trailer will be rented from Williams-Scott. Chair Jourdan questioned the timeframe for the new facility. Mr. Lanman stated that the Site Plan will be considered by the Planning and Zoning Board on August 19, 2008. The goal is to break ground for the new facility in October or November 2008, and open the facility in May or June 2009. Mr. Haskins recommended that the Board consider a specific time frame for the temporary building use with consideration is made for the construction a new facility. Chair Jourdan closed the Public Hearing. Several of the Board Members expressed their favoritism of the temporary building, and discussed the limitation date. Board Member Baumbach recommended that the variance have a stipulation for August 2009, being that construction for a new facility may take longer than usual. Mr. Lanman stated that August 2009 will give him plenty of time to construct the new facility and move the offices, as well as remove the temporary building from the location before leasing out the existing offices on Ballard Avenue. A motion was made by Board Member Baumbach, and seconded by Board Member Dahl, to Grant the variances to Sections 5.5.A and 5.5.E.2 requiring a Temporary Use to operate for more than 90-days and the use to conform in all respects to all other City regulations and standards, respectively. Discussion The subject properties are Tract 195 of Abstract 688-2 Francisco de la Pina Survey and Lot 2 Blk A of the Wylie High School Addition, located at 2000 S.H. 78 North and 949 Hensley Lane,respectively. The subject properties are owned and occupied by the City of Wylie and are in locations zoned as Corridor Commercial and Agricultural/30. The applicant was originally granted a variance to the 90 day time limit for a temporary use in order to continue to provide City services in an effective and cost efficient manner in September of 2005. The applicant is currently requesting an extension to that variance of Section S.S.A. The requested variance is to last for three years or until the completion and occupancy of the new Civic Center(currently scheduled for late 2010). The reason for this request is that the City has initiated planning for additional facilities and the current portable buildings are the most fiscally responsible option to retain the additional office space needed. The applicant states that a hardship exists due to the rapid growth of the City outpacing the ability of the City to build proper facilities for providing City services. This growth creates a unique circumstance not created by the applicant. Public comment forms were mailed to 31 property owners within 200 feet of this request, as required by State Law. No responses have been received at the time of this posting. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or Page 1 of 2 Page 2 of 2 ZBOA 2008-06 (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions,the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions,the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. Discussion The subject property is located at 431 Carver Drive and was platted in June 2004. The applicant requests a variance to the requirement for a side yard setback of 25 feet to 19 feet in order to build a residential structure of approximately 2,836 s.f. The requested variance of 6 feet represents a 24% adjustment to the requirements of the Zoning Ordinance. The setback means that any structure more than 48" in height must be that minimum distance from the property line. The purpose of the building setback requirement, including the increased side yard set back required on corner lots where two streets intersect, is to preserve and promote open space, increase visibility, and add to neighborhood safety. The applicant has provided an illustration of the lot and where on the lot the proposed residential structure would be placed, pictures of the lot, and a floor plan of the proposed home. The applicant states that a hardship exists due to the restrictions of the home size that can be placed on a corner lot with the 25' setback. There are homes within this subdivision on corner lots that are within the 25' setback as required by the Ordinance, located at 304 Di Vinci Court, 201 and 207 Edison Lane, and across the street at 433 Carver Drive. Public comment forms were mailed to 26 property owners within 200 feet of this request, as required by State Law. No responses have been received at the time of this posting. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. Page 1 of 2 Page 2 of 2 ZBOA 2008-07 In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions,the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions,the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie.
