AN ORDINANCE OF THE CITY OF WYLIE, TEXAS ABANDONING A
1.59 ACRE, MORE OR LESS, DRAINAGE EASEMENT AS CONVEYED
TO THE CITY OF WYLIE, TEXAS BY FARMERS ELECTRIC
COOPERATIVE, INC., TIM R. KREYMER AND TONY A SUE KREYMER
HARBOUR, AND RECORDED IN CLERK'S FILE NO.2003-0156317 OF
THE LAND RECORDS OF COLLIN COUNTY, TEXAS; PROVIDING FOR
SAVINGS, REPEALING, AND SEVERABILITY CLAUSES; AND
PROVIDING FOR AN EFFECTIVE DATE OF TIDS ORDINANCE.
WHEREAS, Farmers Electric Cooperative, Inc., Tim R. Kreymer and Tonya Sue
Kreymer Harbour granted a 1.59 acre, more or less, drainage easement to the City of Wylie,
Texas ("City") recorded in Clerk's File No. 2003-0156317 of the Land Records of Collin
County, Texas, a copy of which is attached hereto as Exhibit "A" and incorporated herein for all
purposes (the "Easement"); and
WHEREAS, the City Council of the City of Wylie, Texas desires to abandon the
Easement since new drainage facilities have been constructed; and
WHEREAS, the City Council finds it is in the best interest and for the purpose of
benefiting the public generally to abandon the Easement.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WYLIE, TEXAS:
SECTION 1: Findings Incorporated. The findings set forth above are incorporated into
the body of this Ordinance as it fully set forth herein.
SECTION 2: Abandonment of Easement. Wylie hereby abandons the Easement
recorded in Clerk's File No.2003-0156317 of the Land Records of Collin County, Texas and
more particularly described in Exhibit "A" attached hereto and incorporated herein for all
purposes.
SECTION 3: SavingslRepealing Clauses. All provisions of any ordinances in conflict
with this Ordinance are hereby repealed to the extent they are in conflict; but as such repeal shall
not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal
prevent a prosecution from being commenced for any violation if occurring prior to the repeal of
the ordinance. Any remaining provisions of said ordinances shall remain in full force and effect.
SECTION 4: Severability. Should any section, subsection, sentence, clause or phrase of
this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is
expressly provided that any and all remaining portions of this Ordinance shall remain in full
force and effect. Wylie hereby declares that it would have passed this Ordinance, and each
section, subsection, clause or phrase thereof irrespective of the fact that anyone or more
sections, subsections, sentences, clauses, and phrases be declared unconstitutional or invalid.

Grantors adjacent property for Ingress and egress to the Easement Property for
the purpose of constructing, reconstructing and perpetually rnalnl~ining the
