ORDINANCE NO. 2004-34
AN ORDINANCE OF THE CITY OF WYLIE, TEXAS AMENDING
ORDINANCE NO. 2001-57; PROVIDING FOR EXEMPTION FROM AD
VALOREM TAX ON MOTOR VEHICLES LEASED FOR PERSONAL
USE BEGINNING WITH THE 2005 TAX YEAR AS AUTHORIZED BY
SECTION 11.252, TEXAS PROPERTY TAX CODE; PROVIDING FOR
REPEALING, SAVINGS AND SEVERABILITY CLAUSES; AND
PROVIDING FOR AN EFFECTIVE DATE OF TillS ORDINANCE.
WHEREAS, the City Council of the City of Wylie, Texas ("City Council") is of
the opinion that it is in the public interest to exempt motor vehicles leased for personal
use from ad valorem taxation; and
WHEREAS, Section 11.252 of the Texas Property Tax Code provides that motor
vehicles leased for personal use shall be exempt from ad valorem taxation unless the
governing body adopts an ordinance imposing the tax thereon, which the City of Wylie,
Texas ("Wylie") has done by Wylie Ordinance No. 2001-57; and
WHEREAS, the City Council has investigated and determined that it would be
advantageous and beneficial to Wylie and its inhabitants to amend Wylie Ordinance No.
2001-57 so that motor vehicles leased for personal use shall be exempt from ad valorem
taxation by Wylie beginning with the 2005 tax year.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WYLIE, TEXAS:
SECTION 1: Findings Incorporated. The findings set forth above are
incorporated into the body of this ordinance as if fully set forth herein.
SECTION 2: Amendment of Wylie Ordinance No. 2001-57. Wylie Ordinance
No. 2001-57 is hereby amended so that motor vehicles leased for personal use shall be
exempt from Wylie ad valorem taxation as permitted by Section 11.252 of the Texas
Property Tax Code beginning with the 2005 tax year. Such amendment shall not abate
any pending prosecution and/or lawsuit or prevent any prosecution and/or lawsuit from
being commenced for any violation of Ordinance No. 2001-57, whether for taxes owed,
assessed or otherwise.
SECTION 3: Savings/Repealing Clause. All provisions of any Wylie ordinance
in conflict herewith are repealed to the extent they are in conflict; but such repeal shall
not abate any pending prosecution for the violation of the repealed ordinance, nor shall
the repeal prevent a prosecution from being commenced for any violation if occurring
prior to the repeal of the ordinance, Any remaining portions of said ordinances shall
remain in full force and effect.
SECTION 4: Severability. Should any section, subsection, sentence, clause or
phrase of this Ordinance be declared unconstitutional or invalid by a court of competent
jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance

SECTION 4: Severability. Should any section, subsection, sentence, clause or
phrase of this Ordinance be declared unconstitutional or invalid by a court of competent
jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance
shall remain in full force and effect. Wylie hereby declares that is would have passed this
Ordinance, and each section, subsection, clause or phrase thereof irrespective of the fact
that anyone or more sections, subsections, sentences, clauses and phrases be declared
unconstitutional or invalid.
SECTION 5: Effective Date, This Ordinance shall become effective
immediately upon its passage.
