Board Members present were; Board Member Robert Holcomb, Board Member Kevin Finnell and Board Member Bill Hiney. Vice Chair Jason Potts arriving late. Staff members present were: Renae' 011ie, Planning Director and Jasen Haskins, Planner. CONSENT ITEMS 1. Consider and act upon approval of the Minutes of the February 16, 2015 Meeting. A motion was made by Board Member Finnell and seconded by Board Member Hiney, to approve the Minutes from the February 16, 2015 Meeting as submitted. Motion carried 4 — 0, Vice Chair Potts arriving after the vote. PUBLIC HEARINGS Item 1 —ZBA 2015-03 Hold a public hearing to Consider and act upon, a Variance to Ordinance 2014- 44, Section 22-450 (2) Real Estate Signs requiring requirement of temporary signs to be no larger than nine square feet and four feet in height, property located at 709 Parker Road being Tract 32 of the WD Penney Survey. ZBA 2015-03. Minutes March 16, 2015 Wylie Zoning Board of Adjustment Page 1 of 4 Page 5 of 65 Staff Comments Mr. Haskins stated that the property is located on Parker Road, behind the Lutz Woodworks, and is 250-300 feet off the main roadway. The property totals approximately 4.92 acres and is zoned Agricultural District (AG/30). The Ordinance allows Real Estate temporary signs on residentially zoned property to be a maximum of nine square feet and four feet in height. The applicant maintains that due to the location of property being on the Parker Road loop, there is insufficient visibility to the traffic on Parker Road. The applicant is proposing to construct and erect two four feet by eight feet (32 square foot) real estate signs on the property. Therefore, the applicant is requesting a variance to Section 22-450 (2) of Ordinance 2014-44. The unique circumstance is the size of the lot, which is twenty times larger than the minimum allowed lot size. Additionally, the property is not adjacent to the road on which it is addressed. Public comment forms were mailed to 17 property owners within 200 feet of this request. One comment form in favor of the request was received, and none in opposition. Public Comments Chairperson Jourdan opened the Public Hearing. Mr. John Velis, 2511 Mesquite Valley Road, Mesquite, Texas, Tom Brown Real Estate Representative, stated that the sign would be located on the property, but would be tall enough to be seen from the main Parker Road. The signs would be located on each side of the main entrance to the property. Chairperson Jourdan closed the Public Hearing. Board Discussion Commissioners discussed the time frame for the real estate sale and the lifeline for the condition of the sign. Board Action A motion was made by Board Member Finnell and seconded by Board Member Holcomb, to Grant the variance to Ordinance 2014-44, allowing two real estate signs on the property for six months, if longer than six months is needed, the applicant will come before the Board to discuss condition of the sign. Motion carried 5 — 0. Minutes March 16, 2015 Wylie Zoning Board of Adjustment Page 2 of 4 Page 6 of 65 Item 2 ZBA 2015-04 Hold a public hearing to consider and act upon a request by Kerat Building, LLC for a Variance to Section 3.3.B.3 of the Zoning Ordinance for properties requiring a minimum 15 foot side yard setback for buildings, property located at 621 Fleming Street, being 1, Block E of the Village Addition. ZBA 2015-04 Staff Comments Mr. Haskins stated that the applicant is requesting a variance to Section 3.3.B.3 of the Zoning Ordinance Development Standards for residential zoned properties that requires a fifteen foot side yard setback when on a corner lot. The applicant is requesting ten foot side yard setback. The property is located at 621 Fleming Street. The developer/applicant purchased the remaining undeveloped sixteen lots, and is planning to build homes that meet or exceed the current standard of the neighborhood. The unique circumstance for the property is due to being on corner lot but with a separated access drive. This separation allows vehicles entering Fleming to easily see oncoming traffic, regardless of structure placement on the property, eliminating one of the reasons for the setback. The applicant is proposing to construct a two-car garage, the original requirements of the subdivision allowed for single car garages. The additional footage is needed to allow the two-car garage. Public comment forms were mailed to thirty-six (36) property owners within 200 feet. Two comment forms in favor of the request, and no comment forms opposing the request were received. Public Comments Chairperson Jourdan opened the Public Hearing. Ms. Beth Erkassih, 4014 Kingsberry Drive, Arlington, representative The Real Estate Group, stated that she sold the property to the applicant. Mr. Raid Alawazzi, Kerat Building, LLC, 704 Mt. Vernon Drive, Richardson, Texas, stated that the desire is to develop the subject property, as well as the remaining fifteen lots to be developed meeting or exceeding the current design standards from the Zoning Ordinance. Mr. Haskins responded that the developer/applicant will install a wall, in order to adhere to the current ordinance. Chairperson Jourdan closed the Public Hearing. Board Discussion The Commissioners discussed the request for two car garages. Ms 011ie stated that in 2007, a portion of the empty lots were replatted, which kicked into the current ordinance guidelines. The developer/applicant desires to adhere to current ordinance. Board Action A motion was made by Board Member Hiney, and seconded by Board Member Finnell, to Grant the variance for a ten foot side yard setback for buildings. ADJOURNMENT A motion was made by Board Member Finnell, and seconded by Vice Chairman Potts to adjourn the meeting. ZBA 2015-05 Discussion Applicant: Robert McDonald Owner: Caliber Collision The subject property is located at 451 Westgate Way. The property is 2.0 acres currently zoned Commercial Corridor(Special Use Permit). The applicant is proposing to add an attached lighted wall sign to the south side of the main structure. The proposed sign is approximately 38-1/2" in height and 24'8" in length. Currently, the Ordinance only allows for signs to be a maximum of 2' in height when mounted to a building that is within 100' of a street. Caliber Collision is approximately 70' from Westgate. The intent of the Ordinance is to reduce distraction for motorists and pedestrians and reduce visual clutter. Because the requested sign exceeds the allowed height by 14-1/2" (38%), the applicant is requesting a variance to Section 22-447.1.c.1 of Ordinance 2014-44. The applicant maintains that due to the property's location off of Westgate, north of a Chili's restaurant the sign size allowed by the Ordinance is insufficient to attract attention to the property from the traffic on FM544. Public comment forms were mailed to 8 property owners within 200 feet of this request, as required by State Law. No responses have been received at the time of this posting. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or Page 1 of 2 Page 9 of 65 Page 2 of 2 ZBOA 2015-05 (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. Per Section 8.4.E.1 The administrative procedures and requirements of the ordinance, with regard to Commission consideration and action, on concept plans, detail site plans, preliminary plats and final plats, must be exhausted prior to requesting a variance from the terms of this ordinance. Because the owner has not filed the Final Plat with Collin County, it is staffs recommendation that all procedures have not yet been exhausted and therefore this request should not be granted. However, because the case was properly advertised, the public hearing should be held and afford any interested person to provide comment. Public comment forms were mailed to 13 property owners within 200 feet of this request, as required by State Law. ZBA 2015-07 Discussion Applicant: Renae Lawson Owner: Billy and Sylvia Lawson The applicant is requesting a variance to 11.3.c of the 1985 Zoning Ordinance Development Standards for residential zoned properties that requires a 25' rear yard setback. The purpose of the setback standard is to ensure adequate spacing between structures and between structures and drive lanes for the placement of utilities, fire safety, green space, and aesthetic streetscapes. However, adopted amendments after the 1985 Ordinance allowed for a minimum setback of 20 feet for carports and garages. The applicant is requesting the minimum setback be reduced to 8' to add a carport at the rear of the property. A unique circumstance may exist on the property due to the property being a rear entry property. Traffic is limited to the homeowners in the area and the utility easements run perpendicular in this subdivision. The Board has approved a similar variance in the last 24 months, however that property was at the end of an alley which had no outlet thus limiting potential traffic even further than normal. Public comment forms were mailed to twenty-six (26) property owners within 200 feet of this request, as required by State Law. At the time of this posting one response was received in favor of the proposed variance. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or Page 1 of 2 Page 29 of 65 Page 2 of 2 ZBOA 2014-07 (6) Is based exclusively on findings of personal or financial hardship. ZBA 2015-08 Discussion Applicant: Randy Glenn Owner: Randy Glenn The applicant is requesting a variance to Section 20.3.1.c of the 1985 Zoning Ordinance regulation on building setbacks that require a 20' front yard setback. The property is the subject of a sale, and is typical for purchaser/seller to enlist the services of a surveyor to verify the boundaries of said property. In preparing the survey, it was determined that the main structure did not meet the required setback. The original permit was likely issued in the late 1980's and may have allowed for the error. When reviewing the case, it was Staff's first determination to deem the property LEGALLY NON-CONFORMING. However, upon further review and consideration the decision was made to seek an official approval from the Board to deem the property LEGALLY CONFORMING through granting of a variance. If it is the Board's vote to approve the request,this will put a safeguard in place for current and any future owners. The applicant/Owner is requesting the setback be reduced to 14'. The building sits at 14.4', so this request would allow for a small margin of error. Further, it is the intent of the potential buyer, the Wylie EDC, to redevelop this area at a point in the future so a time limit could be put on the approval, if so voted. Public comment forms were mailed to sixteen (16) property owners within 200 feet of this request, as required by State Law. At the time of this posting one response was received in favor of the request. No responses against this request. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; Page 1 of 2 Page 41 of 65 Page 2 of 2 ZBOA 2015-08 or (6) Is based exclusively on findings of personal or financial hardship. The current building is a metal building and is legally non-conforming because the structure was built prior to the current Ordinance, which requires masonry exterior, was in effect. However, any expansion of non-conforming uses or structures is not allowed under Section 9.5 of the Zoning Ordinance. The applicant is asking for a limited term expansion of the existing metal structure and believes that a hardship and unique circumstance exist, not because of the property per se, but because of their use of the property. The East Fork Special Utility District, which provides water to properties in and around Wylie, uses the property and the metal structure as their offices. EFSUD area has undergone explosive growth over the last few years, while the severely restrained office in prior years left no need for expansion or plans of expansion. Bozman Farms alone has added over 400 single family lots in just the past 18 months. This situation has led to a need for quick expansion. EFSUD is looking at other properties in which to build a more permanent solution, but until such time they are asking for a variance so they can add a 1,300 square foot expansion to the current facility. The applicant has provided structural drawings and a site plan. Also included is a Site Plan (Exhibit C) for a future location on Vinson Road. CONSIDERATIONS: The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or Page 1 of 2 Page 51 of 65 Page 2 of 2 ZBOA 2015-09 (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. Public comment forms were mailed to twenty-two (22) property owners within 200 feet of this request, as required by State Law. One comment was received in favor and no comments were received in opposition at the time of this posting.
