CALL TO ORDER
The Zoning Board of Adjustment Meeting was called to order at 6:31 PM and a
quorum was present. Board Members present: Chair Linda Jourdan, Vice Chair
Jason Potts, Board Member Andre Gonzalez, Board Member Byron Betler, and
Board Member Kevin Lanier.
Staff members present were: Jasen Haskins, Senior, Planner, Kevin Molina,
Planner, and Mary Bradley, Administrative Assistant.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes of the July 9, 2018 Meeting.
A motion was made by Vice Chair Potts and seconded by Board
Member Lanier, to approve the Minutes of the July 9, 2018 Meeting.
Motion carried 5 — 0.
PUBLIC HEARINGS
Item 1 —ZBA 2018-10
Hold a public hearing to consider and act upon a request from Carol Cobble for a
variance to Section 2.5.C.2.a b & c of the Zoning Ordinance for the number of
accessory structures on a lot, the combined lot coverage of accessory structures,
and carport rear setback requirements, property located at 402 Dogwood Drive,
being Lot 20, Block 6 of the Wylwood Estates Third Installment. ZBA 2018-10
Staff Comments
Mr. Molina stated that the property is located at 402 Dogwood Drive and
is currently zoned Single Family Residential — 10/24. The applicant is

requesting three variances to the zoning ordinance to allow for the
placement of a carport.
The first variance is to increase the allowed number of accessory
structures on the lot from two to three structures. This variance would
allow for the two existing sheds to remain and the placement of a carport
that measures 22 by 26 feet. The second variance is to allow for the
combined floor area of all accessory structures to be increased from five
percent of the lot coverage to 11 percent. The third variance is to allow
the rear setback for carports to be 12 feet 1 inches from required 20 feet.
The applicant is requesting the variances due to parents moving into the
house and desiring to provide sheltered space for vehicles in inclement
weather.
Public comment forms were mailed to 28 property owners, and four
comment forms were received in favor and no responses received in
opposition of the request. Three of the property owners signed a letter
in favor of the request.
Board Discussion
Mr. Carol Cobble, 402 Dogwood Drive, applicant, stated that the garage
will be a master suite, and the carport will provide shelter for the
vehicles. Both of the existing accessory structures were constructed
prior to purchase of the property. Enclosure of the garage was approved
and almost complete, and the carport design is pending the results of
the request.
Board Members expressed concern of the number of accessory
structures in adjacent property owners, and in that some included up to
four accessory structures on one lot. Staff stated the accessory
structures may have been built prior to the current zoning ordinance and
would be classified as legally non-conforming. Any structures that are
not attached to the house are considered accessory structures.
Public Comments
Chair Jourdan opened the Public Hearing. With no one approaching the
Board Members, Chair Jourdan closed the Public Hearing.
Board Action
A motion was made by Board Member Betler, and seconded by Vice
Chair Potts, to Grant the variance to allow; three accessory structures,
the combined floor area to be 11 percent; and the rear setback to be 12
feet one inches. Motion carried 5 — 0.

Discussion
The subject property is located at 1219 Braddock way and is currently zoned under Planned Development 2005-24.
The applicant is requesting a variance to the development standards side yard setback requirement of 10%of the lot width
to be changed to 1' to allow for the placement of an attached unenclosed carport. In accordance with Ordinance 2005-24,
Section IV. 3 only a single garage door may face the street. At no time may the carport become an enclosed garage unless
the Planned Development is amended through the adoption of an ordinance.
The applicant is requesting the 1' side yard setback to allow for the placement of a carport for additional covered parking.
The applicant has stated that the homeowners association will allow for the placement of the carport pending the approval
of this variance. A similar variance was granted in February of this year for the property located 3 houses north of the
subject property. In that case the applicant was granted a side yard setback of 7'. ZBA 2018-02
Public comment forms were mailed to 13 property owners within 200 feet of this request, as required by State Law. At
the time of this posting, one response was received in favor of the request.
The Board shall not grant a variance to the development code which:
(1) Permits a land use not allowed in the zoning district in which the property is located; or
(2) Is in the public right-of-way or on public property; or
(3) Alters any definition of the development code; or
(4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements
of the development code; or
(5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably
make practicable the formulation of a general regulation to be adopted as an amendment to the development code;
or
(6) Is based exclusively on findings of personal or financial hardship.

In order to grant a variance to the development code the Board shall find that all the following have been satisfied:
(1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition
particular to the affected property;
(2) That because of these unique physical circumstances or conditions,the property cannot be reasonably developed
or used in compliance with the provisions of the development code;
(3) That due to such unique physical circumstances or conditions,the strict application of the development code
would create a demonstrated hardship;
(4) That the demonstrable hardship is not self-imposed;
(5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or
neighborhood;
(6) That the variance, if granted will not change the character of the zoning district in which the property is located;
(7) That the variance, if granted is in keeping with the intent of the development code; and
(8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie.

HOA Architectural Control Committee (ACC), as required by the governing documents
for Braddock Place Estates HOA. We are pleased to let you know that your request has been
approved by the Committee per the following provision(s):
The carport is approved with the following conditions. These conditions must be
met:
1. The carport MUST NOT EXTEND PAST THE FRONT EDGE of the existing
single car garage.
2. ONLY an automobile or truck (not in excess of one ton carrying capacity) is
allowed to be stored under the carport.
3. The structure must comply with all City of Wylie's setback requirements and
restrictions.
4. The homeowner is responsible for any drainage issue arising on the adjoining
neighbor's properties due to the addition of the carport structure.
This approval is valid for one year from this date. Please remember that you are responsible
for obtaining any and all required permits from the City of Wylie for this project, and that
