Staff Presentation Mr. Haskins stated that the applicant is proposing to add equipment to an existing waste water treatment plant on a single lot consisting of 50.322 acres. The applicant is proposing two generators, a bio filter, and the concrete drives to facilitate access. Fire has reviewed the plans and approved of the placement and design of the access drives. Upon completion of installation of the equipment, a final report will be presented that will show that the residential adjacency standards for noise is met. Discussion Impact Fees are authorized under Chapter 395 of the Texas Local Government Code and are defined as a charge imposed against new development to pay for the off-site construction or expansion of infrastructure facilities that are necessitated by and benefit the new development. Roadway Impact Fees are specifically for roadway improvement projects necessary to reduce congestion and provide for efficient travel to accommodate new growth. Legislatively, Roadway Impact Fees may only consider arterial and collector status roads on the City's official Thoroughfare Plan. Statutory requirements mandate that impact fees be based on a specific list of improvements identified in the Capital Improvements Plan (CIP) and must be updated at least every 5 years. Only the cost attributed (and necessitated) by new growth over a ten-year period may be considered. In order to assess appropriate Roadway Impact Fees, the City has asked Birkhoff, Hendricks & Carter LLP to perform an update to the CIP and Thoroughfare Plan. Local Government Code Section 213.003 outlines a procedure for the Planning and Zoning Commission to review Comprehensive Plan documents. Approval of a revised Thoroughfare Plan will provide direction for the CIP update, and ultimately assist in completing an Impact Fee analysis. City staff is looking to the Planning and Zoning Commission to review and recommend approval of the proposed Thoroughfare Plan to the City Council. This document was presented to City Council for comments on October 23, 2018 and November 13, 2018 and recommended changes have been made.
