Board Members present: Chair Linda Jourdan, Vice Chair Jason Potts, Board Member Andre Gonzalez, Board Member Byron Betler, and Board Member Kevin Lanier. Staff members present were: Renae' 011ie, Planning Director, Jasen Haskins, Senior, Planner, Kevin Molina, Planner, and Mary Bradley, Administrative Assistant. CONSENT ITEMS 1. Consider and act upon approval of the Minutes of the August 20, 2018 Meeting. A motion was made by Vice Chair Potts and seconded by Board Member Gonzalez, to approve the Minutes of the August 20, 2018 Meeting. Motion carried 5—0. PUBLIC HEARINGS Item 1 —ZBA 2018-11 Hold a public hearing to consider and act upon a request from Robert Radowick for a variance to Section 4.2.8 of PD 2005-24, to change the side setback from being 10% of the lot width to 1' to allow for the placement of an attached unenclosed carport on a property located at 1219 Braddock Way, Lot 1 Block A of the Braddock Place Phase I Addition. ZBA 2018-11 Staff Comments Mr. Molina stated that the property is located at 1219 Braddock Way and is zoned Planned Development 2005-24. The variance request is to the side setback from being 10 percent of the lot width to one for the placement of an unenclosed carport. The applicant desires to extend the roof to match the existing structure. When the property was developed, concrete was poured for parking. The applicant intends to construct a carport for covering. The carport may not become an enclosed garage unless the Planned Development is amended through the adoption of an ordinance. Minutes October 22, 2018 Wylie Zoning Board of Adjustment Page 1 of 2 Mr. Molina stated that the applicant received a letter from the Homeowners Association, stating that an approval is based upon approval from the City of Wylie. Comment forms were mailed to 13 property owners and two responses were received in favor of the request. One response was submitted at the meeting from the adjacent neighbor. No responses received in opposition of the request. Board Discussion Board Members questioned the purpose of the carport. Mr. Robert Radowick, 1219 Braddock Way, applicant, stated that his pickup truck does not fit inside the garage, and desires covering for inclement weather. Mr. Radowick further described the construction of the carport, stating that the roof will extend to the end of existing concrete. The concrete posts will be three foot outside the concrete. The gutters will go around the carport and the down spot will be on the driveway. Public Comments Chair Jourdan opened the Public Hearing. With no one approaching the Board Members, Chair Jourdan closed the Public Hearing. Board Action A motion was made by Board Member Betler, and seconded by Board Member Lanier, to Grant the variance to allow the side setback to one feet for the placement of an attached unenclosed carport. ZBA 2019-01 Discussion The subject property is located at 611 Walton Way and is currently zoned Multi-Family and has been platted as The Village Addition since 2003 for Single-Family Attached development. The dwelling was constructed by Choice Homes in 2004. The subject lot sits a little more than 200 feet from the primary entrance into the subdivision. The purpose of the request is to allow the applicant to subdivide Lot 1 into two separate lots in order to construct an additional dwelling unit on the west side of the existing structures. The applicant is requesting a variance to the development standards requiring a lot width of a minimum of 30 feet and a minimum lot size of 3,000 square feet for interior lots. The current dwelling is approximately 40 feet from the west property line (Stephanie Street). The new dwelling would be 15 feet from Stephanie Street and 25 feet from Walton Way. Replatting the lot into two lots would leave only 20 feet in lieu of 30 feet for the lot width and 2,500 square feet in lieu of the required 3.000 square feet for an interior lot. In accordance with the City's Thoroughfare Driveway Standards, driveways that intersect at 90 degrees must be located a minimum of 30 feet from a secondary street's end of curb radius. Based on the conceptual layout submitted, this requirement would not be met for a driveway approach on Walton Way for the new dwelling. Summary of Variance Requested: 1. Less than 30 feet Interior lot width 2. Less than 3,000 square feet interior lot size 3. Less than 45 feet Corner lot Public comment forms were mailed to 35 property owners within 200 feet of this request, as required by State Law. No forms were returned at the time of this posting, for or against the request. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or Page 1 of 2 Page 2 of 2 (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions,the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions,the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. Final Plans and details would be subject to Engineering review and approval. A Replat would also be required for consideration by Planning and Zoning Commission and City Council prior to the submission of building/construction plans.
