INVOCATION & PLEDGE OF ALLEGIANCE Commissioner Alexander gave the invocation and Commissioner Hemphill led the pledge of allegiance. CITIZEN PARTICIPATION No one appeared to speak to the Commissioners. CONSENT AGENDA 1. Consider and act upon approval of the Minutes from the December 6, 2005 Regular Meeting. A motion was made by Commissioner Ames, and seconded by Commissioner Hemphill, to approve the minutes as submitted. Motion carried 3 — 0, with Commissioners Alexander, and Gregg abstaining and Commissioners Byboth and Hennesey absent. P & Z Commission Meeting December 20, 2005 Page 2 of 3 ACTION AGENDA 1. Consider and act upon approval of a Site Plan for Wylie High School No. 2, generally located north of Brown Street and west of Bennett Road (C.R. No. 434, and more specifically described as a tract of land situated in the Francisco De La Pina Survey, Abstract No. 688, City of Wylie, Collin County, and being all of land conveyed to the Wylie I.S.D. by deed recorded in Collin County Clerk's File No. 2005-0041831. Ms. 011ie stated that the applicant is proposing a High School on one lot totaling 63.550 acres. The subject property was rezoned to Agriculture District(A/28)in April of 2005. The proposed High School will not be accessible from Bennett Road. Access to the site will be from Brown Street which connects to a 100-foot right-of-way platted with the subject property. The Preliminary Plat is on the agenda for consideration. Ronny Klingbeil, RLK Engineering, 111 West Main Street, Allen, represented the Engineer for the subject property, stated that a four-lane divided roadway will be built on the western side of the property, with an 11 to 12 foot parkway, and a signal light is planned at this intersection. The intent is to leave the existing trees intact on the north side of Bennett Road. The intent is to create a Ninth Grade facilities initially and in a couple of years convert to a High School facility. A motion was made by Commissioner Hemphill, and seconded by Commissioner Alexander, to approve the Site Plan for Wylie High School No. 2, generally located north of Brown Street and west of Bennett Road (C.R. No. 434), and more specifically described as a tract of land situated in the Francisco De La Pina Survey, Abstract No. 688, City of Wylie, Collin County. Motion carried 5 — 0, with Commissioners Hennesey and Byboth being absent. 2. Consider a recommendation to the City Council regarding a Preliminary Plat for Wylie High School No. 2, generally located north of Brown Street and west of Bennett Road (C.R. Motion carried 5 — 0, with Commissioners Byboth and Hennesey being absent. MISCELLANEOUS 1. Distribute the amendments to Articles 3 and 4 and 5 of the Zoning Ordinance. Ms. 011ie stated that a Public Hearing will be held on January 3, 2006, for Planning and Zoning and January 24, 2006, for City Council to consider the amendments submitted. STAFF RECOMMENDATION: Approval SUMMARY: The Preliminary Plat under consideration will create two lots. Lot 1 is 0.13 acres (5,668 sq. ft.) in size, and lot 2 is 0.44 acres (19,190 sq. ft.). There is an existing 1,648 sq. ft. brick building on Lot 1, and an existing restaurant (Subway) on Lot 2. The property is zoned Commercial Corridor(CC)District and has never been platted. A Cross Easement Agreement is recorded with the Collin County Clerk for the subject property and the adjacent property to the northeast(Hibernia National Bank). STAFF RECOMMENDATION: Approval SUMMARY: The Final Plat for the Sage Creek 9A Addition includes 8.313 acres and will create 35 single-family residential lots. The City Council approved a zoning case to rezone the subject property from Agriculture (A) to Planned Development (PD) District for single-family residential uses in August of 2005. Minimum lot size approved by the PD is 8,400 square feet. The Final Plat substantially conforms to the approved Conditions of the Planned Development District and Development Plan. The temporary cul-de-sac at the south end of Preston Lane will be abandoned by the filing of the Final Plat for Phase IXA. As a Condition of the PD, a road must be provided through Phase 8 to connect these phases to Riverway Lane to provide additional points of access/egress. Commercial uses have already developed at this intersection of two regional thoroughfares, although none as yet within the City of Wylie corporate limits. Parker Road will be realigned at some future date to remove the existing off-set jog, most likely by the extension of the western segment across Country Club. STAFF RECOMMENDATION: Forward recommendation of appropriate revisions to City Council for Council public hearing scheduled for January 10, 2006. Staff believes that the attached drafts reflect the direction provided by the Commission. SUMMARY: On May 24, 2005 the City Council adopted the revisions to the Comprehensive Plan, and these revisions to the Plan dictate the need for corresponding revisions to the Zoning Ordinance. At the September 20 meeting, the Commission finalized the draft recommendations and called a public hearing to receive citizen comments on Articles 3 and 4. On October 4, 2005 the Commission recommended approval of the proposed revisions to Articles 3 and 4. Notices of the public hearings by the Commission and Council were mailed to all postal addresses within the Wylie zip code as well as published in the Wylie News. No written comments were received from the public at the time of posting. APPROVED BY: Initial Date Department Director: MM \ 12/28/05 1 AGENDA SUBJECT: Hold a public hearing and consider a recommendation to the City Council concerning certain revisions to the Use Regulations in Article 5 of the Zoning Ordinance and to the City-Wide Zoning Map. SUMMARY (Continued): The previously approved revisions to Article 3 Residential Standards and Article 4 Non-Residential Standards established several new zoning districts and deleted others, as well as created some changes in both the base and desirable design requirements. With the creation and deletion of these zoning categories, Article 5 Use Regulations/Chart has been amended (see attached) to reflect such new categories in an effort to allow staff to enforce and administer the ordinance. The lot size for all new residential development has been established at 10,000 square feet, 30,000 sq. ft. or 1 acre, and dwelling sizes have been increased for all new lots to 2,400 sq. ft, 2,600 sq. ft. and 3,000 sq. ft. respectively. The Base development requirements for new residential uses have been significantly strengthened, and the flexible system of Desirable value-added choices has been modified. Nonresidential districts have been modified to convert the Business Center (BC) District to Light Industrial, with reduced setbacks which conform to the existing platting patterns of these older areas. The development requirements for nonresidential uses remain largely as currently-adopted except for increased landscaping. Previously zoned Industrial districts are now classified as Heavy Industrial District. The City-wide Zoning Map will be revised to reflect the reduced number of residential districts indicating the new minimum size of SF-10. Light and Heavy Industrial Districts will also be added to the Zoning Map. Properties that are already platted will continue to comply with the dimensional regulations (lot size, dwelling size and setbacks) which were in force when that property was platted, but must comply fully to the proposed use regulations.
