Chair Linda Jourdan called the meeting to order at 6:30 and announced the presence of a quorum. Board Members in attendance; Vice Chair Jason Potts, Board Member Byron Betler, Board Member Andres Gonzalez and Board Member Lisa Shields. Staff present were Mr. Jasen Haskins, Planning Manager, Mr. Kevin Molina, Senior Planner and Ms. Mary Bradley,Administrative Assistant. REGULAR AGENDA Public Hearing Minutes May 20,2019 Zoning Board of Adjustment Page 1 1. Hold a public hearing to consider and act upon a request from Terry Willis for a variance to Section 3.2.B.4.b of the Zoning Ordinance, to change the allowed rear setback of a non-enclosed patio from being 10 feet to 5 feet to allow for the placement of an unenclosed patio on a property located at 111 Autumn Sage, Lot 35 Block G of the Dominion of Pleasant Valley Phase 1. ZBA 2019-06 Staff Comments Mr. Molina stated that the property is located at 111 Autumn Sage within the Dominion of Pleasant Valley Phase I Addition. The property is zoned Planned Development Ordinance 2017- 31. The applicant is requesting a variance to the zoning ordinance to allow for the placement of an unenclosed patio that is five feet away from the rear property line. The proposed unenclosed patio has dimensions of 22 by 16 and measures 352 square feet. The Planned Development Ordinance 2017-31 does not address patio covers The purpose of the request is due to wanting additional privacy from the rear neighbor in close proximity to rear year. The patio will provide additional screening. Public Comment Fauns were mailed to 32 property owners within 200 feet. One comment foiin was received in favor and no comment forms received in opposition of the request. Board Discussion Mr. and Mrs. Terry Willis, owner/applicant for the subject property, approached the Board Members, stating that their property is at the corner of Autumn Sage and Red Bud Pass. The property is 3,723 square feet and the property behind theirs is 4,065 square feet, and runs along the entire back of their property. The desire is to have additional screening, by constructing an 11 to 14 feet patio cover. The Homeowners Association did approve based upon the approval from the City of Wylie for an unenclosed patio. The work has not started. Board Comments Chair Jourdan opened the Public Hearing. With no one approaching the Board, Chair Jourdan closed the Public Hearing. Board Action A motion was made by Board Member Gonzalez, and seconded by Board Member Betler to Grant the variance to Section 3.2.B.4.b of the Zoning Ordinance, to allow five feet rear setback for a non-enclosed patio. The property being located at 111 Autumn Sage, being Lot 35 Block G of the Dominion of Pleasant Valley Phase I Addition. A vote was taken and carried 5 - 0. 2. Hold a public hearing to consider and act upon a request from Ed Pate for a variance to Section 22-447.4 of the sign ordinance, to increase the maximum square footage of windows signs from 25% per window panel to a maximum of 100% per window panel. The property is located at 2014 N Hwy 78, Suite 170, Lot 1R-3R2R, Block C of the Woodlake Village. ZBA 2019-07 Minutes May 20,2019 Zoning Board of Adjustment Page 2 Staff Comments Mr. Molina stated that the property is located at 2014 North Highway 78, Suite 170 and is currently zoned Commercial Corridor. The use is an automotive repair shop, which is an allowed use within Commercial Corridor. The applicant is requesting a variance to the sign ordinance to allow for up to 100 percent of the window panels cover in lieu of the maximum square footage of 25 percent per window panel. The applicant is requesting a variance for window signage, stating that the window signs will provide screening and prevent theft. Mr. Molina stated that the applicant has installed the signs, and received a letter from Code Enforcement, because there was no permit issued. The purpose of the maximum square footage in the sign ordinance is to prevent distraction to drivers. Public comment forms were mailed to seven property owners within 200 feet. One response received in favor and no responses received in opposition of the request. Board Discussion Mr. Ed Pate, Operations Manager, Integrity 15L Automotive, 2014 N Highway 78, Suite 170,the applicant, stated that their facility does not face Highway 78 and is located to the rear of the building. He did not want to install shades or window tinting. The signs have been installed for about three months. Board Comments Chair Jourdan opened the Public Hearing. With no one approaching the Board, Chair Jourdan closed the Public Hearing. Board Action A motion was made by Board Member Betler, and seconded by Board Member Gonzalez, to Deny the request for a variance to Section 22-447.4 of the Sign Ordinance. ZBA 2019-08 Discussion The subject property is located at 1205 Cedar Point and is currently zoned under Planned Development 2005-24. The applicant is requesting a variance to the development standards side yard setback requirement of 10% of the lot width to be changed to 3' to allow for the placement of an unenclosed carport. The applicant is requesting the 3' side yard setback to allow for the placement of a carport for additional covered parking. Since 2018 there have been three similar variances granted to homeowners in this subdivision. Case 2018-02 at 1213 Braddock Way was granted approval to have a carport at a 7' side yard setback, case 2018-11 at 1219 Braddock Way was granted approval to have a carport at a 1' side yard setback and case 2019-04 1702 Timber Falls Lane was granted approval to have a carport at a 2' side yard setback. The applicant's reason for wanting to install the carport is to allow for him to protect his truck and sail boat from the possibility of hail damage. The applicant has stated that his truck does not fit in his garage. The carport is being requested to be 3' away from the side yard. The homeowner is aware that the sailboat is to be placed behind the existing fence and be required to be parked on an impervious surface. The carport measures 12' X 48'and will be attached to the existing house. The home adjacent to the carport will be approximately 38' away from the carport. In accordance with Ordinance 2005-24, Section IV.3, only a single garage door may face the street. At no time may the carport become an enclosed garage unless the Planned Development is amended through the adoption of an ordinance. Public comment forms were mailed to 10 property owners within 200 feet of this request, as required by State Law. At the time of this posting, one response was received in opposition and two responses were returned favoring the request. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or Page 1 of 2 Page 2 of 2 ZBOA 2019-08 (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. ZBA 2019-09 Discussion The subject property is located at 3000 Wylie East Drive and is currently zoned Agricultural District(AG/30). The applicant was granted a variance on May 21, 2012 to allow for a 30' front yard setback in lieu of the required 50' setback from Section 3.I.a(3)for an expansion of the school. The applicant has now requested for a variance to reduce the front yard setback from 30' to 25'. The applicant is requesting this variance of 5' as Wylie East High School is being planned to be expanded by 160,000 sf to accommodate the upcoming growth of the student body. Approval of this variance will allow Wylie ISD to grow to a capacity of 3,100 students and accommodate the necessary classroom additions needed per Texas Education Agency standards. The applicant has provided a site plan showing the proposed changes. A hardship could exist due to the zoning of the property being AG/30. Schools are allowed in any zoned property in the City of Wylie and are not usually required to be rezoned prior to development. Had the property been zoned commercial or residential the front setbacks would have been set at 25' and a variance would not have been required. Public comment forms were mailed to fifty-six (56)property owners within 200 feet of this request, as required by State Law. At the time of this posting there was one response in favor of the variance proposal. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. Page 1 of 2 Page 2 of 2 ZBOA 2019-09 In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie.
