08-20-2019 (Planning & Zoning) Minutes %A,/ - V N Planning & Zoning Commission CITY OF WYLIE Minutes Regular Meeting August 20,2019—6:00 p.m. Wylie Municipal Complex—Council Chambers 300 Country Club Road,Bldg. 100 Wylie,TX 75098 CALL TO ORDER Announce the presence of a Quorum. Chair Ron Smith presided the meeting and called the meeting to order at 6:00PM. Commissioners present: Chair Ron Smith, Vice Chair Randy Owens, Commissioner Cory Plunk, and Commissioner Charla Riner. Those absent: Commissioner Bryan Rogers and Commissioner Brad Emerson. Commissioner Mike McCrossin arrived late Staff present: Mr. Jasen Haskins, Planning Manager, Mr. Kevin Molina, Senior Planner, and Ms. Mary Bradley, Administrative Assistant. INVOCATION & PLEDGE OF ALLEGIANCE Commissioner Plunk gave the invocation and Commissioner Riner led the Pledge of Allegiance. CITIZENS COMMENTS ON NON-AGENDA ITEMS Residents may address Commissioners regarding an item that not listed on the Agenda. Residents must fill out a non-agenda form prior to the meeting in order to speak. Commissioners requests that comments be limited to three (3)minutes. In addition, Commissioners not allowed to converse,deliberate or take action on any matter presented during citizen participation No one approached the Commissioners. CONSENT AGENDA A. Consider and act upon approval of the Minutes from August 6,2019,Regular Meeting. Commission Action A motion was made by Commissioner Plunk, seconded by Vice Chair Owens, to approve the Minutes from August 6, 2019 meeting, as presented. A vote was taken and the motion carried 4- 0.4 0. REGULAR AGENDA Minutes August 20,2019 Planning&Zoning Page 1 1. Consider, and act upon, a recommendation to the City Council regarding a Final Plat for Lake Park Villas to allow for 72 Residential and four open space lots on 12.284 acres, generally located at the northeast corner of Troy Road and Vinson Road. Staff Comments Mr. Molina stated that the plat is a portion of the Lake Park Villas preliminary plat approved in May of 2017. The plat consists of 72 residential and four open space lots. All of the open space lots are to be owned and maintained by the subdivisions HOA. Mr. Jay Marsh, Kimley-Horn, 6160 Warren Parkway, Suite 210, Frisco, applicant for the subject property approached the Commissioners and stated that the property is located adjacent to Vinson and the plat dedicates 50 feet of right-of-way to widen Vinson Road. Commissioners Action A motion was made by Commissioner McCrossin, and seconded by Commissioner Riner, to recommend approval to the City Council regarding a Final Plat for Lake Park Villas to allow for 72 Residential and four open space lots on 12.284 acres, generally located at the northeast corner of Troy Road and Vinson Road. A vote was taken and carried 5—0. Public Hearing 1. Hold a Public Hearing to consider, and act upon, a recommendation to the City Council repealing and adopting regulations to Zoning Ordinance (2001-48) Article 6, Section 6.1 Planned Development Districts, Zoning Ordinance (2008-27) Article 8 Section 8.1 Zoning Related Applications, and to the Subdivision Regulations (2007- 21)Sections 2.2, 2.3,and 2.4 Procedures and Approval. ZC 2019-12. Staff Comments Mr. Haskins stated that with the close of the 86th Legislature Regular Session many changes have a direct impact on municipalities. Based upon the work sessions held on August 6, 2019 with Planning and Zoning and August 13, 2019 with City Council, listed below are the recommendations from Staff on House Bill 2439, House Bill 2840 and House Bill 3167. On House Bill 2439; No changes will be made to the Zoning Ordinance or Subdivision Regulations in regards to building materials. A Resolution will be considered by the City Council on August 27, 2019 meeting to declare all relevant Planned Developments, Specific Use Permits and zoning cases as historically, culturally, or architecturally significant. Staff is also researching other ordinance and regulation options in lieu of building materials, such as architectural element and will present recommendation when the work is complete. f ' Minutes August 20,2019 Planning&Zoning Page 2 On House Bill 2840; staff is awaiting City Council Rules of Procedure and will prepare a recommended update to the Planning and Zoning Commission, On House Bill 3167; staff is making the recommended changes to Articles 6.1, 8,1 of the Zoning Ordinance. Revisions will also be made to Sections 2.2 and 2.4 of the Subdivision Regulations. Public Comments Chair Smith opened the Public Hearing, With no one approaching the Commissioners, Chair Smith closed the Public Hearing.
