10-01-2019 (Planning & Zoning) Minutes IA® Planning & Zoning Commission CITY OF WYLIE Minutes Regular Meeting October 1, 2019—6:00 p.m. Wylie Municipal Complex—Council Chambers 300 Country Club Road,Bldg. 100 • Wylie, TX 75098 CALL TO ORDER Announce the presence of a Quorum. Chair Ron Smith presided the meeting and called the meeting to order at 6:02PM. Commissioners present: Chair Ron Smith,Vice Chair Randy Owens,Commissioner Bryan Rogers,Commissioner Mike McCrossin, and Commissioner Charla Riner. Those absent: Commissioner Cory Plunk and Commissioner Brad Emerson. Staff present: Mr. Jasen Haskins, Planning Manager, and Mr. Kevin Molina, Senior Planner. INVOCATION & PLEDGE OF ALLEGIANCE Commissioner McCrossin gave the invocation and Commissioner Riner led the Pledge of Allegiance. CITIZENS COMMENTS ON NON-AGENDA ITEMS Residents may address Commissioners regarding an item that not listed on the Agenda. Residents must fill out a non-agenda form prior to the meeting in order to speak. Commissioners requests that comments be limited to three (3)minutes. In addition, Commissioners not allowed to converse, deliberate or take action on any matter presented during citizen participation No one approached the Commissioners. CONSENT AGENDA A. Consider and act upon approval of the Minutes from September 17, 2019, Regular Meeting. Commission Action A motion was made by Commissioner McCrossin,seconded by Commissioner Rogers, to approve ^ the Minutes from September 17, 2019 meeting, as presented. A vote was taken and the motion carried 5-0. Minutes October I, 2019 Planning&Zoning Page 1 PUBLIC HEARING 1. Hold a Public Hearing to consider, and act upon, a recommendation to City Council .1 regarding an amendment to the City of Wylie Zoning Ordinance (2006-04), Section 5.1 (Land Use Charts) and Section 5.2 (Listed Uses) as they relate to allowed uses within the Neighborhood Services (NS) Zoning District. ZC 2019-13. Staff Comments Mr. Haskins stated that on August 13, 2019, Council and planning staff held a work session regarding Multi-Family and Single-Family Attached Dwelling uses allowed within Neighborhood Services. Council directed staff to examine the possibility of removing those uses from the Neighborhood Service District. Staff has determined that NS districts generally focus on non- residential uses and emphasize commercial components. Additionally, surrounding cities do not allow multi-family uses in NS District. Furthermore, the NS District was created by Zoning Ordinance in 2001, with the Village Center Concept. In 2006 the Zoning Ordinance was amended removing the Village Center Concept. Staff mailed notifications to approximately 400 citizens that reside or have property near NS zoning districts, and received responses overwhelmingly indicating support of an amendment removing multi-family uses from NS. The proposed text amendment removes Multifamily Dwelling, Single-Family Attached Dwelling, and Assisted Living as allowed uses. The Boarding or Rooming House would now require a Specific Use Permit. Lastly, references to those uses in the 'additional provisions' sections are removed, as those uses are no longer allowed within the NS District. Public Comments Chair Smith opened the Public Hearing. Ms. Lillian Pinkus, 1300 Brown Street, questioned the purpose of the change and type of uses allowed within NS. Staff offered a couple of options for the uses allowed by right; such as, group home, retail shopping center, financial institution, medical office and mostly light commercial uses. The purpose of the request is a couple of Council Members requested staff to examine, but were in favor of removing, the Multifamily Dwelling and Single-Family Dwelling as an allowed use by right. Chair Smith closed the Public Hearing. Commissioners Action A motion was made by Vice Chair Owens, and seconded by Commissioner McCrossin, to recommend approval to the City Council regarding an amendment to the City of Wylie Zoning Ordinance (2006-04), Section 5.1 (Land Use Charts) and Section 5.2 (Listed Uses) as they relate to allowed uses within the Neighborhood Services (NS) Zoning District ZC 2019-13.
