06-17-2019 (Zoning Board of Adjustment) Minutes Zoning Board of Adjustment CITY OF WYLIE Minutes Regular Meeting June 17,2019—6:30 p.m. Wylie Municipal Complex—Council Chambers 300 Country Club Road,Bldg. 100 Wylie,TX 75098 CALL TO ORDER Announce the presence of a Quorum. Chair Linda Jourdan called the meeting to order at 6:30 and announced the presence of a quorum. Board Members in attendance; Board Member Byron Betler, Board Member Andres Gonzalez and Board Member Lisa Shields.Board Members absent: Vice Chair Jason Potts and Board Member Robert Blair. Staff present were Mr. Jasen Haskins, Planning Manager, Mr. Kevin Molina, Senior Planner and Ms. Mary Bradley,Administrative Assistant. 0.0 CITIZENS COMMENTS ON NON-AGENDA ITEMS Residents may address Board regarding an item that is not listed on the Agenda. Residents must fill out a non- agenda form prior to the meeting in order to speak. The Board requests that comments be limited to three (3) minutes. In addition, Board is not allowed to converse, deliberate, or take action on any matter presented during citizen participation. No citizens present to address the Board. CONSENT AGENDA All matters listed under the Consent Agenda are considered to be routine by the Board and will be enacted by one motion. There will not be separate discussion of these items. If discussion is desired, that item will be removed from the Consent Agenda and will be considered separately. A. Consider and act upon approval of the Minutes for the May 20,2019 Meeting. Board Action A motion was made by Board Member Shields, and seconded by Board Member Betler, to approve the minutes as submitted.A vote was taken and carried 4—0. REGULAR AGENDA Public Hearing 1. Hold a public hearing to consider and act upon a request from Jimmy Clark Sutton for a variance to Section 4.2.8 of PD 2005-24, to change the side setback from being Minutes June 17,2019 Zoning Board of Adjustment Page 1 10% of the lot width to 3' to allow for the placement of an unenclosed carport on a property located at 1205 Cedar Point, Lot 10 Block B of the Braddock Place Phase I Addition. ZBA 2019-08 n Staff Comments Mr. Molina stated that the property is located at 1205 Cedar Point in the Braddock Place Addition. The property is zoned Planned Development Ordinance 2005-24. The development standards requires a side yard setback of 10% of the lot width. The applicant is requesting a three feet side yard setback for the placement of a carport. The purpose of the carport is to allow protection from truck and a sailboat.The homeowner is aware that the sailboat is to be placed behind the existing fence and parked on an impervious surface. The carport measures 12 feet by 48 feet and will be attached to the existing house. The home adjacent to the carport will be approximately 38 feet away from the carport. Public Comment Forms were mailed to 10 property owners within 200 feet. Four comment forms were returned, two in favor and two in opposition of the request. Board Discussion Mr. J. Clark Sutton, 1205 Cedar Point, applicant, stated that the Homeowners Association is still reviewing the request for a carport. The intention of the carport is to protect his vehicles from hail damage. He stated that the sailboat has been in the backyard for nine years, parked on gravel. The carport would go from beside the garage all the way to the back yard, being one r� structure. Board Comments Chair Jourdan opened the Public Hearing. Ms. Marilyn Morgan, 511 Sun Meadow, spoke in opposition of the carport. Chair Jourdan closed the Public Hearing. Board Action A motion was made by Board Member Shields made a motion to grant the variance to Section 4.2.8 of PD 2005-24, to change the side setback from being 10% of the lot width to 3' to allow for the placement of an unenclosed carport on a property located at 1205 Cedar Point, Lot 10 Block B of the Braddock Place Phase I Addition. The motion died for the lack of a second. Due to lack of a motion for approval, the request was denied. The property is located 1205 Cedar Point,being Lot 10,Block B of the Braddock Place Phase I Addition. 2. Hold a public hearing to consider and act upon a request from Wylie ISD for a variance to Section 3.1.a (3) Development Standards of the Zoning Ordinance for Agricultural A/30 zoned properties required a minimum 50 feet front yard setback, Minutes June 17,2019 Zoning Board of Adjustment Page 2 property located at 3000 Wylie East Drive, being Lot 1, Block A of the Wylie East High School. ZBA 2019-09 Staff Comments Mr. Molina stated that the property is located at 3000 Wylie East Drive and is currently zoned Agricultural District(AG/30). Zoning within Agricultural requires a 50 feet front yard setback. In May 2012,the applicant received a variance to allow a 30 feet front yard setback.The applicant is now requesting a variance to reduce the front yard setback from 30 feet to 25 feet. Schools are allowed in any district, if the property was zoned commercial or residential, the requirement for front yard setback is 25 feet and a variance would not be required. Public comment forms were mailed to 56 property owners within 200 feet. One response was received in favor of the request. Board Discussion Board Members questioned the purpose of the variance. Staff stated that the applicant desires to expand by 160,000 square feet to accommodate the upcoming growth to the student body. Approval of the variance will allow Wylie East High School to grow to a capacity of 3,100 students and accommodate the necessary classroom additions needed per Texas Education Agency standards. Board Comments Chair Jourdan opened the Public Hearing. Mr. Derrick Gaither, 3408 Endicott Court, spoke in favor of the request and asked for additional clarification of the expansion. Staff stated that the expansion was on vacant land, and does not affect the required landscaping. Chair Jourdan closed the Public Hearing. Board Action A motion was made by Board Member Gonzalez, and seconded by Board Member Betler, to Grant the request for a variance to Section 3.1.a (3) Development Standards of the Zoning Ordinance for Agricultural A/30 zoned properties to allow a 25 feet front yard setback in lieu of the required 50 feet front yard setback. The property is located at 3000 Wylie East Drive, being Lot 1, Block A of the Wylie East High School.
