Ordinance 2020-111 1 1 ORDINANCE NO. 2020-11 AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF WYLIE, AS HERETOFORE AMENDED, SO AS TO CHANGE THE ZONING ON THE HEREINAFTER DESCRIBED PROPERTY, ZONING CASE NUMBER 2019-14, FROM COMMUNITY RETAIL (CR) TO PLANNED DEVELOPMENT COMMUNITY RETAIL (PD-CR) TO ALLOW FOR A CHURCH/ HOUSE OF WORSHIP; PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission and the governing body of the City of Wylie, Texas, in compliance with the laws of the State of Texas with reference to the amendment of the Comprehensive Zoning Ordinance, have given the requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally and to owners of the affected property, the governing body of the City is of the opinion and finds that the Comprehensive Zoning Ordinance and Map should be amended; NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: That the Comprehensive Zoning Ordinance of the City of Wylie, Texas, be, and the same is hereby, amended by amending the Zoning Map of the City of Wylie, to give the hereinafter described property a new zoning classification of Planned Development - Community Retail (PD-CR), said property being described in Exhibit A (Legal Description), hereto and made a part hereof for all purposes. SECTION 2: That Planned Development Conditions and a Zoning Exhibit are an integral component of the development of the property and are attached as Exhibits B and C, respectively. SECTION 3: That all ordinances of the City in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 4: That the above described property shall be used only in the manner and for the purposes provided for in the Comprehensive Zoning Ordinance of the City, as amended herein by the granting of this zoning classification. SECTION 5: Any person, firm or corporation violating any of the provisions of this ordinance or the Comprehensive Zoning Ordinance, as amended hereby, commits an unlawful act and shall be subject to the general penalty provisions of Section 1.5 of the Zoning Ordinance, as the same now exists or is hereafter amended. Ordinance No. 2020-11 - Change the Zoning on the Hereinafter Described Property, Zoning Case Number 2019-14, From Community Retail (CR) to Planned Development Community Retail (PD-CR) to Allow for a Church/ House of Worship SECTION 6: Should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part so declared to be invalid, illegal or unconstitutional, and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 7: This ordinance shall be in full force and effect from and after its adoption by the City Council and publication of its caption as the law and the City Charter provide in such cases. SECTION 8: The repeal of any ordinance, or parts thereof, by the enactment of this Ordinance, shall not be construed as abandoning any action now pending under or by virtue of such ordinance; nor shall it have the effect of discontinuing, abating, modifying or altering any penalty accruing or to accrue, nor as effecting any rights of the municipality under any section or provisions of any ordinances at the time of passage of this ordinance. PURPOSE: The purpose of this Planned Development (PD) District is to allow for a Church to occupy the existing premises under the Community Retail (CR) Zoning District with the following General and Special Conditions. II. GENERAL CONDITIONS 1. This Planned Development District shall not effect any regulations within the Zoning Ordinance or Code of Ordinances, current or as amended, except as specifically provided herein. 2. All regulations of the Community Retail (CR) District as set forth in Article 4, Section 4.1 B of the Zoning Ordinance (adopted as of September, 2019) are included by reference and shall apply herein. 3. The conditions of this Planned Development revert to the baseline Community Retail Zoning Development Standards if Northplace Church or any other church ceases to own or occupy the subject property. III. SPECIAL CONDITIONS 1. A reduction in the typical ordinary parking stall dimensions from 10'x20' to 9'x20'. Handicap spaces shall comply with the Ordinance. 2. Parking space count to exceed the maximum allowable. The current requirement is for 166 spaces minimum and 207 maximum. The proposed count shall not be more that 270 spaces. 3. A reduction in the required Landscape Area required from the current standard of 20% of the Site being 208,561 sf x 20% = 41,713 sf. A minimum of 33,000 sf shall be required representing 15.8% of the Site generally in accordance with the attached PD Landscape Concept Plan. 4. No 4' meandering sidewalk along SH 78 shall be required. 5. Site Design Requirements The project complies with all of the site design requirements base standard as well as the following four of eight desirables: 1. Front Facade oriented to the street. 2. Combined access points with adjacent Tracts. 3. Direct connection between buildings and street. 4. Service area (dumpster) not visible from public street but masonry screening is provided. 1 1 1 1 1 1 6. Comply with three of four required Landscape Design desirable elements as follows: 1. Landscaping in side and rear yard not otherwise required. 2. Landscaping 10% or more in excess of 50 sf/ parking space. 266x50=13,300 x 1.1=14,630 sf required to meet desirable. 3. Increase in minimum width of Landscape Buffer along SH-78 by 20% 10' x 1.2=12' required to meet desirable. Approximately 29' provided 7. Architectural Design Requirements The project complies with all of the Architectural design requirements base standard as well as the following three of six desirables: 1. Use of two complementary primary facade materials to help achieve facade circulation, visual variety, and/or architectural detailing. 2. Copy same style entire block. 3. Use of architectural detailing and/or materials to provide variety in visual appearance. 8. All in accordance with the attached Exhibit A1.00 Architectural Site Plan, dated 10/18 2019, and Exhibit L1.00 PD Landscape Concept Plan, dated 10/18/2019 which shall become parts of this Ordinance.
