Ordinance 1986-03 ORDINANCE NO. _.iri_____:3_____ BEING AN AMENDMENT TO ORDINANCE #83-15 REQUIRING WOOD SHAKES AND SHINGLES TO BE FIRE RETARDANT TREATED WOOD, PROVIDING FOR A PENALTY CLAUSE,PROVIDING A SEVERANCE CLAUSE, PROVIDING FOR PUBLICATION, AND AN EFFECTIVE DATE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, COLLIN COUNTY, TEXAS: SECTION 1. That Ordinance #83-15 is hereby amended by adding there to a new section to read as follows; (g) All wood shakes and shingles installed on any structure shall be fire retardant treated wood as defined in Section 407 of the Uniform Building Code 1982 Addition. SECTION 2. (PENALTY) Any person, firm, corporation or other entity who is found guilty of violating the terms of this ordinance shall be deemed guilty of a misdemeanor and upon conviction of any such violation, shall be subject to a fine not to exceed the amount permitted by State Law. SECTION 3. (SEVERABILITY) It is het~eby declat~ed to:. be the intention of the City Council that the sections, paragraph, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence or section of this ordinace shall be declared unconstitutional or unvalid by any judgement or be declared or decree of a court of competent jursidiction, such unconstitutionality or ivalidity shall not affect any other remaining phrase, clause, sentence paragraph or section of this ordinance; and the City Council haereby declares it would have passed the remaining portions even though it had known the affected parts would be held unconstitutional. SECTION 'f. (PUBLICATIONS) The captic'Y'1 of this ordinance shall be published one time in a newapaper of general distrbution in the City of Wylie. SECTION 5.
