Ordinance 1986-52 ORDINANCE NO. 1r~~~ AN ORDINANCE OF THE CITY OF WYLIE, A HOME RULE POLITICAL SUBIDIVISION OF THE STATE OF TEXAS, AMENDING ORDINANCE NO. 84-12, THE FEE ORDINANCE OF THE CITY OF WYLIE, ADDING A NEW SUB-SECTION 6.01 ESTABLISHING AN AMOUNT FOR CONSTRUCTION MAINTENANCE BONDS TO BE POSTED WITH THE CITY 8Y A SUBDIVISION DEVELOPER/BUILDER. WHEREAS, the City Council of the City of Wylie, deems it necessary and proper to establish criteria for the posting of maintenance bonds when building and developing a subidivision within the corporate limits of the City; THEREFORE, as provided in the Subdivision Regulations of the City of Wylie, Section 8 a subdivider shall provide a maintenance bond as follows: SECTION 6.01 - MAINTENANCE BONDS: Any subdivider/devloper shall furnish a maintenance bond for one year from date of acceptance, an irrevocable letter of credit for one year, or place in escrow for one year from date of acceptance, an amount that represents ten percent (10%) of the total cost of public improvements (streets, drainage, water/sewer lines, etc.) for said development in order to indemnify the City against any repairs which may be necessary in connection with construction of said improvements arising from defective workmanship or materials for a period of one (1) full year from final acceptance of each phase of the development. Final acceptance of a subdivision or a phase of a subdivision will be withheld until said maintenance bond or proof of establishment of escrow account has been furnished to the City. EFFECTIVE DATE: This ordinance shall become effective immediately upon passage and approval by the City Council of the City of Wylie. PENALTY: Any person who in any way violates the terms of this ordinance shall be deemed guilty of a misdemeanor and upon conviction of any such violation shall be subject to a fine of not less than $1.00 nor more than $200.00. SEVERABILITY: All ordinances or parts of the ordinance in conflict herewith are specifically repealed and are superceded by this ordinance. All other parts of such ordinances are not repealed and remain in effect. PASSED AND APPROVED ON THIS THE L'~_DAY O~ ~_1986. /
