That the construction of any structure crossing a public drainage system without first securin; a permit from the City of vJylie is prohibited. That all applications for such construction shall be made at least 48 hours prior to the construction so that proper eleva- tions can be established and grade stakes set and that after such elevations are established ani?:;rade stakes placed, the City Secretary shall issue a permit for the construction. Section 2. That the flow line shall meet the elevation established by the City; and that after construction the owner snall keep the conduit free of all obstructions. Section 3. That the owner or contractor shall use reinforced con- crete pipe or conduit approved by the City; that the construction of nOip" type driveways across open ditches is expressly prohibited. Section 4. That the City shall have the authority to resize and relocate existing pipes in order to correct drainage and that the City shall keep tte salva!,ed pipe which has been replaced. Section 5. rhat the property o"mer shall maintain the driv8'\\1ay surface to the point 'l'Jhere the private dri ve1'lay reaches the surfaced portion of the street. Section 6. A..'1yone violating t~i2 'Provisions of any section of this ordinance shall bec;uilty of a lJ'sdemeanor and upon conviction shall be fined in any sum not exceeding ,$200.00. The fact that trere is much drainage obstruction and. that the use of certain types of construction further obstrucT,s drainage, and the fact that UiGre is no ordinance regulatin;; such construction in the City of 11Jylie creates an emer~ency for the immediate preservation of the property, health and safety and requires that this ordinance take effect immediately after its passage and it is accordingly so ordained.
