Chair Jason Potts called the meeting to order at 6:30pm and announced the presence of a quorum. Board Members in attendance; Chair Jason Potts, Vice Chair Byron Betler, Board Member Robert Blair, Board Member Andres Gonzalez, Board Member Lisa Shields, and Board Member Dan Norris. Board Members absent: Board Member Shaun Chronister. Staff present were Mr. Jasen Haskins, Planning Manager, Mr. Kevin Molina, Senior Planner and Ms. Tina Link, Deputy Secretary. CITIZENS COMMENTS ON NON-AGENDA ITEMS Residents may address the Board regarding an item that is not listed on the Agenda Residents must fill out a non-agenda form prior to the meeting in order to speak. The Board requests that comments be limited to three (3) minutes. In addition, the Board is not allowed to converse, deliberate, or take action on any matter presented during citizen participation. No one addressed the Board. CONSENT AGENDA All matters listed under the Consent Agenda are considered to he routine by the Board and will be enacted by one motion. There will not be separate discussion of these items. If discussion is desired, that item will he removed from the Consent Agenda and will he considered separately. A. Consider and act upon approval of the Minutes for the March 16, 2020 Meeting. Board Action A motion was made by Vice Chair Betler, and seconded by Board Member Blair, to approve the minutes as submitted. A vote was taken and carried 5 —O. Hold a Public Hearing to consider and act upon a request by the City of Wylie for a variance to Section 22-448 of the Sign Ordinance to allow for an increase of the width of one monument sign located at 2000 N State Hwy 78. ZBA 2020-08 Staff Comments Mr. Molina stated that the subject property is located at 2000 N Hwy 78 and is currently zoned Commercial Corridor The applicant is seeking a variance to allow for a maximum width of 11' in lieu of a maximum width of eight feet for a monument sign. Public comment forms were mailed to 13 property owners. No responses were returned in favor or in opposition of the variance proposal. Board Discussion Board Members discussed the location and size of the sign and whether it was consistent with other Public Safety Buildings signs. Staff's response to the requested variance width was that it was not dependent on the intended use but on the overall lot's size. Public Comments Chair Potts opened the Public Hearing. No one spoke during the Public Hearing. Chair Potts closed the Public Hearing. Board Action A motion was made by Board Member Gonzalez, and seconded by Vice Chair Betler, to grant the variance to Section 22-448 of the Sign Ordinance to allow for an increase of the width of one monument sign. Property located at 2000 N Hwy 78, Lot 1, Block D of Woodlake Village Addition. A vote was taken and carried 5 —O. 2. Hold a Public Hearing to consider and act upon a request by Teferi Abebe for a variance to Section 3.2.B of the Zoning Ordinance to allow for a side setback of 5' for the placement of an attached covered patio located at 227 Lake Travis. ZBA 2020-09 Minutes June 15,2020 Zoning Board of Adjustment Page 2 Staff Comments Mr. Molina stated that the property is located at 227 Lake Travis and is currently zoned Single Family 10/24. The applicant is seeking a variance to allow for a 5 foot side setback for the placement of an attached Patio cover that measures 140 square feet. The 5 foot side setback request is in lieu of the normally required 10 foot rear setback. The applicant requested for the cover patio to be allowed as his property has a side door and no rear door. The applicant is proposing to place the covered patio where the existing door is located. Public comment forms were mailed to 31 property owners. One response was received in favor and one in opposition of the request. Board Discussion Board members asked questions regarding the height and placement of the covered patio. Staff's response was that the covered patio would be visible from the right of way as it would be attached to the roof of the existing home. An aerial image of the subdivision showed that multiple households have covered patios with similar setbacks to what the applicant was requesting. Public Comments Chair Potts opened the Public Hearing. No one spoke during the Public Hearing. Chair Potts closed the Public Hearing. Board Action A motion was made by Vice Chair Betler, and seconded by Board Member Gonzales, to grant the variance to Section 3.2.B. of the Zoning Ordinance to allow for a side setback of 5 feet for the placement of an attached covered patio located at 227 Lake Travis Dr. A vote was taken and carried 5 —0. 3. Hold a Public Hearing to consider and act upon a request by Toshiki Watson for a variance to Section 3.2.B of the Zoning Ordinance to allow for a front setback of 11' and a rear setback of 10' for the placement of a new single family home located at 603 E. Marble Street. ZBA 2020-10 Staff Comments Mr. Molina stated that the applicant is seeking a variance to allow for a 11 foot front setback and 10 foot rear setback in lieu of the required 25 foot for the placement of a single family home. A hardship may exist in this case due to the lot being platted in the 1940s. The lot was platted with Minutes June 15,2020 Zoning Board of Adjustment Page 3 the street frontage being wider than its depth. The applicant's request is to allow for the east side yard to function as a rear yard. Public comment forms were mailed to 14 property owners. One response was received in opposition and none in favor of the request. Board Discussion Board Members asked what was located adjacent to the subject property. Staff's response was that there was a parking lot on the east side, a single family home on the west side, and a restaurant on the north side. Public Comments Chair Potts opened the Public Hearing. No one spoke at the Public Hearing. Chair Potts closed the Public Hearing. Board Action A motion was made by Board Member Gonzales, and seconded by Board Member Blair, to grant the variance to Section 3.2.B of the Zoning Ordinance to allow for a front setback of 11 foot' and a rear setbacks of 10 foot for the placement of a new single family home located at 603 E Marble St. A vote was taken and carried 5 —O.
