Ordinance 1968-06 NO. ta<i-t AN OR~INANCE REGULATING THE KEEPING AND POSSESSING OF LIVESTOCK WITHIN THE CORPORATE LIMITS OF THE CITY OF VJYLIE, TEXAS, AND SETTING OUT THE RULES AND CONDITIONS GOVERNING THE SAHE; H1POSING A PENALTY FOR VIOLATION THEREOF; REPEALING CONFLICTING ORDINANCES AND PROVIDING FOR AN EHERGENCY. WHEREAS, because of lack of proper regulation of livestock, there exists in many parts of the City of Wylie unsanitary conditions where flies breed and disease is cultured, where odors are obnoxious to the neighbor- hood, where unsightliness is evident and the need for regulation is great; and WHEREAS, the City Council of the City of Wylie, in the exercise of discretion reposed in it by law, in order to promote the public welfare, health and comfort of the people has decided that it is necessary and advisable to regulate the raising, keeping and harboring of live- stock within the corporate limits; therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: HOGS, COWS, HORSES, MULES, SHEEP, GOATS AND OTHER LIVESTOCK (a) NUMBER LIMITED. It shall be unlawful for any person, firm, or corporation to keep, harbor or raise any hogs, cows, horses, mules, sheep, goats and livestock within the City Limit of the City of Wylie, Texas where the pen or enclosure is less than 400 square feet of which is the equiv- alent of 20 feet by 20 feet per animal. (b) LOCATION OF PENS. hogs, cows, horses, mules, sheep, goats, and other livestock shall be kept in a suitable pen or enclosure, so that no part of the pen or enclosure shall be closer than 50 feet from any inhabited dwelling, provided that this distance requirement shall not apply to the dwelling of the owner himself. SECTION 2: CHICKENS, DUCKS, GEESE, AND OTHER FmJL (a) NUMBER LIMITED. It shall be unlawful for an person, firm, or corporation, to keep, harbor, or raise any chickens, ducks, geese, and other fowl within the City Limit of the City of Wylie, Texas where the pen or enclos- ure is less than 9 square feet per fowl. (b) LOCATION OF PENS. Chickens, ducks, geese, and other fowl shall be kept in a suitable pen or enclosure, so that no part of the pen or enclosure shall be closer than 50 feet from any inhabited dwelling, provided that this distance requirement shall not apply to the dwelling of the owner himself. SECTION 3: SANITARY CONDITIOlJ OF PEN OR ENCLOSURES All pens or enclosures of all animals shall be main- tained and kept in such condition as not to become unsan- itary, offensive or disagreeable to persons residing in the vicinity thereof nor snall they be so maintained or kept to permit the breeding of flies or in any manner cause injury to the health or comfort of the public or any person working or residing in the vicinity of said pen or enclosure. All pens and enclosures shall be cleaned at least twice each week and the manure or refuse on such pens or enclosures shall be promptly removed from the vicin- ity after each cleaning. SECTION 4: PENALTY FOR VIOLATION An person, firm or corporation violating this ordi- nance or any section thereof shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be fined in any sum not less than One Dollar ($1.00) nor more than One Hundred Dollars; each day the violation shall be deemed a separate offense. SECTION 5: EFFECTIVE DATE The fact that the City of Wylie is without an ordi- nance regulating tne keeping and possessing of livestock and fowls within the City Limits creates a health hazard and an emergency and it is necessary for the health, safe- ty and protection of the Citizens of ~'lylie that this ordi- nance shall take effect immediately after its passage and publication. SECTION 6. SAVINGS CLAUSE In the event that any section or portion of this ordi- nance should for any reason be held invalid, nevertheless, all the remaining sections and portions thereof shall not be impaired or affected thereby, but shall remain in full force and effect. SECTION 7. CONFLICTS All ordinances or parts of ordinances inconsistent or in conflict with the provisions of this ordinance shall be and the same are hereby expressly repealed.
