CALL TO ORDER
Announce the presence of a Quorum.
Chair Linda Jourdan called the meeting to order at 7:02 p.m. and stated that a
quorum was present. Board Members present were; Vice-Chair Marilyn Herrera,
Board Member Bill Baumbach, Board Member Bryan Rogers, and Board Member
Jeff Ellis. Board Member Karyn McGinnis was absent.
Staff members present were: Senior Planner Charles Lee, Assistant Planner
Jasen Haskins, and Administrative Assistant Mary Bradley.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes of the July 28, 2008
Meeting.
A motion was made by Vice-Chair Herrera, and seconded by Board Member
Baumbach, to approve the Minutes from the July 28, 2008 Meeting as submitted.
Motion carried 5 — 0.
PUBLIC HEARINGS
1. Hold a public hearing to consider and act upon a request by Mindy
Manson for a Variance to Section 5.5.A of the Zoning Ordinance
requiring that all temporary uses operate 90 days or less within a
one-year time frame, properties located at 2000 S.H. 78 North and
949 Hensley. (ZBA 2008-06)

Mr. Haskins stated that the subject properties are Tract 195 of Abstract 688-2
Francisco de la Pina Survey and Lot 2 Block A of the Wylie High School Addition,
located at 2000 S.H. 78 North and 949 Hensley Lane, respectively.
The applicant was originally granted a variance to the 90 day time limit in
September 2005. The applicant is currently requesting an extension for the
variance for another three years or until the completion and occupancy of the
new Civic Center.
Public comment forms were mailed to 31 property owners within 200 feet of this
request, and no responses either in favor or in opposition of the request was
received.
Mindy Manson, City Manager, City of Wylie, gave an update of the new Civic
Center. The design stage is complete for the new Civic Center, and ninety-nine
(99) percent of the construction plans are complete. When complete the
construction plans will be given to the Construction Manager to prepare for the
bidding process. The new facility will take approximately two years to complete,
and the goal is to break ground in October or November.
Chair Jourdan opened the Public Hearing. No one approached the Board
Members, Chair Jourdan closed the Public Hearing.
A motion was made by Board Member Ellis, and Board Member Rogers
seconded, to Grant the request for a variance to Section 5.5.A. of the Zoning
Ordinance requiring that all temporary uses operate 90 days or less within a one-
year time frame, properties located at 2000 S.H. 78 North and 949 Hensley.
(ZBA 2008-06). Motion carried 5 — 0.
2. Hold a public hearing to consider and act upon a request by Dan
Robertson for a Variance to Section 3.2.B.3 of the Zoning
Ordinance requiring a side yard setback of 25 feet, property located
at 431 Carver Drive being Lot 22, Block 3 of the Meadowview
Estates Addition (ZBA 2008-07).
Mr. Haskins stated that the subject property is located at 431 Carver Drive and
was platted in June 2004. The applicant requests a variance to the requirement
for a side yard setback of twenty-five (25) feet to nineteen (19) feet in order to
build a residential structure of approximately 2,836 square feet. The property is
located a corner lot, therefore has twenty-five (25) foot building line on the side
and on the front. The purpose of the building setback requirement is to preserve
and promote open space, increase visibility, and add to neighborhood safety.
Public comment forms were mailed to twenty-six (26) property owners, as
.a.A, required by State Law. No responses were received either in favor or in
opposition.

Dan Robertson, Crestmark Homes, 201 Edison, Wylie, Texas, applicant for the
request, stated that the intention is to build a wider footprint than what is currently
built within the development. The proposed structure will be a one-story 2,400
square foot residential home, because the perspective homeowner is requesting
an open porch. A formal dining room is offered on the plan, but the perspective
homeowner does not wish for a formal dining room. However, the proposed
homeowner has requested an open porch, being located on right hand side of
the proposed residential structure.
Chair Jourdan opened to the Public Hearing.
Mr. Gene Vick, 1414 Texoma Park, Kingston, Oklahoma, perspective
homeowner and resident, stated that the desire to build a one-story home on a
corner lot and have a covered opened porch, not an enclosed porch. A formal
dining room will not be used, but a covered porch will be enjoyed daily.
Chair Jourdan closed the Public Hearing.
A motion was made by Board Member Rogers, and seconded by Board Member
Ellis, to Grant the variance to Section 3.2.B.3 of the Zoning Ordinance requiring a
side yard setback of 25 feet, with a stipulation that a covered opened porch be
located on the right hand side of the residential structure, property located at 431
Carver Drive being Lot 22, Block 3 of the Meadowview Estates Addition. Motion
carried 5 — 0.
ADJOURNMENT
A motion was made by Board Member Baumbach, and seconded by Board
Member Ellis, all Board Members were in consensus, and the meeting adjourned
at 7:35p.m.
