Ordinance 1974-03 ORDINANCE NO. 74-3 AN ORDINANCE ORDERING IMPROVEMENTS OF VARIOUS STREETS AS DESCRIBED IN APPENDIX TO THIS ORDINANCE~ DECLARING SAID IMPROVEMENTS TO BE IN THE PUBLIC INTEREST~ PROVING THAT THE CITY SHALL PAY FOR ONE-THIRD OF SAID COSTS AND FOR INTERSECTION~ DIRECTING THE CITY MANAGER TO PREPARE ESTIMATES~ PROVIDING FOR ASSESSMENTS ON THE PROPERTY FRONTING ON IMPROVED STREETS~ PROVIDING FOR METHOD OF PAYMENT OF COSTS AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: That the streets described in the appendix attached hereto to be paved by the City of Wylie, Texas. SECTION 2: That the paving of said streets by the City of Wylie, Texas, is deemed to be in the public interest of the City of Wylie, Texas. SECTION 3: That the City of Wylie, Texas, shall pay one-third of the cost of paving and at the intersection of streets, from lot to lot across the street either way shall be paid for by the city alone. The owners of property shall pay two thirds the cost of paving and the total cost of curb and gutter. SECTION 4: That the City Manager of the City of Wylie, Texas, prepare estimates of cost and in the cost report show a full list of all lots or fractional lots, giving number and/or size of same, and the number of the block in which situated, and the name of owner thereof, if known, and such other information as may be required to identify said lot and if there be a lot or fractional lot the owner of which is not known, the same shall be entered on said ( report as unknown. The City Manager shall enter on said list " opposite each lot or fractional lot lying and being on each side of the street to be improved one-third of the estimated expense for such street improvement on the street fronting, adjoining or opposite such lot or fractional lot. SECTION 5: That upon acceptance and approval of the report of estimates by the city Council, said amount shall be imposed, levied and assessed as taxes and shall be a lien upon the property until the payment of same and shall be collected in equal annual payments for a period of five years, all moneys so collected from the assessments shall be appropriated to the payment of the cost of improvement, all of this by virture of Articles 1082 and 1083 of the Revised Civil Statues of the State of Texas. SECTION 6: The fact that the condition of portions of said streets herein ordered improved endangers public health and safety, constitutes and creates an urgent public necessity requiring that this ordinance be passed as an emergency measure and that this ordinance be in force and effect immediately from and after its passage.
