ORDINANCE NO. 75'-3 AN ORDINANCE OF THE CITY OF WYLIE, TEXAS ESTABLISHING THE COMMON EXTRATERRITORIAL JURISDICTION BOUNDARY LINE BETWEEN THE CITY OF WYLIE, TEXAS, AND THE CITY OF ST. PAUL, TEXAS 1 AND PRO- VIDING FOR AN EFFECTIVE DATE. WHEREAS, it is the desire of the cities of Wylie and St. Paul to establish their common extraterritorial jurisdiction boundary line in accordance with Article 970a Section 3(B) V.A.T.S. In order to accomplish this end, the governing bodies of the Cities of Wylie and St. Paul have met and entered into a comtract, a copy of which is attached hereto and marked Exhibit II All , apportioning, by mutual agreement, the areas of overlapping extraterritorial jurisdiction1 NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1. That the following-described boundary line be and the same is hereby declared to be official common extraterritorial jurisdiction boundary line between the city of Wylie and the City of St. Paul in order to accomplish the purposes set forth above, said boundary line being more particularly described as follows, to-wit: BEGINNING at a point in the present corporate limit line of Wylie, Texas, said point being at the junction of the east right-of-way line of Farm Road No. ~378 and the north boundary line of the J. C. McUlmurry Survey Abstract 6291 THENCE easterly following the north boundary line of the J. C. McUlmurry Survey, to a point for corner, said point being the intersection point of the W. D. Burnett Survey Abstract 56 and the J. C. McUlmurry Survey Abstract No. 6291 THENCE in a southerly direction at all times following the east line of the J. C. McUlmurry Survey and the Charles Atterbury Survey, Abstract No. 22 to a point for corner in the east property line of Tract No. 1 (105 acres) in a Deed of Trust from T. F. Birmingham, dated August 25, 1950, same being the northwest corner or Tract No. 5A and said Deed of Trust, dated November 1, 1940: THENCE easterly following along the north property line of Tract 5A and 5B to the west survey line of the W. D. Penny Survey Abstract No. 696: THENCE southerly following along the west survey line of the W. D. Penny Survey Abst. 696 to a point for corner, said point being the southwest corner of a 39.98 acre tract out of the W. D. Penny survey belonging to the Knox Supply Co. as filed in Collin County Deed of Records, Volume,N.K /((}ttJf3, Page /'Y5'C:.- . THENCE easterly along the south property line of said 39.98 acre tract to the south westerly right of way line of FM 25141 THENCE IN a southerly and easterly direction at all times following the west and south right-of-way lines of Farm Road 2514 to the intersection of Farm Road 2514 and a County Road commonly referred to as the Paul Wilson Road1 Page 2 THENCE easterly crossing Farm Road 2514 to the north right-of-way line of the Paul Wilson Road and continuing in an easterly direction to a point for corner, said point being the west survey line of the Francisco De La Pina Survey, Abstract 6881 THENCE northerly and at all times fOllowing the west survey line of the Francisco De La Pina Survey to the point of intersection with the southern boundary line of the John C. Campbell Survey, Abstract 239, said point being the most northwestern corner of the Francisco De La Pina Survey. SECTION 2. That the portion of the above described land now under lease to the Wylie Northeast Water Supply Corporation, by the Vantage Properties, Inc., in a lease agreement signed the 25th day of October, 1974, and filed in Collin County Deed of Records, Vol. 934, Page 460, be within the future city limits area of the City of St. Paul, Texas. SECTION 3. The fact that the best interest and welfare of the general public will be served by the City of Wylie and the City of St. Paul establishing a common extraterritorial jurisdiction boundary line, requires that this Ordinance shall take effect immediately from and after its passage, and it is accordingly so ordained. PAUL. TEXAS, are parties to the Contract 1 and WHEREAS, Article 3, Section 64 of the Constitution of the State of Texas authorizes cities to contract one with another for the performance of governmental functions required or author- ized by the Constitution or the Laws of the State of Texas: and WHEREAS, the parties agree that under this Contract the public welfare of each city will be enhanced by proper planning for orderly growth1 and WHEREAS, the parties further agree that under thds Contract1 citizens, property owners, and corporate firms presently located or which may in the future be located, within the area between each city ~ll be benefited in planning and developing their property, homes and businesses1 and WHEREAS, the parties further agree that it is in the in~erest of the Citizens of this area to reach voluntary agreement concern- ing the location of future mutual boundaries between the various cities1 NOW, THEREFORE, it is hereby mutually agreed by the duly e1ected officials of the CITY OF WYLIE, TEXAS, and the CITY OF ST. PAUL, TEXAS: 1. That, in accordance with council ordinance duly passed and adopted by the CITY OF WYLIE, TEXAS, at the council meeting of ~/2 // <2.( , 1975, and in accordance with council ordinance duly passed and adopted by the CITY OF ST. PAUL, TEXAS at the council meeting of ~/CC-H AI ,1975, the mayor or city manager and secretary of the respective cities are there- by authorized to execute this agreement on behalf of the Citizens of said Cities. 2. That the following described boundary between the CITY OF WYLIE, TEXAS, and the CITY OF ST. PAUL, TEXAS, is voluntarily agreed upon by the duly elected mayor and council of each of said cities, and that the following described boundary be accepted by the citizens of said cities as the common boundary between the said cities. 3. That the following described boundary between the CITY OF WYLIE, TEXAS, AND THE CITY OF ST. PAUL, TEXAS, shall be recognized with respect to future development of each city, but that the land which is encompassed by the mutual boundary other than the land presently within the said cities, shall not be subject to taxation by either respective city until such time that land is legally annexed to that respective city. 4. That the extra-territorial jurisdiction of each city shall remain in accordance with the terms and conditions of the 1963 MUnicipal Annexation Act. 5. The boundary line between the CITY OF WYLIE, TEXAS, and the CITY OF ST. PAUL, TEXAS, shall be as follows: BEGINNING at a point in the present corporate limit line of Wylie, Texas, said point being at the junction of the east right-of-way line of Farm Road No. 1378 and the north boundary line of the J.C. McUlmurry Survey Abstract 629. THENCE easterly fOllowing the north boundary line of the J.C. Mc- Ulmurry Survey, to a point for corner, said point being the intersection point of the W.D. Burnett Survey Abstract 56 and the J.C~,.'McUlmurry Survey Abstract No. 629; THENCE in a southerly direction at all times following the east line of the J.C.
